Romero, Public Works Director SUBJECT: Consideration of a request by BIA to reroute Highway 227 RECOMMENDATION: Adopt resolution requesting Caltrans to initiate action to transfer a portion of State Route 227 to a new alignment BACKGROUND: In past years, the City has several times discussed the possibility of rerouting a portion of State Route 227 from its current alignment along Broad Street, Marsh and Higuera, to a new alignment along South, Higuera and Madonna Road (map Attachment A) : The last formal request occurred in 1981. I.n 1983, the State set conditions which the City could not meet (Attachment B) . The City has received a request from BIA that the City once again initiate action to transfer the route alignment so as to avoid adverse effect on Thursday Night Activities/Farmer' s Market. DISCUSSION: The current alignment of Route 227 along Broad Street leads through Old Town to the downtown area at Marsh and at Higuera, then follows these one way streets southwesterly to join US 101. Although very few motorists follow this route because it is a State highway, those who do are unnecessarily led into downtown. The City government has long been concerned with the dual (City-State) jurisdiction of this route traversing the heart of downtown. Permits of all kinds for activities are cumbersome, requiring mutual concurrence, or adherence to the requirements of the stricter agency. The Thursday Night Activities/Farmer's Market has historically extended to include that portion of State highway on Higuera Street between Broad and Nipomo. This weekly activity is in violation of State statutes which prohibit the closure of a highway for special events more than four times a year and prohibit sales on a State highway. Caltrans officially notified the City of these statutes by letter of December 18 , 1991 (Attachment C) . Conflicts between the Thursday Night Activities/Farmer 's Market were discussed at a BIA meeting in. January. The meeting was also attended by City staff, Caltrans staff, and a representative from Andrea Seastrand's office. Various alternatives were discussed, and it was finally determined that the solution favored by BIA involved changing the alignment of State Route 227 to avoid downtown. BIA also received a letter of support from Andrea Seastrand (Attachment 'F) . The Caltrans letter of 1/30/92 (Attachment E) generally outlines the procedure the City must follow. A City resolution is the necessary first step. Future City steps will involve an environmental document and a public hearing. FISCAL IMPACT: Adoption of the resolution has no fiscal cost in itself. As the process moves along, requirements for the EIR will be determined. A rough general figure for this would be $30,000, which would be budgeted at the appropriate time. Currently, Caltrans and the City share maintenance costs for Route 227 within the city limits. This covers items such as street sweeping, street lighting, traffic signal operations, street painting and street repairs, all set out in a long standing Maintenance Agreement. Such agreement would be entered into for the new alignment which is 1.b miles in length, as opposed to 1. 5 miles for the current alignment. The realignment will result in increased City maintenance costs of approximately $12, 000 per year, plus an undetermined amount for periodic heavy maintenance such as resurfacing. ALTERNATIVES: The following alternatives might also meet BIA objectives as they relate to Thursday Night Activities/Farmer's Market. A. Seek legislative action to change the statutes, thus allowing continuation of the activities. B. Seek a Caltrans exemption from the statutes due to the special circumstances in San Luis Obispo. C. Shift Thursday Night Activities/Farmer's Market activities away from the block on the State highway. All alternatives would be less expensive in direct City cost. Alternatives B and C could be accomplished more quickly than the realignment of the route. Box L San Luis Obispo, CA. 93406 Dear Mr. Garcia: State Highway 227 (Broad Street) leads into San Luis Obispo from the southeast as a four lane facility with two way turning lanes and bike lanes. Between South Street and Nigh Street the roadway narrows to one lane and parking in each direction as it traverses our historic old town area enroute to downtown. After reaching downtown, Route 227 follows a one way street pair of Marsh and lliguera Streets and finally terminates at US 101 at the Marsh Street interchange. . The City Council is now in the study and hearing stage for the Circula- tion Element of the General Plan. Our deliberations consider not only the desirability of convenient traffic movement but the preservation of the character of the community as well. It has occurred to us that both of these goals could be served if Route 227 were to connect to US 101 via South Street. The city hereby requests that Caltrans initiate such a study at an early date. Box 321 San Luis Obispo, California 93406 Dear Mayor Billig 3 On August 20, 19811 you requested that Caltrans initiate a study of changing the routing of Route 227 from the Broad Street/South Street Intersection to Route 101 . The new route would be via South Street, to Higuera, to Madonna, thence to Route 101 in lieu of Broad Street to Marsh/Higuera couplet to Marsh Street Interchange. After we obtained permission from the City of San Luis Obispo (on September 23, 1982) to remove core samples from South Street, we were able to complete our study. Attached to this letter is a copy of the procedures required to transfer a highway location. Although the procedures indicate the State will not make any physical adjustments to the existing State highway, we will continue to pursue completion of the A.C. overlay on Broad Street, from Sandercock Street to Eiiguera Street (projected bid date of June 1983) , The procedures also require the local agency to comply with all public hearing and environmental requirements. In addition , the local agency must provide a substitute facility in good repair capable of accommodating the State highway traffic. Our investigation of your South Street facility revealed two areas requiring improvement: 1 . It would be required to improve South Street to a 64' , four-lane facility. It is estimated the cost to the City of widening the existing facility would be $450 ,000 (1983 dollars) . 