Planning Commission Chair Gil Hoffmann participated in the interview. The Subcommittee is pleased to recommend that the following be reappointed for the terms as listed. In order to achieve the Council goal of staggered terms (two terms expiring each year), the appointments are for three and four years, respectively. Term to Expire Fred Peterson 3/31/94 Keith Gurnee 3/31/95 Applications for those not selected will remain on file for one year. They are available for review in the Council Office. The following information should be helpful in understanding the process which is consistent with City policy as provided in the Advisory Body Handbook. On January 31, 1991, the Subcommittee to the Planning Commission (Dunn/Rappa) was notified of current and previous applications on file. There was a large number of applications on file and in fairness to the current group of applicants,who were noticed that their applications are kept on file for at least one year, it was determined to interview all applicants not previously interviewed. It would not have been appropriate to advertise for more applicants when so many candidates were available,however, other advertisements during this period did state that applications were accepted year-round for all advisory bodies and an additional application was received for the Planning Commission in addition to the ten on file. The Subcommittee properly chose to interview those applicants who had never been interviewed previously. Appointments to the Planning Commission were originally scheduled for an agenda in March. However, when the Subcommittee, learned of an important conference (League of California Cities Planning Commissioner Institute on March 20-22, 1991), they deemed it appropriate to submit their recommendations to Council as soon as possible. This would enable the appointees to make plans for this meeting. Hence, the agenda for the 2/25/91 meeting was revised Friday afternoon and posted outside the door of City Hall in accordance with Brown Act requirements. Further, proper notice of the interviews were posted as well. For your information I provide the attached documentation. I was surprised because the printed agenda I received on Friday February 22 makes no mention of such appointments. No other members of the public I know have received a mailed or delivered agenda which indicates planning commission appointments are under consideration . After being told by various parties that such an item would come up at Monday's meeting, I checked the agenda posted on City Hall 's front door . The posted agenda is a different agenda from the one distributed to the public -- it does indeed include planning commission appointments! Given the controversial nature of such appointments, one might draw distasteful inferences from this discrepancy between distributed agendas and the posted agenda . Even if this discrepancy is legal , the situation negates the principles of open participatory government . It leaves the impression , were the council to proceed with the appointments on Monday, of an attempt to deceive the public . Many interested citizens do not know that planning commission appointments are imminent -- in part because opportunities to apply for the commission have not been advertised. I have had many questions directed to me about when advertisement for applicants will take place . I think the public will find it curious that no effort was made to recruit potential commissioners before appointments were announced. Not advertising vacancies also negates the principles of open participatory government , whether or not any legal issue is involved. I believe the appearance of poor public policy procedures and of indifference to open government is conveyed by the way the planning commission appointments are presently being handled. For the sake of good government , I urge you to go back to square one : advertise , offer the broadest possible public participation opportunities, and when it comes time to make the appointments offer generous public notification .
