Kenny, Supervising Civil Engineer SUBJECT: Final Map Approval for Tract No. 2044, an 8-Unit Commercial Air-Space Condominium Development at 225 Prado Road (Prado Corporate Center, Subdividers) . RECOMMENDATION: Adopt resolution approving the final map for Tract No. 2044. BACKGROUND: The tentative map for this tract was approved on November 20, 1990 by Resolution No. 6904 (1990 Series) . This tract creates 8 airspace condominium units on a common lot. The building permit for the single structure is expected to be issued upon recordation of the final map. The onsite improvements will be constructed as building permit requirements. The public improvements were constructed under Tract No. 703 . Although individual water services are being installed with the building permits, the subdivider has drilled a well to provide domestic water and for landscape irrigation. The units will be plumbed to allow connection to the City services when, and if, needed. The fire sprinklers will be connected to the City main. The final map has been checked and found to be satisfactory and in substantial conformity with the approved tentative map. All conditions per Resolution No. 6904 (1990 Series) have been met and/or are conditions of the building permit, and the subdivider has asked for final map approval. All fees were previously paid and there is no need for a subdivision agreement. CC&R's have been approved and will be recorded with the final map. SIGNIFICANT IMPACTS: None. CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION: The subdivider would not be able to sell the proposed units. Funding of the proposed structure is apparently conditioned on recordation of the final map. CONCURRENCES: All affected departments concur with the recommended action. ALTERNATIVES: Option 1: Adopt resolution approving the final map for Tract 2044. Option 2 : Deny approval of the final map if Council finds that any conditions have not been satisfactorily met. RECOMMENDATION: Adopt resolution approving the final map for Tract No. 2044. (Prado Corporate Center, Subdivider) WHEREAS, the City Council made certain findings concerning Tract No. 2044 as contained in Resolution No. 6904 (1990 Series) , and WHEREAS, all conditions required per said resolution have been met, and/or are conditions of the building permit, and WHEREAS, the final map is in substantial conformance with the approved tentative map. NOW THEREFORE BE IT RESOLVED that the final map for Tract No. 2044 is hereby approved. Findings. That this council, after consideration of the tentative map of Tract 2044 and the Planning Commission' s recommendations, staff recommendations, and reports thereof, makes the following findings: 1. The design of the tentative map and proposed improvements are consistent with the general plan. 2. The site is physically suited for the type and density of development allowed in a Service-Commercial zone. 3 . The design of the tentative map and the proposed improvements are not likely to cause serious health problems, substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. 4 . The design of the subdivision or the type of improvements will not conflict with easements for access through (or use of property within) the proposed subdivision. 5. The Community Development Director has determined that the proposed subdivision will not have a significant effect on the environment and has granted a negative declaration. 6. The Architectural Review Commission has reviewed the project and approves of the site design. SECTION 2 . Conditions. The approval of the tentative map for Tract 2044 be subject to the following conditions: 1. The subdivider shall submit a final map for review, approval and recordation. 2 . The subdivider shall provide individual water services for each unit. Meters shall be clustered at property frontage to the approval of the City Engineer. The subdivider shall extend individual gas and electrical services and metering for each unit to the approval of affected utilities and the City Engineer. 4 . The final map shall note a blanket easement over the common lot area, except under the structure, for underground public utilities serving the site to the approval of the City Engineer and affected utility agencies. 5. The subdivider shall prepare covenants, conditions and restrictions (CC&R's) to be approved by the City Attorney and Community Development Director prior to final map . approval. The CC&R's shall contain the following provisions: a. Property owners' association shall be created to enforce the CC&R's and provide for professional, perpetual maintenance of all common areas including but not limited to, the driveway, parking lot, landscaping, utilities and building exteriors, trash/waste pick-up and disposal. b. Rights shall be granted to the city to maintain common areas if property owners association fails to do so and assess said association for expenses incurred. C. All parking spaces provided in the project shall be available for use by all of the individual owners. d. No change in city-regulated provisions of the CC&R's shall be allowed without prior approval of the Community Development Department and City Attorney. 6. Interior vehicular circulation on the site shall be designed to assure that truck access to the loading zone/dock does not require backing off of Prado Road for entry or exit.
