DISCUSSION Background On August 20, the Council approved a preliminary work scope for the EIR and directed staff to negotiate an agreement with the recommended consulting firm. Staff has done so, and is presenting the draft agreement for approval. FISCAL IMPACTS According to the agreement, the cost is not to exceed $85, 000. The budgeted amount for environmental review of the Land Use Element ($45, 000) and the Circulation Element ($40, 000) , according to the adopted 1991-93 budget, equals the proposed cost. ALTERNATIVES The council may continue action. RECOMMENDATION Approve, and authorize the Mayor to sign, an agreement with Fugro-McClelland to prepare an EIR for the Land Use Element and Circulation Element updates, for a total cost not to exceed $85, 000. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. The certain agreement, attached hereto marked Exhibit "1" and incorporated herein by reference, between the City and Fugro-McClel land (West) , Inc. , is hereby approved and the Mayor is authorized to execute the same. SECTION 2 . The City Finance Director shall encumber $85, 000 from Account No. 001-4035-008-086 for consultant services and related expenses. SECTION 3 . The City Clerk shall furnish a copy of this solution and a copy of the executed consultant's agreement approved by it to the Finance Director, the Community Development Director, and Fugro-McClelland (West) , Inc. The service to be provided by Consultant under this agreement consists of preparing draft and final environmental impact reports pursuant to the California Environmental Quality Act and Environmental Guidelines, for proposed updates of the general plan Land Use Element and Circulation Element. City desires to engage Consultant to provide these services because of Consultant's qualifications and experience for performing such work. Consultant has offered to provide the desired services on the terms and in the manner described in this agreement. In consideration of their mutual covenants, the City and Consultant agree as follows: 1. PROJECT COORDINATION a. City. The Community Development Director shall be the representative of the city for all purposes under this agreement. The director, or his designated representative, Glen Matteson, Associate Planner, hereby is designated as the Project Manager for the City. He shall supervise the progress and execution of this agreement. b. Consultant. Consultant shall assign a single Project Manager to have overall responsibility for the progress and execution of this agreement for Consultant. Stephen Svete is hereby designated as the Project Manager for Consultant. If circumstances change following execution of this agreement so that a substitute Project Manager is required, the Project Manager designee shall be subject to the prior written acceptance of City' s project manager. Consultant' s Project Team is further described in Exhibit "A, " attached to and a part of this agreement. The individuals identified and the positions held as described in Exhibit "A" shall not be changed except by prior approval of City. 2 . DUTIES OF CONSULTANT a. Services to be furnished. Consultant shall provide all specified services as set forth in Exhibit "A, " attached to and a part of this agreement. All products shall reflect that level of care and skill ordinarily exercised by members of the profession currently practicing in California under similar conditions. City ' s project manager shall be responsible for evaluating quality of work and for the issuance of consultant payments upon satisfactory delivery, completion, and city acceptance of work. C. Laws to be observed. Consultant shall: (1) Procure all permits and licenses, pay all charges and fees, and give all notices which may be necessary and incidental to the due and lawful performance of services by Consultant under this agreement; (2) Keep itself fully informed of all existing and proposed federal, state and local laws, ordinances, regulations, orders, and decrees which may affect those engaged or employed under this agreement, any materials used in Consultant's performance under this agreement, or the conduct of the services under this agreement; (3) At all times observe and comply with, and cause all of its employees to observe and comply with all of said laws, ordinances, regulations, orders, and decrees mentioned above. (4) Immediately report to the City' s Project Manager in writing any discrepancy or inconsistency it discovers in said laws, ordinances, regulations, orders, and decrees mentioned above in relation to any plans, drawings, specifications, or provisions of this agreement. d. Release of reports and information. Any reports, information, data, or other material given to, or prepared or assembled by, Consultant under this agreement shall be the property of City and shall not be made available to any individual or organization by Consultant without the prior written approval of the City' s Project Manager. e. Copies of reports and information. If City requests additional copies of reports, drawings, specifications, or any other material in addition to what the Consultant is required to furnish in limited quantities as part of the services under this agreement, C-9 s Consultant Services Agreement 3 General Plan Update EIR Consultant shall provide such additional copies as are requested, and City shall compensate Consultant for the costs of duplicating such copies at Consultant' s direct expense. 3 . DUTIES OF CITY City agrees to cooperate with Consultant and to perform any work that is described in Exhibit "A, " attached to and a part of this agreement. 4 . COMPENSATION The Consultant will perform the work in phases as described in Exhibit "A" . Consultant will bill City for actual time and material expenses monthly. City will pay invoices according to its normal accounts payable schedule, generally within 30 days of receipt. The Consultant may not charge more than the amount shown in Exhibit "A" without prior approval of the City. 5. TIME FOR COMPLETION OF THE WORK Completion of work phases shall follow the attached Exhibit "A, " unless revisions are approved by the City's Project Manager and Consultant. Time extensions may be allowed for delays caused by City, other governmental agencies, or factors not directly brought about by the negligence or lack of due care on the part of the Consultant. 6. TEMPORARY SUSPENSION The Community Development Director shall have the authority to suspend this agreement wholly or in part, for such period as the director deems necessary due to unfavorable conditions or to the failure on the part of the Consultant to perform any provision of this agreement. Consultant will be paid the compensation due and payable to the date of temporary suspension. 7. SUSPENSION; TERMINATION a. Right to suspend or terminate. The City retains the right to terminate this agreement for any reason by C-9-� Consultant Services Agreement 4 General Plan Update EIR notifying Consultant in writing seven days prior to termination and by paying the compensation due and payable to the date of termination; provided, however, if this agreement is terminated for fault of Consultant, City shall be obligated to compensate Consultant only for that portion of Consultant services which are of benefit to City. Said compensation is to be arrived at by mutual agreement of the City and Consultant; if they fail to agree, then an independent arbitrator is to be appointed and the arbitrator' s decision shall be binding upon City and Consultant. b. Return of materials. Upon such termination, Consultant shall turn over to the City immediately any and all copies of studies, sketches, drawings, computations, and other data, whether or not completed, prepared by Consultant, and for which Consultant has received reasonable compensation, or given to Consultant in connection with this agreement. Such materials shall become the permanent property of City. Consultant, however, shall not be liable for City' s use of incomplete materials or for City's use of complete documents if used for other than the project contemplated by this agreement. 