SUBJECT: Assessment Against McCarthy Tank & Steel
for Curb, Gutter and Sidewalk Improvements at
313 South Street
CAO RECOMMENDATION:
Adopt resolution changing assessment
BACKGROUND:
At the meeting of December 4, 1990, McCarthy Tank & Steel protested the
assessment against their property for curb, gutter and sidewalk for
property at 313 South Street. The Council overruled McCarthy's protest
and determined that a lien should be placed against the property
following provisions of the 1911 Act. McCarthy's property was placed
on Exhibit A of Resolution 6906.
McCarthy's attorney has since reviewed longtime City policy, and
presumably further reviewed legal issues, and has determined that they
will not continue legal proceedings with the City. They have asked
that their property be placed on Exhibit B, thus allowing a three year
payment. City staff has no objection and has prepared the attached
resolution modifying Resolution 6906, thus placing the McCarthy
property on Exhibit B.

RESOLUTION NO. (1991 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
LUIS OBISPO MODIFYING RESOLUTION 6906 WHICH
DEALS WITH COSTS OF CURB, GUTTER AND SIDEWALK
CONSTRUCTED UNDER THE 1911 SIDEWALK ACT
WHEREAS, on December 4 , 1990 the City Council adopted
Resolution 6906 containing Exhibits A and B, and
WHEREAS, McCarthy Tank & Steel, 313 South Street was shown
on Exhibit A and has now requested that they be shown on Exhibit
B, thus permitting a three year payment.
THEREFORE BE IT RESOLVED that Resolution 6906 is hereby
modified allowing McCarthy Tank & Steel, 313 South Street, to be
removed from Exhibit A and included on Exhibit B.
