RECOMMENDATION: Introduce an ordinance to print amending the Mass
Transportation Committee Membership Requirements to exempt
the Cal Poly Representative from term limitations and direct
staff to amend the Advisory Body Handbook respectively.
BACKGROUND:
The Advisory Body Handbook requires eight year term limitations for all advisory body
members. The only exceptions are three permanent technical/special-purpose advisory
bodies including the Housing Authority, Jack House, and Tree Committee. The Mass
Transportation Committee recommends one of its representatives be similarly designated.
The 1992 appointment process resulted in 5 members retiring from their posts. One
member is the Cal Poly Representative on the Mass Transportation Committee. At its
meeting of January 28, 1992, the Mass Transportation Committee reviewed a request to
amend the Cal Poly representative's term of office and voted unanimously to urge the City
Council to allow this position to serve unlimited terms. Due to the unique role this
position plays as liaison for the University and with Transit Managers throughout the
community, staff believes this position can better serve its respective agencies by continued
service on this Committee. The position performs a dual role as community representative
and as the designated representative for Cal Poly. As a result, staff and the University have
experienced a much greater level of communication and coordination during the last eight
years.
FISCAL IMPACT: No direct or indirect costs would result except minor amendments to
effectuate the change in the enabling ordinance and Advisory Body Handbook.
RECOMMENDATION: Introduce an ordinance to print amending Mass Transportation
Committee membership to exempt the Cal Poly Representative from term limitations and
direct staff to amend the Advisory Body Handbook respectively.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO AMENDING CHAPTER 2.20 OF THE MUNICIPAL CODE AND RESCINDING
ORDINANCE NOS. 985, 1112 AND 1140 OF THE MUNICIPAL CODE REGARDING
MASS TRANSPORTATION COMMITTEE
BE IT ORDAINED by the City Council of the City of San Luis Obispo as follows:
SECTION I. Chapter 2.20, of the San Luis Obispo Municipal Code is hereby
amended to read as follows:
Section 2.20.010 ESTABLISHED
There is established the Mass Transportation committee of the City.
Section 220.020 MEMBERSHIP
The Mass Transportation committee shall consist of seven members, selected
as follows:
A. One person from California Polytechnic State University, San Luis

B. One senior citizen;
C. One person from the human relations commission;
D. One person from the business community;
E. One person with technical transporation planning experience;
F. One disabled person;
G. One person from the general public.
Provided, if in the opinion of the Council there is not available within any of
the classes listed aqualified person for appointment, the Council may appoint any
other person subject to Charter Section 1202 limitations, to fill the committee seat
for that class.

B. Vacancies shall be filled by the Council for unexpired terms.
Section 2.20.040 OFFICERS
At its first regular meeting of April 1st each year, the committee shall elect
a chairperson and vice chairperson whose terms shall be one year, commencing on
election. No person shall serve in the office of chairperson or vice chairperson for
more than two consecutive terms.
SECTION II. This ordinance, approved by the City Attorney, together with
the ayes and noes, shall be published at least three (3) days prior to its final passage in the
Telegram-Tribune, a newspaper published and circulated in said City, and the same shall
go into effect at the expiration of thirty (30) days ager said final passage.

6. Council Subcommittees Appointments: (Liaisons to advisory bodies are
selected annually by the full council - usually in December). The Mayor
and Vice-Mayor shall submit recommendations to the full Council and rotate
nominations for Councilmember Subcommittees to provide an opportunity
for each member to serve as a liaison at least once on each advisory body
when possible. When terms of office do not allow each member to serve
once, members with greatest seniority shall have first right of selection.
D. TERM OF OFFICE r
The term of office for each appointee to an advisory body shall be four years and
shall commence on April 1. No appointee shall serve on the same advisory body for
more than two consecutive, full terms (eight years), but may subsequently serve on
another advisory body unless noted otherwise. Some exceptions include: the Housing
Authority, Jack House Committee and Tree Committee.
A mid-term appointment to a vacant seat on an advisory body shall not preclude
the appointee from serving two additional consecutive full terms, provided that the initial,
partial term served is less than one year.
E. ETHICS AND CONFLICT OF INTEREST
1. The duties of an advisory body member shall be performed in good faith
and in a manner which the member believes to be in the best interest of
the City.
2. It is improper for any member of an advisory body to utilize, for personal
pecuniary gain or in an otherwise self-dealing manner, any information
which is received by reason of said membership and is not a matter of
public record.
3. No member of an advisory body shall have a material financial interest in
any contract or other transaction involving that advisory body. The member
shall promptly disclose such interest in any proposed activity of the advisory
body and shall not participate in any related deliberations or actions of that
4. All members of the Planning Commission and Architectural Review
Commission and Housing Authority are required to file Statements of
Economic Interest (form 721 or 730) under the Political Reform Act of 1974
as amended. The City Clerk will supply such forms and assist in their
completion.
5. If any advisory body or member has a concern with a Council action or
policy, the Chairperson or member of the committee shall discuss the issue
with a Councilmember before making a public statement.
JOINT RECREATIONAL USE OF SCHOO niMIr•T
PROPERTY COMMITTEE
PURPOSE
The Joint Recreational Use Committee advises the Council and the San Luis
Coastal Unified School District Board regarding policy for operation of school district joint
use recreational facilities and priorities for granting use of those facilities, and plans for
balanced integration of school district property being developed.
STATUS
The Committee was established in 1981, and is staffed by the Parks Maintenance
Supervisor, a Recreation Supervisor and two members of the staff of the Unified School
District. (Ref: SLO M.C. Chapter 2.52, Ordinance No. 906, adopted 10/27/81.)
The Joint Use Committee consists of seven members, one of whom is a
representative of the Parks & Recreation Commission.