8 . INSPECTION Consultant shall furnish city with every reasonable opportunity for City to ascertain that the services of Consultant are being performed in accordance with the requirements and intentions of this agreement. All work done and all materials furnished, if any, shall be subject to the City ' s Project Manager' s inspection and approval. The inspection of such work shall not relieve Consent of any of its obligations to fulfill its agreement as prescribed. 9. OWNERSHIP OF MATERIALS All original reports and other materials prepared by or in possession of Consultant pursuant to this agreement shall become the permanent property of the City, and shall be delivered to the City upon demand. 10. INDEPENDENT JUDGMENT Failure of City to agree with Consultant's independent findings, conclusions, or recommendations, if the same are called for under this agreement, on the basis of differences in matters of e-9-7 Consultant Services Agreement g General Plan Update EIR judgment shall not be construed as a failure on the part of Consultant to meet the requirements of this agreement. 11. ASSIGNMENT: SUBCONTRACTORS• EMPLOYEES This agreement is for the performance of professional consulting services of the Consultant and is not assignable by the Consultant without prior consent of the City. The Consultant may employ other specialists to perform services as required, with prior approval by the City. 12 . INTEREST OF CONSULTANT Consultant covenants that it presently has no interest, and shall not acquire any interest, direct or indirect, financial or otherwise, which would conflict in any manner or degree with the performance of services under this agreement. Consultant further covenants that, in the performance of this agreement, no subcontractor or person having such an interest shall be employed. Consultant certifies that no employee or subcontractor who has or will have any financial interest under this agreement is an officer or employee of City. It is expressly agreed that, in the performance of the services hereunder, Consultant shall at all times be deemed an independent contractor and not an agent or employee of City. 14 . Any and all claims and demands which may be made against City, its officers, agents, or employees by reason of any injury to or death of any person or corporation caused by any activity or omission of Consultant under this agreement or of Consultant' s employees or agents; b. Any and all damage to or destruction of the property of City, its officers, agents, or employees occupied or used by or in the care, custody, or control of Consultant, or in proximity to the site of Consultant's work, caused by any activity or omission of Consultant under this agreement, or of Consultant' s employees or agents; C. Any and all claims and demands which may be made against City, its officers, agents, or employees by reason of any injury to or death of, or damage suffered or sustained by, any employee or agent of Consultant under this agreement, however caused, excepting, however, any such claims and demands which are the result of the negligence or willful misconduct of City, its officers, agents, or employees; d. Any and all claims and demands which may be made against City, its officers, agents, or employees by reason of any infringement or alleged infringement of any patent rights or claims caused by the use of any apparatus, appliance, or materials furnished by Consultant under this agreement; and e. Any and all penalties imposed or damages sought on account of the violation of any law or regulation or of any term or condition of any permit, when such violation of any law or regulation or of any term or condition of any permit is due to any willful or negligent act or omission on the part of the Consultant. Consultant, at its own costs, expense, and risks, shall defend any and all suits, actions, or other legal proceedings that may be brought against or for employees on any such claim or demand of such third persons, or to enforce any such penalty, and pay and satisfy any judgment or decree that may be rendered against City, its officers, agents, or employees in any such suit, action or other legal proceeding, when same were due to negligence of the Consultant. �-g�9 lonsultant Services Agreement 7 veneral Plan Update EIR 15. WORKERS COMPENSATION Consultant certifies that it is aware of the provisions of the Labor Code of the State of California, which require every employer to be insured against liability for workers compensation or to undertake self-insurance in accordance with the provisions of that code, and it certifies that it will comply with such provisions before commencing the performance of the work of this agreement. 16. INSURANCE The Consultant shall procure and maintain for the duration of this agreement insurance which meets the requirements of attached Exhibit B. As evidence of this insurance, Consultant shall provide City a Certificate of Insurance and an Endorsement naming City as "Additional Insured. " 17. AGREEMENT BINDING 'his agreement shall apply to, and shall bind, the heirs, successors, executors, administrators, assigns, and subcontractors of City and Consultant. 18 . WAIVERS The waiver by either City or Consultant of any breach or violation of any term, covenant, or condition of this agreement or of any provision, ordinance, or law shall not be deemed to be a waiver of any subsequent breach of violation of the same or of any other term, covenant, condition, ordinance, or law. The subsequent acceptance by either party of any fee or other money which may become due under this agreement shall not be deemed to be a waiver of any preceding breach or violation by the other party of any term, covenant, or condition of this agreement or of any applicable law or ordinance. 19. COSTS AND ATTORNEY 'S FEES The prevailing party in any action between the parties to this agreement brought to enforce the terms of this agreement or arising out of this agreement may recover from the other party its reasonable costs and attorney ' s fees expended in connection •ith such an action . DISCRIMINATION No discrimination shall be made in the employment of persons under this agreement because of the race, color, national origin, ancestry, religion or sex of such person. If Consultant is found in violation of the nondiscrimination provisions of the State of California Fair Employment Practices Act or similar provisions of federal law or executive order in the performance of this agreement, it shall thereby be found in material breach of this agreement. Thereupon, City shall have the power to cancel or suspend this agreement, in whole or in part, or to deduct from the amount payable to Consultant the sum of Twenty-five Dollars ($25) for each person for each calendar day during which such person was discriminated against, as damages for said breach of contract, or both. Only a finding of the State of California Fair Employment Practices Commission or the equivalent federal agency or officer shall constitute evidence of a violation of contract under this paragraph. If Consultant is found in violation of the nondiscrimination provisions of this agreement or the applicable affirmative action guidelines pertaining to this agreement, Consultant shall be found in material breach of the agreement. Thereupon, City shall have the power to do either or both of the following: (a) Cancel or suspend this agreement, in whole or in part; (b) Deduct from the amount payable to Consultant the sum of Two Hundred Fifty Dollars ($250) for each calendar day during which Consultant is found to have been in such noncompliance, as damages for said breach of contract. 