DISCUSSION On September 17, 1991, the Council adopted a resolution setting development review fees for planning, building & safety and engineering services at comparable levels with other communities while generating a level of cost recovery that is consistent with adopted City policy. Included in the fee increase for engineering services is the amount charged for transportation permits, which was raised from $15.00 to $35.00 for a single trip permit. In accordance with the provisions of Assembly Bill 1849, codified as California Vehicle Code Section 35795, signed into law on July 1, 1990, cities and counties are prohibited from charging more for transportation permits than the California Department of Transportation. Transportation permits are issued by the Department of Transporation and local jurisdictions to authorize the use of their streets and roads by vehicles and loads that exceed the state size and weight limitations. The Department of Transportation's current fee structure is $15.00 for single permits and $85.00 for annual or repetitive permits. As a result, it is necessary for the City to revise its current fee schedule to make it consistent with that of the California Department of Transportation. It should be noted that the Department of Transportation anticipates increasing their permit fees during the Summer of 1992. FISCAL IMPACT The fiscal impact of this charge is minimal. Statistics indicate that the City issues an average of twelve single permits and six annual permits in a year. Revising the City's fee schedule to make it consistent with the Department of Transportation will result in a loss of $19.00 for each single permit issued and a gain of $55.00 for each annual or repetitive permit issued. Based upon the statistics above, there will not be a negative impact on the City due to this change. SUMMARY Revising the City's current fee schedule for engineering services to make it consistent with that of the California Department of Transportation will bring the City into compliance with Assembly Bill 1849. (1992 SaAJES) A RESOLUTION OF THE COUNCIL OF THE CITY OF r SAN LUIS OBISPO AMENDING TRANSPORTATION PERMIT FEES CONSISTENT WITH ASSEMBLY BILL 1849 WHEREAS, the City of San Luis Obispo's Municipal Code authorizes the establishment of various fees for delivery of municipal services; and WHEREAS, the City Council of the City of San Luis Obispo adopted Resolution No. 7030, establishing development review fee schedules for Planning, Building & Safety, and Engineering Services, effective November 16, 1991; and WHEREAS, the Transportation Permit Fees set forth in Resolution No. 7030 Exhibit "C' are not in compliance with Assembly Bill 1849; NOW THEREFORE, the City Council of the City of San Luis Obispo finds and resolves that the Transportation Permit Fees established in Resolution No. 7030, Exhibit "C' shall be amended to be consistent with the fee schedule set by the California Department of Transportation as provided in Assembly Bill 1849, codified as California Vehicle Section 37595 (B).