2. Several years ago the City identified the Madonna/ Higuera and South/Higuera Intersections as problem intersections and proposed a project to realign these intersections. We would, therefore, require the City to improve these intersections in a manner similar to that proposed in 1979. It is esti- mated the cost to the City of the intersection realignment improvements would be $2,200,000 (1983 dollars) . Romero, Public Works Director SUBJECT: Farmer' s Market I have just received the attached information from Caltrans indicating that State regulations permit only four special events on State highways during a year, and that State regulations also prohibit vending from vehicles within the highway- right-of-way. Apparently our Farmer's. Market activities have become so successful that other. communities wish to copy- them and are running into these restrictions in other- Department'- of Transportation districts. -. We. have. been aware of these. restrictions in our own district. for some. years, however,. by tacit agreement we have ignored them. It appears that we must now work on some formal resolution. Several alternatives present themselves. It..would' appear that a permanent answer would be legislation through.-the League of - Cities that would permit a weekly street fair with all of' its - related activities. This may take some years to process through the legislature. Alternatively, we might shift the Farmer's Market activities northeasterly away from the one block of Broad and the one block of Higuera which are part of the State highway system. In any event, the issue is now squarely before us and should be discussed at one of the next Board meetings. Box L San Luis Obispo, CA 93403 Dear Tom, In 1983 , the City and Caltrans discussed the possibility o realigning Route 227 from the current route along Broad,- M and Higuera Street to a new alignment along South Street, Street and Madonna Road. The last correspondence on this letter from Jesus Garcia, dated March 22, 1983 , which incl two requirements. One for a full street widening and a se, one for realignment at the westerly end of South Street. In the ensuing years, the City has actively pursued wideni: the remainder of South Street to the extent that there is : only one property left to be widened. This property is no, involved in a redevelopment and probably will be .widened w. the next year. In addition, the City is in the process of repaving/reconstructing all of South Street. This should completed within the next several weeks. The second condi however, is much more serious, since it called for a realia of South Street through existing developed property at an estimated $2 . 2 million cost in 1983 . Since that time there been substantial improvements and upgrades in these properi and the costs will be substantially greater. Quite frankli condition represents an unreasonable requirement so far as City is concerned. We simply will be unable to conduct the work. It would appear that there is substantial advantage to Cali to change the alignment of Route 227, even if this realigns South Street is not made. From a Caltrans standpoint, the route would be much shortened, with inherent savings in maintenance costs and liability. The existing Route 227 traversing through Old Town also will represent some major problems for Caltrans should the time ever arise that trafi needs require that this route be widened to four travel lar that parking be prohibited. My personal opinion is that Ca would be getting the better of a straight exchange of the t routes, with no special conditions. Pollock Page Two There is some resurgence of activity among the community, particularly as it relates to Farmer's Market, to initiate discussions regarding the exchange of alignments for this route. We expect the matter to come before the City Council within the next few months and ultimately to be presented to Caltrans for consideration. Romero, Director Public Works Department City of San Luis Obispo 955 Morro Street San Luis Obispo, CA 93401 Dear Dave: Thank you for your recent letter regarding the possible relocation of State Route 227 from Broad, Higuera and Marsh Streets to South Street in San Luis Obispo. Caltrans is required to prepare a report discussing the suitability of this local facility as a State Highway. Caltrans Headquarters must concur in this transfer with final approval resting with the California Transportation Commission. To begin the process we need a formal request from the City for this transfer in the form of a resolution. The normal process calls for the City to hold a public hearing and prepare the appropriate environmental document. The success of this event is too important to the economic well-being of the downtown area to impose alterations on it now. During these already difficult economic times, I am concerned that any changes to the event may have a negative financial impact. It is for this reason that I offer you all the assistance I can to see that California Route 227 is ushered from the downtown area of San Luis Obispo. As was discussed at earlier meetings with Eric Daniels of my staff, both the City of San Luis Obispo and the local Department of Transportation office are interested in developing a solution through rerouting. I too believe a change in the highway's route to be the best answer for the situation. Caltrans informed the SIA that they would not require N LUIS >< a comprehensive EIR due to the categorical exemption of the rerouting. Caltrans stated that from their standpoint the rerouting would be superficial, thus would not require an intensive EIR. The alternatives listed were discussed at the BIA Thursday Night Activities Committee and Board of Directors meetings. Seeking legislative action, based on information from Caltrans and Assemblywoman 4:, Y Seastrand's office, was not feasible due to the broad sweeping implications for all state highways. Caltrans also felt an exemption for San Luis Obispo J would open the door to other jurisdictions, again setting a precedent for any community. Caltrans felt that these two options were not as pursuable as the rerouting. Caltrans notified the BIA that the current configuration of Thursday Night Acitivities/Farmers �y�� Market does not comply with two state statues which limit the closure of a highway to four times per year 3 for special events and prohibits sales on state highways. Caltrans has agreed to allow the BIA to operate Thursday Night Acitivities/Farmers Market on an interim basis while the re-routing is investigated. The Public . Works Department, BIA, and Caltrans agree that the re- routing is the best solution to this problem. The Public Works Department has been in communication with Caltrans to obtain approval of the re-routing. The BIA would also request that the City Council approve the re-routing.
