Greg Smith, Associate Planner SUBJECT GP/R 1501: Consideration of amending the Land Use Element Map and Zoning Map to change the designations from Conservation/Open Space - 20 acre minimum (C/OS- 20) to Public/Semi-Public (PF) for property at the city's wastewater treatment plant, located south of Prado Road, adjacent to San Luis Creek. CAO RECOMMENDATION Adopt attached resolution approving General Plan Amendment GP/R 1501, and pass to print the attached ordinance rezoning the corresponding area from C/OS-20 to PF. DISCUSSION Background The council certified an EIR supplement for this project on January 15, 1991. The Planning Commission recommended council approval of the General Plan amendment and rezoning February 13, 1991. Data Summary Address: 35 Prado Road Applicant: City of San Luis Obispo Utilities Department Existing and Proposed Zoning: PF (Public Facility), C/OS-20 (Conservation/Open Space, 20-acre minimum lot size) Existing and Proposed General Plan: Public/Semi-Public, Conservation/Open Space Environmental Review Status: EIR supplement approved by council January 15, 1991. Action Deadline: November 15, 1991. Site Description i The project site involves approximately 17 acres of the property owned by the city south of Prado Road, between US 101 and San Luis Creek. The city's Corporation Yard and property used for a recycling center occupy other portions of the city-owned property. Several acres of the city property are undeveloped, and treated wastewater holding ponds occupy city property south of the treatment plant project area. Much of the project site is occupied by existing wastewater treatment and transit maintenance facilities. The site is surrounded by undeveloped land and service commercial uses to the north; service commercial and residential uses across the creek to the east; the treated wastewater ponds and undeveloped land to the south; and tourist commercial uses and vacant, GP/R 1501 Page 2 unincorporated land across the freeway to the east. EVALUATION The proposed general plan amendment and rezoning would extend the "Public Facility' designation south to include the area needed for the wastewater treatment plant expansion. Staff suggests the council consider the following issues in reviewing the amendment: A. General Plan Policies The Public Facilities policy section of the Land Use Element includes the following statement: 'The city will locate its facilities and advocate location of other agencies' facilities in order to ... make economical use of land and buildings already owned by public agencies and min;n„ze the displacement of existing private businesses or residents." Open Space policies state that the Conservation/Open Space designation will be applied: "to land which is unsuited to urban use because of: infeasibility of providing access or utilities consistent with policies under C.Ld above; excessive slope or slope instability; wildland fire hazard; noise exposure; flood hazard; scenic value; ecological sensitivity; and agricultural value." The Planning Commission determined that the proposed amendment will be consistent with relevant policies. B. Extent of Rezoning The boundaries of the proposed rezoning correspond very closely to the area to be developed with wastewater treatment facilities. A narrow strip of land between the proposed treatment facilities and the freeway - designated on use permit plans as "future bus parking" - is also included. The Planning Commission required deletion of the bus parking designation from the use permit site plan, but the commission's recommendation to approve the General Plan amendment includes the area within the PF designation. Commission action on the use permit also included a requirement for creation of a four-acre pond/wetland habitat. Although that requirement has also been appealed to the council, the proposed rezoning boundaries would leave ample C/OS zoned land to accommodate the wetland habitat Although specific plans have not yet been presented to the commission, Public Works staff indicates that some of the vacant and under-developed areas in the corporation yard area will be needed for expansion of the corporation yard facilities. (An application for outdoor material storage and composting of tree trimmings,in the area north of the transit maintenance facility, will be considered by the commission in March.) Since some flexibility in accommodating future corporation yard expansions is desirable, and since the treatment facilities will extend to the southerly boundary of the rezoning area, the site. 6Z GP/R 1501 Page 3 proposed rezoning boundaries are appropriate regardless of the council's action on the use permit appeal. CONCURRENCES The action of the Planning Commission is noted above. Concerns of the Utilities Department regarding the extent of the rezoning area are also discussed above; no other department has raised significant concerns with the rezoning. FISCAL IMPACT The rezoning will not involve significant changes to city costs or revenues. ALTERNATIVES The council may approve rezoning of a smaller area, if desired. The rezoning area may not be expanded without further environmental studies and public hearings. Delays in approving the rezoning may result in delays in the Wastewater Treatment Plant upgrade project, if the area included does not cover the extent of the planned plant expansion. RECOMMENDATION Adopt attached resolution approving General Plan Amendment GP/R 1501, and pass to print the attached ordinance rezoning the corresponding area from C/OS-20 to PF. (1991 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE GENERAL PLAN LAND USE MAP DESIGNATION FOR A PORTION OF THE PROPERTY LOCATED AT 35 PRADO ROAD FROM CONSERVATION/OPEN SPACE TO PUBLIC/SEMIPUBLIC WHEREAS, the Planning Commission conducted a public hearing on application No. GP/R 1501 on February 13 . 1991, and recommends approval of the application; and WHEREAS, the City Council has conducted a public hearing on March 5, 1991, and has considered the testimony and statements of the applicant, and other interested parties, and the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff; NOW, THEREFORE, the Council of the City of San Luis Obispo resolves as follows: SECTION 1. Action Application No. GP/R 1501 is hereby approved, amending the General Plan Land Use Map designation for a portion of the site from Conservation/Open Space to Public/Semipublic, as shown on attached Exhibit A. and based on the following findings: SECTION 2. Findings. 1. The proposed amendment to the General Plan Land Use Map is consistent with adopted policies in the General Plan. 2. The resulting pattern of land uses will be appropriate for this section of the community. 3 . The site is suited for Public/Semipublic uses. 4. The council has approved an EIR and a Supplement to the EIR for the Wastewater Treatment Plant Upgrade Project. Alan HacMeekin, 2011 Chorro Street, said he did not have any objections to any of the proposed zoning option. He said his preference was to have residential R-2 on both Broad and Chorro Streets . He said Paul Porter was did not care about the zoning change. Chairman Hoffman closed the public hearing. Comma. Gurnee moved to approve the rezoning shown on Exhibits A and B with findings . Commr . Schmidt seconded the motion. Commr . Karleskint said he did not support the motion because he did not think it was proper to rezone the lot on Broad Street . He said he preferred Exhibit D #2 . Commr . Hoffman agreed with Commr . Karleskint . VOTING: AYES - Commrs . Gurnee, Schmidt, Kourakis, Peterson, and williams . NOES - Commrs . Karleskint and Hoffman . ABSENT - None . (Continued from January 301 1991) ------------- ---------------------------------- ------- Jeff Hook presented the staff report and recommended the Commission recommend to the City Council approval of the General Plan Amendment and rezoning . Answering a question of Commr . Schmidt, he explained a use permit would govern the uses for the site in question . Commr . Schmidt said he received a telephone call from a citizen who preferred to remain anonymous who said it was the most ugly entrance to the City, and what ' s worse, it' s of the City' s own doing . He expressed concern that this rezoning could open the door to unwanted surprises . Draft PC Minutes Page 2 Chairman Hoffman opened the public hearing. John Moss, City Wastewater Division Manager, said there was ample room for the 4-acre pond requested by the Commission. He encouraged the Commission to recommend the approval of the project . Rob Strong said the comment Commr . Schmidt received was interesting and he believed there was a serious erosion of the General Plan intent on this site . He said the character of the entrance to the City has permanently changed and said he understood why it was necessary to change open space to public facilities but felt the City should study its own proposals more closely. Chairman Hoffman closed the public hearing. commr : Gurnee moved to approve the recommendation for rezoning of the General Plan Amendment. Commr . Kourakis seconded the motion.