21. AGREEMENT CONTAINS ALL UNDERSTANDINGS This document represents the entire and integrated agreement between City and Consultant and supersedes all prior negotiations, representations, or agreements, either written or oral. This document may be amended only by written instrument, signed by both City and Consultant. All provisions of this agreement are expressly made conditions. This agreement shall be governed by the laws of the State of California. CONSULTANT /D / By Vv Type Name and title: Mel Willis Vice President CITY OF SAN LUIS OBISPO By Mayor mD:CONTRACT.WP ATTACHMENT A 2.0 SCOPE OF WORK 2.1 STUDY APPROACH In order to provide the requested scope of work within the proposed budget to most efficiently meet the City's stated objectives, Fugro-McClelland proposes to prepare a "Tiered EIR" which integrates the analysis of the Land Use Element and Circulation Element in one coherent document- Such an approach will allow the City to streamline the environmental assessment process, creating a master environmental assessment that may be used as the basis of evaluating the impacts of the City's other general plan elements to be updated in the near future, including the Housing and Open Space Elements. As allowed under Section 15169 of the CEQA Guidelines, information from a master environmental assessment may be used or referenced in EIRs or Negative Declarations involving related projects. The Master EIR's inventory of land use and circulation characteristics of the planning area provides the "setting" for the first tier environmental analysis as required under CEQA. EIRs for specific project development (second tier EIRs) need address only site-specific issues related to the project and incorporate by reference the General Plan Update EIR for the Land Use and Circulation EIements. This approach can eliminate repetitive discussions and focus the EIR on more relevant project-specific issues. Fugro-McClelland's analysis will incorporate approaches mandated by recent court decisions. In response to the decision in Environmental Information and Planning Council v. Counry of El Dorado (1982) 131 Cal. App. 3d 350, this EIR will evaluate the proposed Land Use and Circulation Elements on the basis of existing development rather than merely comparing their goals to those of previous plans. Not only is such an approach mindful of legal requirements, it also provides a more realistic assessment of how these general plan elements propose to affect the current state of land use and circulation development. 2.2 STUDY PARAMETERS Our proposed scope of work is framed by the following legal and informational parameters: 2.2.1 Level of Specificity The proposed project to be evaluated is a pair of general plan elements. The California Environmental Quality Act (CEQA) recognizes that the required level of detail in an EIR for A.2-1 .N'VMKT40WPA 0-943 Attachment A ;eneral plan elements is less than for a specific development project. Section 15146 of the State CEQA Guidelines states: The degree of specificity required in an EIR will correspond to the degree of specificity involved in the underlying activity which is described in the EIR. As discussed previously, this document will function as a master environmental assessment which will provide the basis for future EIRs pertaining to specific developments within the City of San Luis Obispo. 2.2.2 Speculation Some of the issues to be evaluated in the EIR involve methodologies that are imprecise. It must be recognized that precise answers are not possible from imprecise sciences, but require a degree of speculation by the analyst. The State CEQA Guidelines recognize the inherent problems with speculation in an EIR and place limitations on its use. Section 15145 states: If, after thorough investigation, a Lead Agency finds that a particular impact is too speculative for evaluation, the agency should note its conclusion and terminate discussion of the impact. This section of the State CEQA Guidelines is intended to deal with the difficulty of forecasting where a thorough investigation is unable to resolve an issue and the answer remains purely speculative. It is intended to relieve the Lead Agency from a requirement to engage in idle speculation. Consistent with this standard, the EIR will be prepared as an informational document that presents conclusions based on concrete data, and will avoid presenting conclusions based on speculation. 2.2.3 Standards for Adequacy We recognize the necessity to maintain a factual, objective, and balanced approach to preparing the environmental documents for the proposed projects. The State CEQA Guidelines provide the standard by which the adequacy of an EIR is based_ Specifically, Section 15151 of the Guidelines states: An EIR should be prepared with a sufficient degree of analysis to provide decision-makers with information which enables them to make a decision which intelligently takes account of environmental consequences. An evaluation of the environmental effects of a proposed project need not be exhaustive, but the sufficiency of an EIR is to be reviewed in the light of what is reasonably feasible. Disagreement among experts does not make an A.2-2 4KT40WPA Attachment A EIR inadequate, but the EIR should summarize the main points of disagree- ment among the experts. The courts have looked not for perfection, but for adequacy, completeness, and a good faith effort at full disclosure. Consistent with this section, our proposed scope of work is intended to provide an EIR that will be a "good faith effort at full disclosure" of the environmental impacts of the projects. 2.2.4 Available Information It is assumed that the City of San Luis Obispo staff will work closely with Fugro- McClelland staff in identifying the existing level of development in the City. Information needed will include the location and intensity of existing development and an inventory of existing structures by land use type, in addition to proposed land use changes already approved by the City. This information will be used as the baseline against which impacts of the Land Use Element update will be assessed. Similarly, existing circulation system data will be needed to perform a comprehensive and accurate assessment of the Circulation Element update of the general plan. Information sources for both land use and circulation will include existing inventories, aerial photography, and previously commissioned studies. 