HomeMy WebLinkAbout02/19/1991, 1 - AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO TRANSIENT OCCUPANCY TAX RATE ORDINANCE NO. (1991 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING CHAPTER 3.04, SECTION 3.04.030 OF THE MUNICIPAL CODE, TRANSIENT OCCUPANCY TAX RATE WHEREAS, applicable state legislation provides the authority for counties and cities to levy a hotel and motel room tax; and WHEREAS, the Constitution of the State of California provides additional authority to charter cities to levy such taxes; and WHEREAS, the City Council has identified the need for increased financial support for the usual and current expenses of the City, and to fund City projects and programs on an ongoing basis by raising the Transient Occupancy Tax from six percent (6%) to nine percent (9%); NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Municipal Code Section 3.04.030 is hereby amended to read in full as follows: "3.04.030 Imposed. "For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of nine percent (9%) of the rent charged by the operator. The tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments a proportionate share of the tax shall be paid with, each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the Tax Administrator may require that such tax shall be paid directly to the Tax Administrator." / 7 Ordinance No. (1991 Series) SECTION 2 This ordinance, inasmuch as it provides for a tax levy for the usual and current expenses of the City, shall take effect immediately upon adoption, except that the additional tax imposed by this ordinance shall become operative and be imposed on May 1, 1991 and shall not apply prior to said date. SECTION 3. This ordinance, together with the ayes and noes, shall be published once within five (5) days in a newspaper of general circulation, but delay in publication, or even failure to publish, shall not affect the validity of the ordinance. From what we understand, the tax would be increased from the current 6% rate to a 9% rate, an effective increase of 50V We believe that such an increase is ill advised and would negatively impact not only local lodging businesses but all tour and travel related businesses in the city. The original purpose of this tax was to be in advertising and promoting tourism in San Luis Obispo, if this were so, what portion of the now 6% tax is being used for that purpose and what purpose would the monies from the increased tax be used? Madonna Inn is specifically concerned about the impact the proposed increase will have on all of our current business, as well as the disruption of any possible future business with our tour groups and individual guests. As we are in the business of catering to honeymooners, anniversary couples and group tours who are often repeat customers, these customers. may choose to travel minutes away from our city to stay instead of paying higher rates, which we do not have the opportunity to explain to them is caused be increased occupancy tax. In a city that relies on tourism for much of its livelihood, we believe that we cannot afford to do anything that has even the slightest potential of discouraging tour and travel dollars from being spent in San Luis Obispo! As business is already influenced by this city's nonsmoking ordinance, for example we have had numerous complaints from customers state their dislike of this ordinance and the fact that they will no longer stay in San Luis Obispo when traveling through this area. Jerry, we urge you to rethink your action on the nonsmoking and to vote no against the proposed Transient Occupancy Tax increase. Planning Staff City of San Luis Obispo Dear Glen , As a follow up to the Planning Commission study session of last week, Citizens' Planning Alliance of San Luis Obispo County has the following concerns about the scope of the proposed economic study; A. The proposed economic study focuses on the negative economic impact of limiting growth on those interests which would presumably profit from new development ,while ignoring the costs , both economic and enviornmental , of not controlling growth to the existing residents of San Luis Obispo . If we are going to ask, "What is the economic impact of limiting or conditioning (affordable housing a condition of annexation) new development on developers of annexations or businesses?" , the question must also be asked, "What is the cost of this new development to the existing residents • of the city of San Luis Obispo?" While new development , both residential and commercial , may benefit some, there are costs to others . With water alone ,new development has had a cost to existing residents of the city .Economically, existing residents are paying more for less water while also suffering a decline in their "quality of life" . . .dying gardens , unflushed toilets , �e etc . . Traffic congestion and the costs of building new R E C El V E D roads , declining air quality and the future cost of cleaning it up, school crowding and the need to build new schools are JdN 2 �QQ1 all "costs" of new development paid for by existing residents al L� These costs to existing residents should be included in any 9ANL SOBIS a economic study (see "Growth Controls ; Policy analysis for the second Generation" , Navarro and Carson) . B.This brings to question , the process of separating the economic effects of the proposed draft from -the enviornmental effects , making a study of only the economic. 