Hawley, Supervising Civil Engineer SUBJECT: Submittal of Standard Specifications for Construction of Public Works Projects. RECOMMENDATION: Adopt Resolution Approving Standard Specifications for Construction of Public Works Projects. BACKGROUND: City contract specifications set forth the conditions and requirements governing all City Capital Improvement Projects. Specifications which are currently in use consist of several chapters covering general legal provisions, technical construction requirements, special provisions unique to the project, and bidding documents. These specifications are utilized in conjunction with the California Department of Transpor- tation Standard Specifications. State Specifications are referenced or quoted continually throughout the City Specifications, in that they comprise the most accepted and complete industry standards for construction specifications involving public works projects. State Specifications are also updated and revised as needed, to be consistent with current construction law and practices. Over the years, City Specifications have not kept up with these numerous changes. In addition our format and arrangement of information is not consistent with the State's. Hence the need for a major reorganization and updating. Staff has developed a new "City Standard Specifications" which is proposed to replace the specification package currently in use. This new Standard specifications book will be published and sold separately to Contractors. It will be supplemented by a set of Special Provision Specifications which are unique to each CIP project approved by the Council. These new Standard Specifications follow the State Standard specifications on a chapter by chapter basis. The Contractor will be required to either be totally in compliance with a particular chapter of the State Standard Specifications or as modified and stated in the City Standard Specifications. Additional chapter not in the State Standards which specify construction requirements for water, sewer, storm drains, landscaping, and irrigation were also included in the new Specification Standards. Utilization of the proposed Standard Specifications allows for efficient and timely updating in order to be consistent with the State Standards, new contract laws and codes, city policies, and construction techniques. 2 / liolvoiligla�l� city of San tuIS OBISpo 111 i COUNCIL AGENDA REPORT It is important that the City Council approve all standards used in projects. The act of Council approval allows the City protection under the law from future claims of damage that may be attributed to the improvements constructed under these standards. The legal term for this protection is "Design and Plan Immunity. " A copy of the new Standard Specifications book is on file in the Council Office. ALTERNATIVES: Option 1: Adopt the resolution approving the new Standard Specifications, as submitted. Option 2: Continue action on the Resolution to a future date. CONSEQUENCES OF NOT TARING THE RECOMMENDED ACTION: The City will continue to use the old form of specifications, which in many areas are out of date and are in a form that is difficult for Contractors new to our area to follow. CONCURRENCES: The City Attorney's Office and all of the related divisions within the Public Works and Utilities Departments have reviewed these Standard Specifications and concur with the recommendation. The Personnel Department has reviewed the specifications for insurance coverage. SIGNIFICANT IMPACTS: No significant negative or cost impacts. RECOMMENDATION: Adopt Resolution approving Standard Specifications for construction of Public Works projects. Attachment: 1 - Resolution jhllstrds-sr by C -3 -Z. RESOLUTION NO. (1991 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING STANDARD SPECIFICATIONS FOR CONSTRUCTION OF PUBLIC WORKS PROJECTS WHEREAS, the Engineering Division of the Public Works Department is responsible for the preparation of Specifications for Public Works Projects, and WHEREAS, specifications are necessary to ensure that Contractors of Public Works facilities construct projects to minimum acceptable standards and follow existing laws to protect the health, safety and welfare of the public, and WHEREAS, legally adopted Standard Specifications are necessary to provide "design and plan immunity" thereby protecting the City from possible liability, WHEREAS, the existing specifications are in need of updating and reorganization to provide improved ease of use and clear direction to Contractors, and NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San Luis Obispo, California hereby: 1. Approves a booklet prepared by the Engineering Division of the Public Works Department setting forth Standard Specifications for construction of Public Works projects, entitled "Standard Specifications, " attached hereto marked Exhibit "A" and incorporated herein by reference, and 2. Authorizes the Public Works Department to prepare and maintain a supply of said booklet for distribution. ,:�, -3 -3 Resolution No. (1991 Series) Page Two. 3. Directs the City Engineer to incorporate these "Standard Specifications" in all construction contracts advertised by the City.