23 TASK DESCRIPTIONS This section briefly describes the broad tasks to be performed, while Section 2.4 describes the technical approach used to carry out these tasks. Task 1: Initial Meeting/Study Team Organization Immediately upon receipt of authorization to proceed, we will meet with the planning team and City staff to review study objectives. At that meeting, the City should provide us with copies of the existing and updated General Plan/Zoning Ordinances, airport master plans, usable base maps, aerial photographs, and completed baseline land use and circulation studies in addition to those already provided. Task 2: Define Land Use and Circulation Scenarios (Project Description) Within ten (10) working days after the finalization of a draft plan, we will prepare the project description section of the EIR and provide a copy to city staff for review. Because this project description will become the basis for all environmental analysis, we request that the city review and provide any changes in the project description within one (1) week of receipt. The project description section of the EIR will focus on potential buildout within the planning area under the proposed Land Use Element update as well as the effects of new circulation components proposed as part of the Circulation Element. A.2-3 craowr-A C-9-1s Attachment A 'ask 3: Define Alternatives CEQA requires a discussion of alternatives to a project to allow decision-makers a reasoned choice with respect to the updating of general plan elements. The City has tentatively outlined four land use and five circulation alternatives, in each case ranging from minimum expansion to development of increasing intensity. Among the land use alternatives, which are defined as "L-0", "L-1", "L-2" and "L-3" in increasing order of intensity, "L-2" will be examined as the "project" under CEQA. Similarly, the circulation alternative "C-2", one of five in a group including "C-0", "C-IA", "C-1B", and "C-3", is the CEQA-defined project for the purposes of this analysis. Within two (2) weeks of receipt of the City's comments on the Project Description, Fugro-McClelland staff will meet with City staff to more precisely define these alternatives. At that time, it will also be determined which land use and circulation alternatives will be paired for the purposes of streamlining the analysis. Note that not all possible combinations of land use and circulation alternatives will be studied. Subject to negotiation between Fugro-McClelland and City staff, the EIR will analyze the following project alternatives: TENTATIVE EIR PROJECT ALTERNATIVES: Land Use Circulation Scenario Scenario "Proposed Project": L-2 and C-2 Expanded Development Alternatives: Alternative A: L-3 and C-3 Alternative B: L-3 and C-2 Minimum Street Expansion Alternatives: Alternative C: L-2 and C-1B Alternative D: L-2 and C-IA Reduced Development Alternatives: Alternative E: L-1 and C-0 Alternative F (no project): L-0 and C-0 The project alternatives will not be examined at an equal level of detail. Instead, the proposed project will receive the closest scrutiny, and any mitigation measures recommended in the EIR will be based on the impacts of this project alternative. The impacts of the other alternatives (including the "no project" alternative) will be discussed at a lesser degree of detail, and no specific measures will be proposed to mitigate these impacts. A.2-4 EKT40WPA C-9-1� Attachment A Based on a comparison of the impacts of the altematives studied, an "environmentally superior" alternative will be determined. If the "no project" alternative is found to be "environmentally superior", the EIR will identify the environmentally superior alternative among the proposed project and the other scenarios being examined. Task 4: Prepare Environmental Impact Report Task 4.1: Environmental Setting This EIR section will include a description of the environmental setting of the San Luis Obispo area. Where possible, maps and other graphic representation will be used to portray conditions. Task 4.2: Envirotunental Impacts and Mitigation Measures The following is our general approach to evaluating environmental impacts, while Section 2.4 of this proposal describes the specific issues to be studied in the EIR. • Impact Analysis Organization. A quantification of impacts, along with a discussion of their significance, will be attempted when possible. If available data is inadequate, it may be possible to approximate the impacts through use of information available, combined with a reasonable set of assumptions, to arrive at an answer. If quantification is not possible, a thorough qualitative discussion of the expected impact will be included. This discussion will describe how the project will influence the particular resource category and the basis for the degree of impact. For all impact categories, the discussion will be sufficiently detailed to support a finding on level of significance of impact. This conclusion will be explicitly stated in the body and summary of the EIR along with the justification for the conclusion. Integrating the impacts of two separate general plan elements into one document requires creative solutions. In an effort to streamline the document, Fugro- McClelland will present the existing setting of each issue area to be studied (e.g., air quality, geology) only once, even if the issue may be affected by both the Land Use and Circulation Elements. Individual impacts and mitigations pertaining to each element will be discussed separately for each issue area. This approach is especially appropriate because nearly all of the 15 issues examined in this document relate to both the Land Use and Circulation Elements. Cumulative impacts will be addressed by comparing full buildout within the City under the proposed general plan elements to what already exists. • Growth-Inducing Impacts. This section will discuss the growth-inducing impacts of the proposed Land Use and Circulation Element updates, if any. Particular emphasis will be placed on identification of increased growth potential that would result from implementation of the proposed land use and circulation changes. Other issues to be addressed are the elements' effects on housing supply, schools, police and fire services. This analysis will be a direct extension of the analysis contained in the body of the report. • Other Required Sections. The EIR will include all other sections required by the State CEQA Guidelines, including significant irreversible environmental changes resulting from the proposed project, and a discussion of the relationship between local short-term uses of the environment and the maintenance and the enhance- ment of long-term productivity. • Mitigation Monitoring Plan. Pursuant to AB 3180 (Cortese), Fugro-McClelland will develop a mitigation monitoring plan that will outline the steps needed to implement the mitigation measures imposed on projects as conditions of their approval. The plan will include the following features: A.2-6 �MTQWP.A C-9-fig Attachment A Description of each mitigation measure and suggested wording of a condition of approval for those measures recommended by the EIR. Identification of agency responsible for implementation. Time frame for implementation (e.g., prior to zoning clearance, during construction, after construction, etc.). Frequency of monitoring. Criteria to be used to determine compliance with conditions. This proposal is to prepare the monitoring plan only and does not include actual monitoring activities. However, Fugro-McClelland has the technical staff with capabilities to conduct this monitoring, and this could be done under a separate work scope and cost. Task 43: Administrative Draft EIR Within 60 days of City acceptance of the project description, McClelland will deliver five (5) copies of the Administrative Draft EIR for City staff review. The Administration Draft EIR will be prepared in accordance with the State CEQA Guidelines and in the format specified by the City. This time frame may be amended to adhere more closely to the City's General Plan Update Schedule if deemed necessary by the City. Task 4.4: Draft EIR Within ten (10) days after receiving City comments on the Administrative Draft EIR, we will submit one camera-ready original of the Draft EIR for the City of San Luis Obispo Land Use and Circulation Elements Update. • Planning Commission Hearings. During the public review period, the project manager and study team will present the EIR to the Planning Commission