SUBJECT:
Final Map approval for Tract No. 2017, a Planned Unit Development
(Condominium) at 570 Dana Street (James & Mary Duenow, Subd. )
RECOMMENDATION:
Adopt resolution approving the final map for Tract No. 2017.
DISCUSSION:
The tentative map for this tract was approved on September 4, 1990 by
Resolution No. 6867 (1990 Series) . This tract creates 9 lots; 8 for
individual condominium units and 1 common lot. The building permits
have been issued and the structures are nearing completion. They may
not be occupied until this map records, or they would be subject to the
Condo-Conversion Ordinance.
The onsite improvements are being constructed as building permit
requirements. There are no public improvements to be constructed.
Access is provided via 2 driveways from Dana Street. Easements have
been provided for Stenner Creek maintenance (with the right to make
improvements) , access and for onsite public water and other utilities.
The onsite sanitary sewer and storm drain systems are to be privately
maintained.
The final map has been checked and found to be satisfactory and in
substantial conformity with the approved tentative map. All conditions
per Resolution No. 6867 (1990 Series) have been met and/or are
conditions of the building permit, and the subdivider has asked for
final map approval. All fees have been paid as noted on the attached
Fee and Bond List. There is no subdivider's agreement. CC&R' s have
been approved and will be recorded with the final map.
SIGNIFICANT IMPACTS: None
CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION:
The subdivider would not be able to sell the proposed units, nor allow
occupancies without accommodating the Condo-Conversion Ordinance.
CONCURRENCES:
All affected departments concur with the recommended action.

RESOLUTION NO. (1990 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE FINAL MAP FOR TRACT NO. 2017 LOCATED AT
570 DANA STREET. (James and Mary Duenow, Subdividers)
WHEREAS, the City Council made certain findings concerning
Tract No. 2017 as contained in Resolution No. 6867 (1990 Series) ,
and
WHEREAS, all conditions required per said resolution have been
met, and/or are conditions of the building permit, and
WHEREAS, the final map is in substantial conformance with the
approved tentative map.
NOW THEREFORE BE IT RESOLVED that the final map for Tract
' No. 2017 is hereby approved.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE TENTATIVE MAP FOR TRACT 2017,
CREATING EIGHT SMALL LOTS AND ONE COMMON LOT,
ON DANA STREET, NEAR ITS INTERSECTION WITH NIPOMO STREET
(TR 2017)
BE IT RESOLVED by the Council of the City of Sara Luis
Obispo as follows:
SECTION 1. Findings. That this council, after
consideration of public testimony, the subdivision request TR 2017,
the Planning Commission's action, staff recommendations and reports
thereon, makes the following findings:
1. The design of the tentative map and proposed improvements
will not adversely affect the health, safety, or welfare
of persons living or working in the vicinity.
2. The design of the tentative map and proposed improvements
are consistent with the general plan.
3 . The design of the tentative map and the proposed
improvements are not likely to cause serious health
problems, substantial environmental damage or substantially
and unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision or the type of improvements
will not conflict with easements for access through (or use
of property within) the proposed subdivision.
5. The Community Development Director has determined that the
proposed subdivision will not have a significant effect on
the environment and has granted a negative declaration,
with mitigation.
6. Compliance with the private open space standard for unit
E (lot 5) would not be practical because of the location
and site design.
7. An exception to allow a portion of the private open space
for unit E (lot 5) to be narrower than the standards
require will not constitute a grant of special privilege.
8. No feasible alternative to authorizing the exception to
private open space width for unit E (lot 5) would satisfy
the intent of city policies and regulations.

SECTION 2 . The tentative map for Tract 2017 is approved
subject to the following conditions:
1. The subdivider shall submit a final map to the city for
review, approval, and recordation.
2 . No occupancy shall be granted prior to recordation of the
final map, or the condominium conversion process must be
followed.
3 . The subdivider shall prepare conditions, covenants, and
restrictions (CC&R's) to be approved by the City Attorney
and Community Development Director prior to final map
approval. The CC&R's shall contain the following
provisions:
a. Creation of a homeowners ' association to enforce
the CC&R's and provide for professional, perpetual
maintenance of all common areas including private
driveways, utilities, drainage, parking lot area,
walls and fences, lighting, laundry facilities, and
1 landscaping in a first class condition.
r b. Grant to the city the right to maintain common area
if the homeowners' association fails to perform,
and to assess the homeowners ' association for
expenses incurred and the right of the city to
inspect the site at mutually agreed times to assure
conditions of CC&R's and final map are met.
C. No parking except in approved, designated areas.
d. Grant to the city the right to tow away vehicles
on a complaint basis which are parked in
unauthorized places.
e. Prohibition of storage or other uses which would
conflict with the use of garages and uncovered
parking spaces for parking purposes.
f. No outdoor storage of boats, campers, motorhomes,
or trailers nor long-term storage of inoperable
vehicles.
g. No outdoor storage by individual units except in
designated storage areas.
1 h. No change in city-required provisions of the CC&R's

i. Homeowners ' association shall file with the City
Clerk the names and addresses of all officers of
the homeowners ' association within 15 days of any
change in officers of the association.
4. Lot 9 (common lot) shall contain a blanket public utilities
easement and creek access easement, to the satisfaction of
the City Engineer.
5. The easterly driveway shall be widened to 201 , to the
satisfaction of the Fire Department.
6. An exception to the private open space width requirement
for lot 5 is hereby granted.
