CAO RECOMMENDATION: Adopt the attached draft resolution denying the appeal of the Planning Commission's action. DISCUSSION: Background The Planning Commission denied the use permit application on February 26, 1992, and the applicants have appealed that decision. The Commission denied a variance to allow a parking space with a 2-1/2-foot setback for a parking space at the same meeting, but that decision was not appealed. The applicant/appellant proposes a private elementary school on two lots in the R-1 zone. Each lot has a house which would be remodelled for classrooms, office, and instructional area. The lots are on the same side of Meinecke Avenue, and separated by one lot with a house at 818 Meinecke Avenue. This property is used as rental housing, and is not part of the proposed elementary school. Fourteen parking spaces are proposed off-site at 75 Santa Rosa Street (MidState Bank). Zoning Regulations require a planning commission use permit to allow an elementary school in the R-1 zone, and to allow off-site parking. An application for architectural review as a minor or incidental project is also pending on the project, and will be processed after Council action on the use permit. U 1546 ` Page 2 Property at 814 Meinecke Avenue has a two-story house; and. 850 Meinecke Avenue has a single-story house with a carport. Houses border the site on the east side, offices on the north and east, and Casa de Vida, a home for handicapped persons, across Meinecke to the south. Several mature trees are found on the two lots. The trees are to be preserved, and no other significant vegetation is found on the site. Project Description The attached project description from the applicant states that the school would have a maximum enrollment of approximately 90 children, with a staff of five full-time and three part-time adults. Hours of operation would be approximately 8:30 a.m. to 2:30 p.m., Monday through Friday, with a more flexible schedule in the summer. The applicant proposes a number of changes to the site and buildings:, - Additional paving for on-site parking. (Paving at 814 Meinecke was installed without a permit prior to filing a use permit application. "Irrigated landscaping in permanent containers" is proposed for the paved area closest to the Meinecke frontage, where the variance denial eliminated a proposed parking space.) - Handicapped access to the first floor of each building. - Closing off windows adjoining side property lines to meet building code requirements. (Refer to Other Department Comments, below). - Addition of a carport at 814 Meinecke. - Removal of a carport at 850 Meinecke. - Additions to the rear of each structure. Interior changes would include changes to partition walls, providing handicapped restroom facilities and access, and fire sprinklers. Seven parking spaces are proposed on the two lots. Nine spaces were shown on the plans reviewed by the Planning Commission, but two spaces at 814 Meinecke were eliminated as a result of the variance denial. 14 additional spaces would be provided in a bank parking lot one block away (75 Santa Rosa Street). EVALUATION The Commission considered a number of issues in reviewing the appropriateness of the proposed school use. Those issues are outlined below. 1. Land Use Policies According to the general plan, certain non-residential uses like convenience shopping, day care centers, schools and churches which serve primarily neighborhood needs should be considered "conditionally compatible" in residential zones subject to evaluation of site development plans. Such uses should not adversely affect the privacy, peace and quiet, 3 U 1546 Page 3 access and parking for adjacent residents (Land Use Element C.2.h, attached). Two members of the Planning Commission also expressed concerns related to Housing Element policies which generally discourage replacement of residential units with non- residential uses. The commission considered several aspects of the school proposal and the neighborhood in evaluating consistency with the Land Use Element policies and surrounding uses: ■ As a private, arts-oriented school, Greenhills School is likely to serve students on a citywide basis — not primarily students from the neighborhood. ■ The "split site"layout with a house between the two school buildings increases the likelihood of parking conflicts, noise and privacy disturbances for the neighbors at 818 Meinecke. ■ About one-half of the Meinecke block between Santa Rosa Street and Chorro Street consists of residential uses (Casa De Vida is a residential group quarters in the O zone), and the remainder is offices. If this project is approved, it would contribute to a trend toward non-residential uses which may not be compatible with R-1 zoning. ■ If the Council believes the trend away from residential uses is appropriate, the Council should consider an appropriate pattern of zoning to accommodate the transition. Expanding the adjoining office zone to include properties at 814, 818, and 850 Meinecke would be an appropriate option. 