and answer questions. Our cost proposal assumes two hearings. Revised costs will be necessary if additional hearings are necessary. • City Council Hearings. The project manager and appropriate study team members will attend two City Council meetings. Task 4.5: Responses to Comments Within ten (10) working days of receipt of all comments on the Draft EIR, we will submit one camera-ready original of comments and responses, including any added or revised A.2-7 N`VMKr60WPA a C-9-I r Attachment A sctions of the Draft EIR which may be necessary, depending on the nature of the comments. i his proposal's budget includes responses for up to 25 letters and not more than 75 comments. Adjustments to this ratio are negotiable at the time of contract preparation (see Section 4.0 Cost and Schedule). Task 4.6: Final EIR After certification of the Final EIR, Fugro-McClelland will deliver one (1) camera- ready original of the Final EIR, and a copy on computer disk. 2.4 TECHNICAL APPROACH 2.4.1 Community Plans and Goals (Internal Consistency) This section will separately assess the internal consistency of both the Land Use and Circulation Elements, and will evaluate the compatibility of these elements with all locally adopted plans and policies, including both those that are in the process of being updated and those that are not. Key documents that will be considered include: 1. Draft Noise Element (1991) 2. Energy Element (1984) 3. Zoning Regulations 4. Subdivision Regulations 5. Parking Management Plan (1990) 6. Bicycle Facility Plan (1985) 7. Draft Transit Management Plan (1991) The Land Use and Circulation Elements will also be examined to determine whether they are consistent with one another. If there are inconsistencies with any or all of these documents, changes to the two elements in question will be recommended to bring them into consistency with existing City policies. 2.42 Population/Employment/Housing This section will assess the population, housing and employment impacts of both the Land Use and Circulation Elements. This will be accomplished through graphics and text showing historic population and employment trends, planned growth and the City's share of regional (county) growth. The analysis of the Land Use Element will also assess its effect on regional housing buildout potential, and will discuss possible jobs/housing balance impacts. "The study area with respect to a jobs/housing balance analysis is the San Luis Obispo nning area, as defined by Figure 1 of the City's Draft Land Use Element (April 1990), and --,compasses the City and its rural environs in all directions. It does not include other cities A.2-8 KT40WPA �-�ao Attachment A within San Luis Obispo County or other urbanized communities outside the San Luis Obispo planning area." With respect to the Circulation Element, this section will determine how the proposed circulation changes will affect population distribution in the San Luis Obispo planning area, to the extent that these changes are not obvious from the perspective of the Land Use Element. This section will also note potential land use changes induced by the Circulation Element that may conflict with proposed Land Use Element designations. 2.4.3 Land Use This section will assess the land use impacts induced by the Land Use and Circulation Element updates. With respect to the Land Use Element, this analysis will show by map the parts of the planning area which will be converted from open to urban uses, and the parts which will change or intensify urban uses. It will also discuss the type and extent of agricultural land impacts. As part of the presentation, this section will portray in schematic perspective: • In two or three aerial views, the expansion of the city; • In two street-level views, changes in the central business district; • In one street-level view, changes in a downtown residential/office neighborhood. In regard to the Circulation Element, this section will assess the impacts of circulation projects and programs on land use, including at least the following: 1. The direct impact on adjoining land uses including historic and architecturally significant buildings, sites, and districts. 2. The impact on archaeological resources. 3. The impact on the character of residential and commercial areas and on pedestrian flow and safety within these areas. 4. The potential for changes in land uses as a result of recommended changes to the - street network. 5. Potential changes in the use of residential areas if recommended traffic reduction programs are implemented. A.2-9 �'vNIIcraawPA 61_9a1 Attachment A '.4.4 Transportation and Circulation The transportation impact assessment for the EIR will essentially cross-check the Circulation Element update with the Land Use Element update. The focus of this section of the EIR will be to compile existing data and provide the necessary impact assessment to identify localized impact areas. Of particular importance will be the development of mitigation measures that can be applied on a project by project basis. Fugro-McClelland will apply its planning expertise in developing "non-traditional" transportation solutions for potential problems arising from the Land Use and Circulation Elements. In recognition of San Luis Obispo's emphasis on alternative transportation modes, mitigations which stress bus ridership, bicycling, walking, ridesharing and similar low-cost solutions will be considered in favor of large-scale public improvements which may create additional impacts unforeseen at the time of their construction. However, when major road improvements are warranted in light of their overall transportation benefits, they will be considered as primary mitigations in his analysis. Fugro-McClelland will blend its experience in "neo-traditional" urban design with in-house traffic analysis capabilities to develop reasonable transportation solutions with City staff. Among the transportation impacts to be evaluated by Fugro-McClelland include: 1. Changes in the distribution of traffic caused by changes to the street network. 2. Segments of streets and intersections where the level of service (LOS) is adversely affected by proposed circulation projects. 3. Changes to the characteristics of traffic if the proposed "modal split objectives" are achieved (e.g., likely concentration of bicyclists). Traffic reduction programs described in the draft Circulation Element will be considered as mitigation measures to future traffic growth and congestion. The EIR will assess the effectiveness of these measures, where these programs will not reduce impacts to insignificant levels, the EIR will describe other mitigation measures that the city may employ. 2.4.5 Public Services This section of the EIR will project the additional facilities and personnel needed to maintain current levels of service, at full development for: 1. Fire protection 2. Police protection A.2-10 ECT40WPA Tolcvl Attachment A 3. Parks and recreation 4. Administrative and planning functions 5. Public schools Although this issue is of particular importance in evaluating the Land Use Element, it is also necessary to assess the impact of proposed changes to the street network on response time for emergency vehicles. The EIR will provide a complete inventory of service facilities and their capacities based on existing information sources. Where deficiencies presently exist, plans for facility expansion or service improvements will be thoroughly discussed including funding mechanisms and timing. All existing and planned facilities will be mapped in the EIR. Generation and demand factors will be developed and verified through contact with affected service agencies. The analysis will provide quantification of existing and projected demands, as well as a comparison of these demands to the service capabilities. Where service deficiencies are identified, mitigation programs will be developed to avoid or minimize potentially adverse impacts. The resulting product will include mapping of facilities and the necessary technical data that will provide a framework for evaluation of subsequent future city projects. 