PURPOSE
The Mass Transportation Committee assists with an ongoing program of public
transit in the City and Cal Poly. The Committee makes recommendations to the Council
regarding routes, schedules, capital projects, fares, marketing and additional services.
STATUS
The Committee was established in 1972 to study the feasibility of a public mass
transit system to serve city residents and visitors. It is staffed by the Transit Manager
who is under the supervision of the CAO. (Ref: Chapter 2.20, Ord. 1140 {1989 series},
R2382, adopted 10/14/72, Bylaws amended by Ord. 1140 (1989 series].)
MEMBERS
The Committee has seven members, who serve four year terms, and consists of
(a) one person from Cal Poly; (b) one senior citizen; (c) one person from the business
community; (d) one person with technical transportation planning experience; (e) one
handicapped person; (f) one person from the general public; and (g) a representative
from the HRC.
MEETINGS - Held on call, generally on a quarterly basis.

Dear Ms. Voges:
I am significantly concerned to hear of your recent letter to Mr. Joseph C. Risser regarding his
ineligibility to be appointed to the Mass Transportation Committee. Mr. Risser originally applied for
appointment to this committee, eight years ago, as a citizen of this community to perform a dual role
as community representative and as the designated representative for California Polytechnic State
University. Prior to this time the University experienced a wide variety of levels of communication with
this committee and coordination between the campus and the city on this important issue was
intermittent.
During Mr. Risser's two terms on the committee, he has served an essential role as liaison for the
university to the committee and with the Transit Managers. He has been instrumental in the
establishment and maintenance of the current agreement between the City and Cal Poly for SLD
Transit services. Cal Poly faculty, staff, and students now account for over 70% of the ridership of
the SLO Transit system and we participate significantly in the funding of the operation of the system.
He has also served as Vice Chair and Chairman of the committee and represented the committee at
the Area Coordinating Council's Citizens Transportation Advisory Committee.
l have recently asked Mr. Risser to chair our Parking and Traffic Subcommittee (Public Safety Advisory
Committee) due in part to his longterm interest and relationship with SLD Transit. This committee has
as a part of its charge the responsibility to develop policy to address the Air Quality Control Board's
plan for San Luis Obispo, particularly in the area of transportation control measures. Increased
utilization of SLO Transit by the campus community is one of the goals that will be set and will
necessitate continued quality in our communications and contractual relationship.
I believe that it will best serve the City and Cal Poly to have continuity in our working relationship by
maintaining a University designated member of the Mass Transportation Committee. I would
appreciate your considerat;cn of reappointment of Mr. Risser as the Cal Poly Representative to the
City's Mass Transportation Committee. l have attached his completed application for reappointment
to a city advisory body for your convenience.

STATUS FOR MASS TRANSPORTATION COMMITTEE
I would like to suggest an alternative to the recommended action. I'm hoping this advance
notice will give each of you ample time to consider this suggestion prior to our meeting.
Given the Council's support for Mass Transit, I feel it is appropriate that we establish this
one with permanent status (Reference: Advisory Body Handbook description, page C-8-
6 of staff report). This would solve several concerns:
1) Member terms would begin with permanent status. Precedence for this action
was taken with the Cultural Heritage Committee;
2) Place the proper emphasis on the importance of this committee;
3) Allow opportunities for expanded responsibilities,i.e.,alternate transportation;
4) Retain an overall conformance with other committees and commissions;
5) Allow Council liaison recommendations for appointment/reappointment.
Please call me to discuss this item. I will be out of town over the weekend.