2. Setback Reduction for Parking Five parking spaces are proposed which do not meet the 20-foot street yard setback normally required in the R-1 zone. Spaces which are setback at least ten feet may be approved in conjunction with a use permit (spaces 1 and 2 at 814 Meinecke, spaces 1-3 at 850 Meinecke). Although the encroachment of parldng in the street yard is significantly reduced from the plans reviewed by the Commission, there is still some question whether the extent of paving proposed is appropriate for the R-1 zone. Reduction of paved area - particularly at 814 Meinecke - would facilitate screening of parking, planting street trees, and provision of significant landscaped areas. 3. Parking_Requirements Zoning Regulations require schools to provide 2 parking spaces per classroom, plus 1 space per 300 square feet of assembly, office or common area. Seven spaces are proposed on site, and 14 parking spaces are proposed at 75 Santa Rosa Street in a parking lot adjacent to Mid-State Bank. Section 17.16.060(G) of the Zoning Regulations require that, for safety and convenience, off-site spaces be located within 300 feet of the uses served. 3-3 U 1546 Page 4 The proposed off-site parking does not meet this standard, as it is normally interpreted by staff. Although the bank property is within 300 feet of the proposed school, the designated spaces are over 750 feet away as actually walked, crossing Meinecke at either street comer (580 feet with mid-block crossing, 450 feet away "as the crow flies"). The proposed tandem parking spaces are also inconsistent with standards in the Zoning Regulations. Section 17.16.060.D2 allows tandem parking for residential uses; tandem parking for non-residential uses is not permitted. Project parking requirements are as follows: 814 Meinecke: 6 spaces for classrooms, 4 spaces for office/assembly. 850 Meinecke: 6 spaces for classrooms, 2 spaces for office/assembly. Total Required: 18 spaces Proposed parking: 814 Meinecke: 4 spaces. 850 Meinecke: 3 spaces. 75 Santa Rosa: 14 spaces. Total Proposed: 21 spaces If the tandem spaces are subtracted, a total of five conforming on-site spaces could be provided. If the off-site spaces are accepted, a total of 19 spaces - one more than the minimum required - would be provided. 4. Traffic Several neighbors testified at the Commission hearing regarding traffic problems in the neighborhood. These concerns are not supported by traffic counts, or by a traffic study performed in March, 1990, by traffic consultant Gerald Skiles. Mr. Skiles studied the traffic under a contract with the City to evaluate the traffic impacts of the office complex at 862 Meinecke. Planning staff is not aware of any more recent studies. Concerns were also raised about the safe loading and unloading of children. It may be appropriate to consider curb striping for passenger loading zones in front of both lots; such a proposal would be reviewed by the City Engineer. At the Commission hearing, the applicant proposed a car pooling plan to help address traffic generation and parking concerns. 5. Tree Removals The driveway to space #2 and #3 at 850 Meinecke will necessitate the removal of an 8" Eucalyptus tree, and endanger a Yucca. The City arborist recommends replacement of the 3- 4 U 1546 Page 5 Eucalyptus on a one-to-one ratio, and recommends that the Yucca be transplanted on the site. If the City Council approves the project, tree removals and compensating planting will be reviewed by the ARC (or by staff as a minor/incidental project). 6. Water Use Staff estimates that school will use about as much water as four houses at full projected enrollment (90 pupils). No significant impact will occur, since the project will be subject to the City's retrofit program requirements. PLANNING COMMISSION ACTION The Planning Commission's denial of the use permit application was based on the following finding: The proposed use is inappropriately located due to its split site layout and lack of on-site parking, and likely to pose land use conflicts of noise, privacy, traffic, access and parking with adjacent residential uses. Many people testified at the Commission hearing. Supporters cited the need for private educational facilities in the community; opponents expressed concerns with further traffic increases in the neighborhood, and with erosion of the residential character of the neighborhood. CONCURRENCES The Building Official notes that the proposed school will change the structures' occupancy classification and require interior and exterior modifications to meet building codes: - Fire sprinklers will be required for both structures due to the use change. - The west wall of 814 Meineke and east and west walls of 850 Meinecke will need to be 2-hour fire walls because they are less than 5 feet from the nearest property line. This will require elimination of any openings on these walls. Installation of sprinklers will eliminate the need for parapets. - Access and bathrooms for the handicapped must be provided. Engineering staff note that much of the property at 850 Meinecke is located in an A-O flood zone. The average depth of flooding in the A-O zone is three feet in a 100-year storm, and the depth of flooding is probably three feet or less at this site. Part of the property at 814 Meinecke is located in a B flood zone (less than one foot of flooding in a 100 year storm). If the cost of the remodelling exceeds 50 percent of the houses' replacement cost, city flood regulations will require that the structures be floodproofed. FISCAL IMPACT No significant impact on City revenues or expenditures are expected as a result of this project. 