2.4.6 Utilities This section will project the additional resources and facilities needed to maintain current levels of service under the provisions of the Land Use Element for: 1. Water supply, treatment, and distribution 2. Sewage collection, treatment, and reuse/disposal 3. Electricity 4. Natural gas 5. Recycling/solid waste disposal The individual subsections within the utilities section will be prepared as follows: A.2-11 _NVMKT40WPA c-�-a3 Attachment A Water Service • Discuss and map existing water supply system and storage facilities; • Identify service agencies/companies,jurisdictional boundaries and current service policies; • Review of planned system improvements; • Develop water demand rates based on existing data sources as verified through local water purveyors; • Calculate water demand for full buildout of Land Use Element; • Evaluate potential impacts from Land Use Element on current and possible future water storage and distribution systems; and • Develop mitigation measures that can be applied on an individual project basis. Sewage Service • Inventory and map current sewer conveyance system; • Discuss current capacities of treatment facilities and transport lines and pump stations; • Review the constraints governing sewage treatment expansion; • Analyze current and future agreements with other service areas and inputs on City system; • Calculate sewage generation, based on accepted factors,for the Land Use Element; • Identify potential impacts to existing sewer facilities and sewage treatment plant; • Identification of mitigation necessary to avoid potential sewage disposal impacts; and • Review airport industrial demand potential. Electricity and Natural Gas • Inventory existing energy supplies and quantify the existing usage; A.2-12 KT40WPA Attachment A • Identify service agencies/companies,jurisdictional boundaries and current service policies; • Review planned system improvements; • Calculate energy demand upon buildout under the Land Use Element; • Evaluate potential energy impacts and propose mitigation which may be applied to future individual projects. Solid Waste • Identify service areas; • Review current landfill capacity and projected future capacities; • Calculate potential service demand from accepted waste generation factors for land use element; • Identify potential impact on waste disposal service and landfill capabilities; • Discuss service alternatives that may be necessary to mitigate potential impacts; and • Review countywide solid waste management plans to possibly provide future solid waste disposal facilities. 2.4.7 Noise The Noise section of the EIR will be prepared in accordance with the "Guidelines for Noise Study Reports as Part of Environmental Impact Reports" issued by the California Department of Health Services, Office of Noise Control. The EIR will draw upon information developed for the city's Noise Element to establish current and future baseline conditions. The EIR will include a noise map depicting both current and projected noise level contours throughout the city. This information will be used to assess impacts of the Land Use and Circulation Element updates. The noise analysis will address potential impact areas for each alternative as well as available mitigation options. Mitigation requirements will be established and necessary conditions of project approval will be set forth for key noise impact areas, if necessary. A.2-13 NNMXT40"A n_ Attachment A The analysis will assess the following noise sources in the manner described below: 1. Traffic and transportation sources Identify sensitive land uses (such as residences, schools, hospitals, parks) that will be adversely affected by noise from increased traffic levels, and those where noise levels will significantly increase due to a redistribution of traffic, even if resultant noise levels do not exceed city standards. If levels are found to be significant, the EIR will describe mitigation measures. The EIR will also identify impacts of noise mirigation measures, such as the appearance of sound walls. 2. Stationary Sources This section will describe any situations where more intense land development or newly adjacent land uses may result in unacceptable noise exposure, and describe potential mitigation measures. 2.4.8 Geology This section will use existing base information to identify any areas where more intensive land uses or circulation projects may be affected by geological or seismic hazards. This nalysis will evaluate proposed plans with existing hillside preservation programs, and .ecommend mitigations where necessary. The topographic changes associated with the construction of major street projects will be assessed to the extent possible based on proposed alignments. The impact assessment will provide graphic representation of potential hazard areas and will outline specific mitigation requirements for each hazard identified. Specifically this section will include: • Review of existing literature sources including site-specific soils studies, if available; • Discussion of existing geologic conditions (e.g., seismic capabilities, soils, subsurface structure, landform, etc.); • Identification of potential areawide geologic hazards (e.g., liquefaction, shrink- swell, erosion, etc.) and regional seismic characteristics; • Mapping of geologic hazards from existing data sources; • Discussion of local groundwater characteristics; A.2-14 4XT40 PA C-9-'=PG Attachment A • Evaluation of the effect of areawide geologic hazards on various buildout scenarios (e.g., liquefaction, erosion, seismic, etc.); • Projection of possible impact to groundwater sources as a result of lost recharge and increased pumpage; • Measures to mitigate specific geologic hazards; • Additional geologic and soil analysis that may be necessary to ensure adequate mitigation of geologic hazards. 2.4.9 Air Quality While air quality is better than in some other areas of the state, San Luis Obispo County does not attain state ozone standards. The draft Clean Air Plan (County APCD, May 1991) shows that a broad range of new pollution-control measures will not achieve the required emissions reductions, considering projected countywide growth. This section will assess the extent that implementation of the Land Use Element will help or impede the attainment of clean air goals. In addition, it will propose mitigation measures beyond those contained in the Clean Air Plan that will help close the gap between desired and projected emission reductions. With respect to the Circulation Element, this section will evaluate changes in localized air quality caused by changes to the state network, and will assess the effect of achieving "modal split objectives" and implementing "traffic reduction programs" on community air quality levels. The assessment of air quality impacts will specifically address the following: Short-Term Emissions. Short-term emissions generated during the site preparation and construction phase of a project include fugitive dust resulting from grading and materials handling, construction workers' vehicular traffic, and the exhaust from heavy-duty gasoline and diesel powered vehicles. Emission factor data for the emissions generated during construction activities