'effects and then making decisions based on economics alone , without study or knowledge. of the enviornmental effects .The natural enviorn- ment , which is considered by its residents to be our city' s greatest strength, is not receiving the same weight as economics . The General Plan Survey , which gives us what residents want , told us that residents were not willing to accomodate develop- ment and economic growth if it meant any increase in air pollution . We are asking for the economic cost of limiting new development without any discussion of the enviornmental benefits of limiting new development . Perhaps the City Council might be asked to reconsider their request to use this process rather than the tradional planning process of examining enviornmental and economic effects at the same time . D. If an economic study is done, it should be "framed" within the desires of community residents , not a vacumm. Residents voted to control commercial growth recently . Residents were polled at the beginning of the General Plan process and the natural beauty of the area, including its clean air and open space, was considered the areas most important strength and the single most important aspect of the quality of life to its residents . Residents also wanted more services to protect the peaks , hillsides , creeks and marshes . On the other hand, excessive growth was considered San Luis Obispo' s greatest problem. Any consultant should "frame" - an economic discussion within this greater picture of community desires . C . If an economic study is done , the following questions should be considered: 1 . Given the water , air , sewer , school , traffic and other resource limitations of our community, what is the cost of new development to existing residents? Contingent valuation and other methods should be used to thoroughly assess the complete costs of new development to existing residents . 2 . As a community , we have a very limited ammount of prime agricultural land. Is it prudent to give up this limited prime agricultural land in order to have more commercial and residential development? As a community , should we give up our ability to produce a basic commodity . . . . food? The City of Arroyo Grande just received a $25 , 000 grant from the Costal Conservancy for an "Agriculture Feasibility Study" . Could Conservacy funding be obtained to pay for our "Agriculture Feasib- ility Study"? 3 . City residents are willing to pay more and/or divers= money to keep peaks , hillsides , creeks and marshes open according to the City' s General Plan Survey . . What are the methods for funding this directly , in ways not dependent on new development (and its attendent "costs" to existing residents) ? Bed tax increases , direct funding through bonds , transfer taxes , etc , should be included. %0,` 4 . What would the impact of pricing public resources closer to their real cost or their market value? (Developers were willing to pay up to $10, 000 per dwelling for retrofitting, yet the city charged only a very small fee for water connection while existing residents are "paying" more for less water .) To what extent do new annexations and development represent a "transfer of wealth" from existing residents? 5 . What is the feasibility of setting a list of " community priorities" and then ranking the desirability of new development proposals according to community priorities? (The city of Pasadena has done this for new development) Free market competition would then become more of a part of the development process and the city would be encouraging new development which is beneficial to the city . 6 . Larger Commercial development with headquarters outside of our area is not the same as small local commercial development . Sales income is exported from our area by large corporate commercial development and small local commercial development is often adversely effected by their presence . Any economic study should differentiate between these ..:types of new development , especially as it effects our smaller local businesses . Is there a point at which existing local businesses are weakened by additional development ? 7 . We have experienced considerable retail and tourist development since th'e 1983 "Strategic Planning Program" . What has been the effect of this? Has this new development funded the protection of our natural enviornment? Favorably affected the jobs/housing balance? Improved or diminished the quality of life for existing residents? 8 . How can the city asses*development and expansion areas so that funding for the needed new or expanded resources and/or facilities does not require the city to then institute rates or types of potentially less desireable development to be fiscally solvent? ( Look at other areas for examples .) 9 . To what extent has the city solicited initial advice from recognized authorities on economic studies such as Navarro and Carson , for questions which should be contained in an economic analysis of the cost/benefits of limiting or not limiting new development? The purpose of the this economic evaluation should be to obtain a comprehensive socioeconomic statistical analysis of the full range of scarcity, amenity, and distributional consequences of adopting various versions of the Draft Land Use Element update. What are the economic effects of adopting the Draft Land Use Element in its current form? The analysis should include, but not limited to answering the following questions. A. What will be the Cost-Revenue impact of adopting the draft element? 