Dear Lynn:
Several concerns were raised in the BIA Board of Director's letter to the City Council of
November 19, 1991. 1 would like to briefly respond to those concerns, recognizing that
a follow-up meeting has been scheduled for Monday, November 25th, to discuss these
and other issues more fully. Ken Hampian, Dave Romero, Mike Bertaccini, and Alison
Lloyd will represent the City at that meeting.
With regard to the BIA's project related complaints, attached is a memorandum from the
Utilities Director which discusses last week's work on Nipomo Street in connection with
the ongoing sewer trunk project. While we feel that both aspects of this work were
handled in a responsible and sensitive manner, (we have received compliments from
some businesses regarding both our timeliness and communication), the failure in
communication with the Cleaves should not have happened. Steps have been taken to
avoid a similar communication gap in the future.
With regard to the "No Parking" signs on Nipomo Street, while there were safety and
work-related reasons for installing the signs, the BIA'S concern has illustrated the need
for improvements to our specifications, including the amount of information which should
be included on such signs. The current contract has no such requirements. We will
follow-up in developing improved contract specifications.
In terms of the signs installed on Higuera Street, these were posted because of planned
sidewalk steamcleaning. You are correct that advanced notification should have been
provided, consistent with our commitment for improved advanced communication. You
have my assurance that we will make every effort to abide by this commitment.
Regarding a 30 day "moratorium" on City projects, there are no new City projects
scheduled for initiation through the remainder of this calendar year. In fact, no City
projects are anticipated to start construction until May 1992. City staff provided you with
a downtown project schedule in September 1991 which supports this general timeframe.
Attached is an updated schedule. A map will be provided at the November 25 meeting.
I have also attached correspondence from Southern California Gas and Pacific Bell which
show that they have no projects planned through the remainder of 1991. In addition, it
is my understanding that a meeting has been set with you in December, to include the
utility companies, to further discuss project timing and coordination.
In your November 19th letter, you indicated that the staff showed "disregard for the points
expressly stated by the BIA"in your October 15 correspondence. Let me assure you that
our November 6 response was drafted after a substantial amount of discussion and
consideration, and that City staff is committed to much improved communication and
coordination with the BIA. While we would like to "bat 1000 from day one", realistically,
there may be some glitches from time to time. In these cases, I would ask that the BIA
provide City staff with the opportunity to investigate and respond to concerns prior to
elevating them to the City Council level.
In closing, despite the recent problem I would like to point out that we have also
experienced some success as a result of our recent efforts. For example, Jim Neil of
Sandy's Liquor called me last week to commend the City for our speed in installing the
sewer trunk in front of his business and for the extra level of communication provided with
the project. He described it as the "finest effort' he's experienced in his 15 years in the
City. He felt that we "got the job done in half the time" and that his contacts with the
Contractor's employees have been excellent. So, I believe our joint efforts have had a
positive impact; such perspective is needed as we work together to make further needed
improvements.
We look forward to continued work with the BIA to improve communication and the
coordination of downtown projects.

Subject: Construction Work in the Downtown
The following information is in response to the letter from the Business Improvement
Association and the opinions expressed during public comments at the City Council
meeting on November 19, 1991 concerning the construction work in the downtown area.
1. Nipomo Street between Marsh and Higuera was posted "Closed to Through
Traffic" on Tuesday (8:00 a.m. to 4:00 p.m.) and Wednesday (7:30 a.m. to 9:30
a.m.). The work was required to correct a defect in the construction which could
have resulted in a blockage of the sewerline and subsequent damages. Businesses
immediately fronting the affected area were notified by the inspector. The
inspector should have notified the Cleeve's but failed to do so. The parking lot
serving their business was never closed.
2. On Tuesday, "No Parking" signs were placed along Nipomo Street by the prime
contractor's crew. A subcontractor was scheduled to coat the manholes on either
side of San Luis Obispo Creek Bridge with an epoxy coating. The work required
parking their truck at the manhole and spraying the inside. The prime contractor's
crew felt that posting of the parking was necessary for safety reasons. The signs
were posted on Tuesday morning. There is no requirement for 24 hour posting
unless the contractor wants the police department to have vehicles towed. The
signs were not removed after the subcontractor left in the morning because they
have to spray a number of coats inside the manhole to build-up the coating to the
required thickness. They returned to the site an additional two times on Tuesday.
The Engineering Division will revise the specifications for City projects to require
24 hour advance posting and dates and times on all "no parking" signs.

SUBJECT: Excavation Permits in the Downtown Area
In order to maintain the downtown in a presentable fashion
between the Thanksgiving and Christmas holidays, the City will
not issue excavation or sidewalk permits nor allow any new work
in City streets or on City sidewalks in the downtown area between
November 28 and December 26, 1991.
The downtown is defined as the area within, and including, Palm
Street on the north, Santa Rosa Street on the east, Pacific
Street on the south, and Nipomo Street on the west.
If you have an emergency situation we will handle it on an
individual basis.

This memo is to inform your office , that as of this "
date, Pacific Bell has no identified major jobs scheduled for
the remainder of 1991 , or projected for the 1992 calendar
year.
In the event of a service request we might need to do
such work. Also, if another utility had some major trench
work proposed, we may advance a project to utilize that same
trench. By advancing our work to coincide with the other
utility, additional disruption to the citizens would be
avoided.