will be obtained from EPA AP-42, Compilation of Air Pollutant Emissions Factors, Third Edition. Although the Land Use and Circulation Element updates will not involve construction, this section will provide a guideline for subsequent analysis of specific projects. Long-Term Emissions. The long-term emissions associated with areawide and other cumulative development are the indirect emissions induced principally by the use of motor vehicles. This assessment will identify and analyze emission sources (i.e., motor vehicles, power generation, project operations). Factors in vehicle usage to be considered area: A.2-15 :v'VMICT40�LPA H/ C-9-a/ Attachment A • Number of vehicle trips associated with the update; • Peak hour traffic count estimates; • Percent cold-hot start; • Types of trips and average speed; • Vehicle miles traveled per day. Local Scale Analysis. Estimate of the air quality impact given full buildout of the land use update. Special emphasis will be placed on identifying locations of sensitive receptors (i.e., hospitals, schools, etc.) and the actual exposure to pollutants. Compatibility with Adjoining Agricultural Spraying. Development in a predominantly agricultural area may result in conflicts from aerial spray drift of fertilizers and/or pesticides. Impacts of limiting such uses and impacts to the specific areas will be addressed. Additionally, agencies responsible for monitoring such activities and their regulatory authority will be discussed. Mitigation Measures. The EIR will identify all feasible motor vehicle trip reduction measures that can serve to mitigate development-related air quality impacts. The following measures may be applicable: • General transportation measures; — Direct support to transit agencies for service and/or facilities. — Parking management. • Employer-sponsored transportation measures (for job sites); and • Land use development measures. 2.4.10 Water Quality and Flooding This section assesses the effect of proposed circulation and land use modifications on area hydrology and water quality. With respect to land use, this analysis will identify areas where intense development is slated to occur in the 100-year flood zone, assess the impacts of such development and propose appropriate mitigations to ensure public safety. This section will also assess the overall impacts to water quality from storm water drainage. Circulation improvements may also dramatically affect water quality and hydrology. This analysis will evaluate the impact of the proposed circulation projects on drainage patterns and water quality. Special emphasis will be given to water quality impacts on creeks, wetlands A.2-16 E\'VMxraowrA 2-9-a2 Attachment A and Laguna Lake. This study will also assess the impact of proposed circulation projects on existing flood levels and the susceptibility of the projects themselves to flooding. To facilitate this analysis, this section will specifically include: • Review of literature sources and contact with local authorities to establish an inventory and map existing and planned drainage facilities and subsequent flood plain areas; • Assessment of increased runoff form potential buildout scenarios; • Identification of potential flood impacts associated with full buildout; • Identification of program mitigation to minimize or avoid flooding and ground- water impacts; and • Recommendation of measures to protect long-term water quality and to promote water conservation. 2.4.11 Biological Resources The biological assessment for the EIR will address the effects of potential allowed by the Land Use and Circulation Element updates. The EIR will generally describe major plant and animal communities within the planning area and identify significant biological resources. The investigation will also involve review of published and unpublished literature sources to identify possible constraints to development under the proposed buildout scenarios envisioned by the Land Use Element. Special emphasis will be given to assessing impacts on rare or endangered species, species that are candidate for these designations, and on mature vegetation. Impact areas receiving particular attention will include creeks,riparian habitats, hillsides and the Morros, open field areas, wetlands and Laguna Lake. Relevant information sources will include, but not be limited to: the city's Open Space Element, the California Natural Diversity Data Base, and specific data available from previously prepared environmental studies in the San Luis Obispo area, if applicable. 2.4.12 Archaeological and Historical Resources An archival search will be conducted to determine the location of known prehistorical and historical resources in the San Luis Obispo planning area. A confidential map will be prepared, to be kept separate from the document, showing the location of identified cultural resources. The analysis will also assess the potential impacts of the scenarios developed in the Land Use and Circulation Element updates on identified cultural resources. Mitigation will A.2-17 E\vMKT40WPA Attachment A largely consist of an identification of possible measures to manage and avoid the destruction of known resources. 2.4.13 Aesthetics/Urban Design Impacts to aesthetics and urban design are often overlooked yet critical components of an environmental analysis, and they are particularly important in as geographically and architecturally rich an area as San Luis Obispo. With its varied terrain, impressive morros and scenic creeks, the San Luis area features a number of natural landmarks that all agree are visual assets to the community. Similarly, the City has a long tradition of preserving its historic and cultural resources, from the most famous examples (Mission San Luis Obispo de Tolosa, and the J.P. Andrews building) to the less obvious but no less important (the residential district in the neighborhood of Broad and Islay Streets). Fugro-McClelland staff's familiarity with the City and its experience with traditional urban design issues will prove invaluable in identifying major natural and cultural resources and assessing the visual impacts of proposed development in those areas. Special emphasis will be placed on assessing the views of such landmarks from residential neighborhoods and from downtown. The effects of proposed land use and circulation changes on recognized urban edges, nodes, gateways and paths will be discussed as well. This section will assess the possible negative aesthetic impacts of proposed road widening and new circulation projects on the visual character of the community, and appropriate mitigations will be proposed The visual assessment will include, but not necessarily be limited to, the following: • Photodocumentation of viewing corridors affected by the proposed buildout discussed in the update; • Discussion of applicable visual policies identified in the city's Land Use Element; • Visual characterization of the San Luis Obispo planning area; • Discussion of the consistency of the development scenarios with city visual/urban design guidelines, if applicable; • Discussion of the impact of the proposed land use changes on the aesthetic character of the San Luis Obispo planning area; and • Identification of appropriate measures to mitigate visual impacts, including alternative land uses or densities to conform to visual guidelines, landscaping, location of structures below ridgelines, and protection of view corridors. IN addition, alternative circulation improvements may be suggested as mitigations to protect visually sensitive areas. A.2-18 �.�vmncraawp.n �_9-30 Attachment A The Aesthetics/Urban Design section will be augmented with environmental simulation graphics, using the computer-aided photo scanning capabilities of Grayscale FXTM software. 