1. Including an estimate of the full range of scarcity and amenity effects associated with alternative growth management proposals, (2) determination of the distributional and general welfare implications of these effects, and (3) examining the important collateral issues listed below. B. Will the I% cap on residential growth rates result in changes in the number of people per individual households? C. Will the draft element result in less jobs being created thus translating into a higher unemployment rate relative to the case of RECEIVED unconstrained growth in the rate of commercial development? 1. Will growth control reduce the housing supply in an absolute sense, or merely slow down the rate of expansion? 2. Will homeowners benefit from the wealth effects of an increase in equity if housing prices rise above what can be expected due to the cap on residential growth rates? E. Can the additional growth pay for itself in terms of providing revenues to finance incremental facilities and infrastructure? If not, what are the additional costs born by the existing residents? F. Will the rates of job formation and population growth be consistent with the City of San Luis Obispo's ability to provide the desired level of public services and infrastructure under the existing (or an alternative set of) fiscal and zoning rules? G. How do differing rates of population and commercial growth affect the tax base and per capita income? H. What are the amenity effects and their welfare implications induced by adopting the Draft Land Use Element (relative to the case of unconstrained growth)? A measurement of these growth induced externalities should include, but not be limited to the following areas. 1. Air Pollution a. Health damage b. Visibility impairment c. Mitigation costs 2. Public Safety a. Police protection b. Fire protection 3. Congestion a. Traffic-freeways b. Traffic-arterials c. Recreational facilities (parks, beaches, etc.) d. Public facilities (libraries, performing arts centers, etc.) e. Parking 4. Reliability a. of water supply b. of power supply 5. Loss of open space 6. Expenditure avoidance a. Sewage capacity b. Solid waste disposal site c. School overcrowding I. What transfers of income will result from adopting the Draft Land Use Element? J. If the plan to provide additional affordable housing available to low income individuals succeeds will the aggregate utility of the community rise? K. In the absence of growth controls, property tax limitations and rising marginal costs for public services will a disproportionate share of the costs of growth be born by existing residents? L. Wilt amenity effects realized by residents of San Luis Obispo be negated by spillover costs born by other communities? M. Do economically superior alternatives exist to the Draft Land Use Element in its current form? If so, what are they? We had a good discussion on the proposed Transient Occupancy Tax increase and their reaction to it. On Tuesday afternoon I was contacted by Maggie Cox who, on behalf of the three groups, made a request for continuation, so that they could have more time to study the matter and discuss the matter with their membership. I indicated to Maggie that I would recommend to the City Council that the matter be deferred for two weeks in order to give all parties the best opportunity to further discuss the matter. JD:mc C. This program is required by law and uses the Federal General Pretreatment Regulations (40 CFR Part 403) and City Sewer Use Ordinance to enforce the general discharge prohibitions and specific Categorical Pretreatment Standards . 40 CFR 403 . 8(f ) (3) requires that the City have adequate resources to implement the Pretreatment program. The City is proposing to establish an industrial user fee program sufficient to cover the cost of the Pretreatment program. The proposed fee program will charge a specific fee to all facilities under permit that use the City sewer . The fees , which are broken down into classes, are based upon the minimum amount of monitoring and inspection needed to insure compliance with Federal , State and Local discharge limits . The amount of required monitoring is governed by the classification of an industry and it 's potential to interfere with the operation of the Publicly Owned Treatment Works (POTW) . The proposed industrial user fees are as follows : 1 . Significant and Categorical Users Annual Permit Fees . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $1 , 140 .00 2 . Class I Users Annual Permit Fees . . . . . . . . . . . . . . . $570 .00 3 . Class II Users Annual Permit Fees . . . . . . . . . . . . . . $285 .00 4. Monthly compliance monitoring, sampling and follow-up inspections for noncompliance/violations to be billed at the hourly rates established in the Public Works Department "Labor and Equipment Rates" document . Significant and Categorical industries such as metal platers and industries that have a large potential to interfere with the POTW would be charged the highest fee. Class I facilities , such as , but not limited to, automotive repair, photo-finishing and dry cleaners and Class II facilities , primarily restaurants would be charged the corresponding fees because of a decreasing potential to effect the POTW. If you are unsure about your facility's classification, refer to your recently issued revised wastewater discharge permit . All County, State and Local agencies will be exempt from the fees except on the Federal level . The city is now seeking comments on the proposed fee program. All comments , suggestions and criticisms will be reviewed and considered by the City before submission of the program for approval . A public hearing will be held prior to approval of the fee program. All businesses affected by the program will be notified of the hearing by mail .
