Romero, Public Works Director PREPARED BY: Cyndi Butterfield, Solid Waste Coordinatorl%1 SUBJECT: Notification to State Integrated Waste Management Board of Anticipated Dates of Document Submittal CAO RECOMMENDATION: Adopt a resolution, as mandated by the State Integrated Waste Management Board, indicating: • that the City of San Luis Obispo is concurrently preparing a Source Reduction and Recycling Element (SRRE) , a Household Hazardous Waste Element (HHWE) , and environmental impact reports (EIR) for the SRRE and the HHWE • that upon completion and certification of the EIR for the SRRE and the HHWE, or December 1, 1991, whichever is sooner, the City shall submit its final SRRE and HHWE to the County. BACKGROUND: Under current law, each city is required to prepare, adopt and submit to the county in which it is located an SRRE and an HHWE on or before July 1, 1991. However, if a city is unable to comply with this deadline due to simultaneous preparation of EIR's for the SRRE and HHWE, the city is directed to adopt a resolution stating: • the reasons it is unable to comply with the deadline • a date when the city will comply with the deadline. This resolution is due to the State Integrated Waste Management Board on or before July 1, 1991. DISCUSSION: Attached is an in-depth discussion of the background prepared by Steve Devencenzi who is coordinating the regional planning of AB 939. Attachments: resolution Devencenzi letter stateint/cbil A RESOLUTION OF THE CITY OF SAN LUIS OBISPO REGARDING PREPARATION AND SUBMITTAL OF SOURCE REDUCTION AND RECYCLING ELEMENTS, HOUSEHOLD HAZARDOUS WASTE ELEMENT, AND RELATED_ ENVIRONMENTAL IMPACT REPORTS WHEREAS, the Cities and the County of San Luis Obispo have joined together under a Memorandum of Agreement with the San Luis Obispo Area Coordinating Council to prepare and adopt Source Reduction and Recycling Elements (SRRE's) and Household Hazardous Waste Element (HHWE) based upon a regional approach; and WHEREAS, the Cities and the County of San Luis Obispo have begun preparation of Environmental Impact Reports (EIR's) on the proposed Source Reduction and Recycling Elements, and Household Hazardous Waste Elements; and WHEREAS, .the preparation and adoption of these Environmental Impact Reports, and associated processing timeframes, will require that the communities acting together in this effort continue to meet and confer on the impacts associated with the proposed programs and facilities that will be required to meet the demands of AB 939; and WHEREAS, State Law requires notification of the Integrated Waste Management Board as to the local jurisdiction's intentions regarding the nature and timing on local approval of SRRE's, HHWE, and the associated environmental documentation. Resolution No. (1991 Series) NOW, THEREFORE, BE IT RESOLVED, that the San Luis Obispo Area Coordinating Council, on behalf of the City of San Luis Obispo and the County of San Luis Obispo, is in the process of preparing an Environmental Impact Report on the proposed SRRE's and HHWE's, and will be submitting the required documents to the Integrated Waste Management Board prior to December 1, 1991, or other statutory deadlines that may be established for the submittal of plans required by AB 939 and AB 1820 that are subject to the preparation of EIR's. In order to satisfy the required notification of the Integrated Waste Management Hoard (114M) of the anticipated date of submittal of your Sawoe Re&=tion and RBcycl]l7g Elements (SRRES) , Household Ha=1cus Waste Element MMM , and related Impact Repots (EIRs) the State's regulations require the local jurisdictions to prepare and submit resolutions that spiecify when these docznnents will be prw"Ited. The nral;minary drafts of the Special Waste, Public Information and Education, Facility Capacity, Source Reduction, Recycling, and Composting Components of the SRRE have been prepared and are awrently being revia fired by the Solid Waste Task Force and Technical Advisory Committee. The contract to prepare the SRREs and HHWEs also includes provisions to prepare an EIR on the plan which is now under the Notice of Preparation stage of the California Envirammtal Quality Act (CSA) procedtwes. Mie provisions of AB 939 and AB 1820 allow jurisdictions that prepare an EIR to submit their plans to the IWO by December 1, 1991. 'there is legislation currently beirg considered (AB 2090 Sher) that would extend this deadline by an additional 6 months, ztle IWM has circulated a letter indicating that fines and penalties will not be =posed due to the expected approval of the time extension. However, we feel it is prudent to pry, adopt and transmit the required notification prior to July 1, 1991. The resolution submitted for your consideration refers to the December 1, 1991 date and also states "...or other statutory deadlines that may be established for the submittal of plans.. .". This language is intended to provide the latitude to cover the expected revised timetable that the currently proposed legislation promises. If you have any questions please contact me at 549-4662.
