SUBJECT:
Water Reclamation Program Implementation, Authorization of Utilities
Director or his designee to file applications for water rights and
for a State Revolving Fund (SRF) loan and execute resultant
agreements.
CAO RECOMMENDATION:
Adopt resolution authorizing Utilities Director or his designee to
sign and file, for and on the behalf of the City, an application for
the Appropriation of Water, and a SRF Loan for the reclamation of
municipal wastewater. Authorize the City's representative to
certify the City' s compliance with all applicable State regulations
related to water rights and all applicable Federal and State
statutory and regulatory requirements related to any Federal and
State loan funds received. Authorize the City's representative to
execute the resultant water rights application, the. loan agreement
and amendments, for the purposes of water rights and securing SRF
water reclamation loan funds.
DISCUSSION:
The City is currently pursuing a water reclamation program. As a
part of that program the City will be seeking appropriative water
rights to the effluent currently discharged to San Luis Obispo
Creek. Along with the water rights the City will be seeking funding
assistance through the SRF Water Reclamation Loan Program.
At this time, it is not clear that the City must apply for the water
rights to divert the flow of effluent from San Luis Obispo Creek.
To clarify the water rights issues, both the City's water rights
attorney and the State Water Resources Control Board (SWRCB) ,
Division of Water Rights recommended that the City apply for the
appropriative water rights. Along with the appropriative water
rights application, the SWRCB recommends that the City submit a
petition for change of point of discharge. Because of the
inconsistencies in California water law, staff recommends that the
City apply for the appropriative water rights and petition for
change of point of discharge as soon as possible.
There are three components to the resolution required by the SWRCB
for the SRF loan program. First, authorizing and directing
designated representatives to sign and file, for and on behalf on
the City, an application for a SRF loan. Second, authorizing the
designated representatives to certify that the City will comply with
all applicable State and Federal statutory and regulatory
requirements related to any Federal and State Loans. Anj third,
authorizing the designated representative to execute the resultant
loan agreements and any amendments thereto for the purpose of
securing SRF water reclamation loan funds.

FISCAL IMPACT:

The direct fiscal impact of this action will be $180. 00 in permit
application fees and an annual fee equal to the application fee at
the then current rates. Staff has estimated that this will cost the
city $2200. 00 over the next ten years.
Sufficient funding has been approved in the 1991 - 1993 financial
plan and approved 1991 - 1992 budget, wastewater administration i
operating budget, to cover the application and permit costs.

By authorizing the application for a SRF loan, the City could be
eligible for five million dollars of low interest loan funds per
water reclamation project. This would save approximately half the
interest charges of a conventional municipal bond, thus lowering the
cost of reclaimed water and making it available to a larger market.
ALTERNATIVES:
There are na legitimate alternatives to adopting the resolution.
Although, Council may wish to designate a representative other than
the Utilities Director, at their discretion.
RECOMMENDATION:

RESOLUTION NO. (1991 Series)
AUTHORIZING FILING APPLICATIONS FOR STATE
PERMIT TO APPROPRIATE WATER AND A STATE REVOLVING
FUND LOAN TO CONSTRUCT FACILITIES FOR THE RECLAMATION
OF MUNICIPAL WASTEWATER
WHEREAS, City policy is to pursue a water reclamation
program to supplement the City's water supply, and
WHEREAS, the City plans to construct facilities necessary to
facilitate the aforementioned policy, and
WHEREAS, the City is seeking authorization to appropriate
water for the purpose of water reclamation, and
WHEREAS, the City is seeking funding assistance for the
construction of the water reclamation •facilities through the
State Revolving Fund and the Water Reclamation Loan Program low
interest loans and,
WHEREAS, the State requires designation and authorization of
representatives of the City to file the water appropriation
permit and loan applications and related materials.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of San Luis Obispo that the City Utilities Director or
his/her designee is hereby authorized and directed to sign and
file, for and on the behalf of the City of San Luis Obispo, an
application for the appropriation of water under California Water
Law and any agreements or other documents necessary to secure and
receive a State Revolving Fund Loan under the Clean Water Bond
Law of 1984, the Water Quality Act of 1987, and the Clean Water
and Water Reclamation Bond Law of 1988.
BE IT RESOLVED that the City of San Luis Obispo hereby
agrees and further does authorize the aforementioned
representative or his/her designee to certify that the
municipality has and will comply with all applicable State water
rights regulations, and all applicable State and Federal
statutory and regulatory requirements related to any Federal and
State loan funds received.
BE IT FURTHER RESOLVED that the City Utilities Director or
his/her designee of the City of San Luis Obispo is hereby
authorized to execute the resultant water rights and loan
agreements and any amendments thereto for the purpose of securing
water rights and loan funds. A copy of the agreements will be
filed in the office of the City Clerk.
