SUBJECT: Advisory Body Appointment to the Appeals Board for
Handicapped Access
CAO RECOMMENDATION:
By motion, appoint Robert Stevens to the Appeals Board for
Handicapped Access for a four-year term ending March 30, 1995.
DISCUSSION:
City adoption of the 1988 Edition of the Uniform Administrative
Code in June of 1990 modified the advisory body involved with
disabled access regulations by creating the Appeals Board for
Handicapped Access, which serves as the "local appeals board"
specified in Section 19957.5 of the California Health and Safety
Code relating to alternative accommodations for the physically
handicapped.
Section 204 (b) of the Uniform Administrative Code establishes the
membership of the Appeals Board for Handicapped Access to be the
five members of the Board of Appeals and two members "who shall be
physically handicapped as defined in Section 2-417, Title 24 , Part
2 of the California Administrative Code. " The former handicapped
advisory board included only one member who meets the definition
and whose term has not as yet expired (due to expire in March,
1992) . The recommended appointment of Robert Stevens is consistent
with the State definition and will be particularly helpful to the
Board in rendering decisions relative to wheelchair accessibility.
FISCAL IMPACT:
Approval of the recommended appointment will have no fiscal impact.