2.4.14 Energy/Resource Use This section will note any resources for which the overall rate of use would be affected by proposed development. This analysis will require an inventory of existing energy resources and their historic rate of usage. Buy applying known demand factors, future impacts may be determined and appropriate mitigation measures recommended. This analysis will include the following: • Inventory existing energy supply; • Identification of system capabilities and deficiencies; • Calculate demands under buildout alternatives; • Determine impacts associated with growth scenarios evaluated; and • Identify mitigation requirements for each impact. 2.4.15 Human Health Hazards In recent years, researchers have identified manmade health hazards which may pose significant risks to an unknowing population. This section will evaluate such hazards, which may include the effects of high-voltage transmission lines on neighboring schools or residential development. Other possible items of discussion will include the effects of rail or truck accidents involving hazardous materials, and an evaluation of whether the Diablo Canyon nuclear facility's emergency response program is adequate in light of the increased area population that the Land Use and Circulation Elements will induce. A.2-19 'NvMIcraowe.n ATTACHMENT A 3.4 PROJECT MANAGEMENT The preparation of an environmental impact report for the Land Use and Circulation Elements of the City's General Plan will require the focused application of a diversity of professional skills and expertise. Fugro-McClelland has assembled a team of highly qualified and respected professionals for this project. Principal members of the project team and their responsibilities and similar project experience are described below, followed by an organization chart Resumes for these and other support staff are provided in the Appendices. Mr. Stephen Svete, AICP, Senior Program Manager for Planning Services, will manage the project. Mr. Svete has over seven years of experience in planning, urban design and project management for both public agencies and private consulting firms. He participated in the development of General Plans for the Cities of San Bernardino, Redondo Beach and West Hollywood,and conducted the policy consistency studies associated with the Comprehensive Plan Master EIR for the City of San Buenaventura. He is currently managing the Sphere of Influence Study and Specific Plans project for the City of Santa Maria, which is in the final stages of review. Mr. Svete will be the primary contact for the City of San Luis Obispo and will manage the project schedule, budget control and staffing. Mr. Svete recently presented a paper on the subject of "Integrating Alternative Transportation Modes and Open Space" to the annual Association of Environmental Professionals Statewide Conference. Mr.John Rickenbach,Environmental Planner,will coordinate the Circulation Element analysis. Mr. Rickenbach has conducted traffic studies using gravity-model analysis techniques and has designed internal circulation systems, including bikeway and pedestrian access, for specific plan areas in Santa Barbara County. He is familiar with the principles of circulation system design, neo-traditional site planning and the incorporation of alternative modes of transportation. He is currently coordinating the preparation of Specific Plans for the City of Santa Maria, and is working closely with the City to resolve conflicts between incompatible land uses and to implement environmentally sensitive planning concepts. In addition to coordinating the analysis of the Circulation Element, Mr. Rickenbach will conduct the analysis of population/housing, circulation, archeological and historical resources associated with the study. Mr. David Romero, Environmental Planner, will coordinate the Land Use Element analysis. Mr. Romero's project experience includes the Rivergate Specific Plan EIR and the three phase Sphere of Influence and boundary adjustment study for the City of Santa Maria. He has assisted in the preparation of a variety of environmental and planning studies, including geologic evaluations, solid waste and agricultural productivity assessments, traffic and air quality studies, water and wastewater studies, land use and recreation / open space analyses, and cumulative buildout analyses. In addition to coordinating the analysis of the Land Use Element, A.3-1 EN'V n T40WP.a Attachment A Mr. Romero will conduct the analysis of utilities, noise, geology and water quality/flooding issues associated with the study. Mr. Mel Willis, AICP, Vice President of Environmental and Planning, will be responsible for contract administration. In this role, Mr. Willis has the responsibility to approve or modify the general direction of project activities and their level of effort. He is available to the study team members and the City of San Luis Obispo as needed. Mr. Willis has managed/prepared more than 100 EIR/EIS's and major planning documents. Dr. Duane Vander Pluym, Senior Program Manager, will be responsible for EIR Quality Assurance/Quality Control. Fugro-McClelland's internal QA/QC program includes peer review of all documents for technical content and consistency with contract specification. Dr. Vander Pluym has over 11 years professional consulting experience and is trained in a number of environmental disciplines, including noise, air quality, biological resource analysis, land use and traffic. Mr. Joseph Power, Environmental Planner, will be responsible for analyzing and preparing the land use, policy consistency, air quality and energy/resource use sections of the study. Mr. Power has conducted research and analysis for numerous land use and environmental studies, and recently participated in a Southern California air pollution control market study and a review of Regulation XV rideshare plans and transportation policy issues for the South Coast Air Quality Management District. Ms. Donna Hebert, Environmental Scientist, will conduct the analysis of the public services and human health hazards associated with the study. Ms. Hebert has been a principal analyst for a variety of environmental studies which have focused on public services constraints to development. She recently managed the preparation of an EIR for a 15-year development plan for the Santa Catalina Island Company and the City of Avalon, and a residential project EIR for the City of Lompoc. Ms. Jean Shepard, Environmental Planner/Landscape Designer, will evaluate the aesthetics and urban design impacts associated with the study. Ms. Shepard has participated in the preparation of numerous aesthetic and scenic resources analyses, and has designed landscape plans for professional office and retail developments, parks, private residential communities and custom homes. Prior to joining Fugro-McClelland, Ms. Shepard operated her own landscape design firm in San Luis Obispo. Ms. Sally Bull, Environmental Analyst, will evaluate the biological resource impacts associated with the study. Table 1 is a breakdown of the proposed costs by major work items. The not-to-exceed cost includes preparation of an Administrative and Final Draft EIR, Responses to Comments and a Final EIR. Attendance at up to three meetings and/or public hearings are included in the estimated fee. At City request, additional meetings will be attended and billed per our Standard Fees and General Conditions. The not-to-exceed cost includes a five (5) percent contingency fee, which is recommended to allow flexibility in the event of additional work requirements.