2�� U 1546 Page 6 ALTERNATIVES The Council may uphold the appeal, and approve the use permit subject to appropriate findings and conditions. The Council may also continue consideration of the appeal, although action must be taken by May 14, 1992. RECOMIWENDATION Staff recommends the council adopt the attached draft resolution denying the appeal, based on the finding adopted by the Planning Commission. CA 93401 805-545-5909 fax 805-542-0716 LETTER OF CLARIFICATION REGARDING PLANNING ISSUES RELATING TO THE GREENHILLS SCHOOL OF SAN LUIS OBISPO APPLICATION NUMBER 1546 To Mayor Ron Dunin, Members of the San Luis Obispo City Council , and The Community Development Department: The purpose of this letter is to clarify the reasons for bringing this case before the San Luis Obispo City Council in order to open The. Greenhills School of San Luis Obispo, (a non profit school ) . at 814 and 850 Meinecke Avenue, in the City of San Luis Obispo in September of 1992. The original request was denied at a Planning Commission hearing, held on February 26, 1992. The denial was based on our split site layout. lack of on-site parking as well as land use conflicts of noise, privacy, traffic, access. and parking with adjacent residential uses. I shall attempt to elaborate on each of the relevant planning and environmental issues because I feel it is important that you have a factual assessment of this case before the April 7, 1992 City Council meeting. SPLIT SITE LAYOUT The two presently owned sites at 850 and 814 Meinecke Ave. , are located on a transitional street that is presently zoned R-1 . yet the entire block is composed of both compatible commercial uses and residential rental uses. (Since a business tax has been levied on all rental housing in the City of San Luis Obispo, and since each house on this particular block of Meinecke Ave. between Santa Rosa and Chorro Streets is a rental property, we must conclude that the entire street is now composed of businesses. ) In addition to rental housing, there are three medical office buildings, The Casa de Vida facility for the disabled, and a Mid-State Bank branch all of which are all located in the same block as the proposed Greenhills School . The Greenhills School plans to have self-contained classrooms in each of the two already remodelled properties. We foresee a minimal number of times during which the children shall be crossing from one property to the other. We do not feel that the property located at 818 Meinecke) will create any additional operational or planning related problems because each site has been analyzed .to meet specific educational and functional program requirements successfully. 3-15 We did approach the owner of the property at 818 Meinecke to either rent or buy his rental house both prior to our Planning Commission hearing. (when there was absolutely no interest on his part to either rent or sell to us at a fair market price, ) and, again, after our hearing, when he said he would be open to proposals. The unreasonable asking price of many tens of thousands of dollars over the assessed fair market value made the sale or even lease of this property prohibitive at this time. It became clear that we would not be able to acquire this parcel prior to our April 7, 1992 City Council hearing. PARKING We have more than ample parking on site for visitors. Additional - parking is available across the street in our "Teacher Parking Area* at Mid-State Bank should the need arise. Therefore. parking is over code requirements. At our Planning Commission hearing, several commissioners questioned why we had SO MUCH PARKING! There was also concern as to the safety of the children crossing the street from the Mid-State parking lot. In answer to this. we have designated the parking lot at Mid-State Bank to be our "Teacher Parking Area" and overflow lot for special events. AT NO TIME SHALL PARENTS BE ALLOWED TO DROP THEIR CHILDREN OFF OR PICK THEM UP FROM THE MID-STATE BANK PARKING LOT. Children will be dropped off and picked up directly in front of the school with Greenhills School staff supervision, and this procedure will be strictly monitored each day. (These procedures will be further covered under the heading 'Traffic.' ) NOISE It was found in our "Environmental Determination" that the noise generated by The Greenhills School would be less than that of cars passing on either Santa Rosa or Chorro Streets, and that the noise would be limited to very short periods of time (recesses and P.E. ) during the daytime. weekday hours. The noise that would be generated would be the sounds of children singing or playing at recess or P.E. , a highly appropriate noise for an R-1 zone. There would be no noise at all generated during weekends, holidays, or after 3:00 PM. In addition. both sites back up to a six foot high wall separating the site from the landscaped parking lot of a medical office building. PRIVACY We find it hard to imagine that a school could undermine the privacy of its neighbors. We need only to examine the other schools in the community to discover that schools and neighborhoods work well together, even if the closelst neighborhood with predominantly owner-occupied residences is well over a block away. TRAFFIC AND ACCESS Traffic and safety are both primary concerns of ours. We decided that our best solution to these challenges would be to initiate a mandatory carpooling rule and staggered dismissal times in the afternoons. Access to the school would be from Santa Rosa Street so that the drivers would be able to drop off children to a waiting staff member on the school 3-! side of the street: Under no circumstances would drop-off or pick up be an appropriate time for the parent (or driver) to leave the car and congest traffic. Nor would it be appropriate for children to be dropped off either across the street from school or from the Mid-State parking lot. We anticipate each carpool drop-off or pick up to take no longer than 30-45 seconds. The driver would then proceed down Meinecke to Chorro and turn right to Foothill . We feel that making this circle will not further impact traffic since both Santa Rosa and Chorro have been designated as major arterial streets. Also, by not allowing parents or visitors to °stop and chat" during designated drop-off and pick-up times, we feel we can monitor a very orderly and safe beginning and ending to our school day. PARKING AT ADJACENT RESIDENCES As I have previously stated, we do have ample on-site and off-site parking available for our faculty, parents other visitors during all school days. However, on the rare occasions when we have an open house or a cultural arts presentation, (three to four times per year.) additional off-site parking would probably be required. VARIANCE V 1547 Because the Planning Commissioners couldn't find significant reasons to grant the variance due to any unique circumstances, we have consequently revised our site plans to eliminate the need for the variance altogether. CONCLUSIONS We feel we have directly addressed all of the issues raised at the recent Planning Commission hearing. We feel it is important to add that none of these issues were originally foreseen as a result of our negative "Environmental Determination' or from any prior neighborhood contacts. We are a school and community resource that, by our very nature, plan to be environmentally prudent and community oriented. The Greenhills School wishes to operate in an harmonious manner with the immediate neighborhood and be a vital asset to the San Luis Obispo community at large. DESCRIPTION OF PROJECT AND ENVIRONMENTAL SETTING The applicant proposes to operate a private elementary school on two non-contiguous lots. The school would have a maximum enrollment of approximately 90 children, with a staff of five full-time and three part-time adults. Hours of operation would be approximately 8: 30 a.m. to 2:30 p.m. , Monday through Friday, with a more flexible schedule in the summer. Up -to nine parking spaces would be provided on the two lots, and 14 additional spaces would be provided in a bank parking lot one block away (75 Santa Rosa Street) . The school would occupy two structures originally built as houses. There would be minimal modification to the exterior of the structures, except for additional paving. Interior modifications would also be minimal. The two houses which would comprise the school are separated by a third house. A medical office building is located behind the houses, and other houses and offices are located in the immediate vicinity. Several mature trees are found on the two lots. The trees are to be preserved, and no other significant vegetation is found on the site. The project involves three discretionary approvals from the City: * A use permit to allow a school in an R-1 zone. * A variance to allow a 2-1/2-foot setback to a parking lot where a 20-foot setback is normally required. * Architectural review of the site and building improvements as a minor and incidental project. The use permit and variance will be acted on by the Planning Commission; the architectural review application will be acted on by the Community Development Director. II. POTENTIAL IMPACT REVIEW A. Community Plans and Goals The General Plan Land Use Element includes the following policy: "Nonresidential uses which serve neighborhood needs (convenience - shopping,.. schools, parks, day care centers, churches, lodges, and similar public or semipublic -facilities) should, however, be considered conditionally compatible with residential environs, subject to evaluation of site development plans. " The proposed school use is consistent with adopted community plans and goals. B. Population Distribution and Growth No significant effect is expected. 3-l9 . ER 45-91 Page 3 C. Land Use Noise levels are addressed in Section II.G, below. No other type of compatibility impact is expected. D. Transportation and Circulation The school will generate up to two hundred trips per day, compared to approximately twenty trips per day generated by previous residential use of the site. - The increased traffic level is not expected to contribute to significant traffic congestion or hazardous conditions. No significant impact is expected. E. Public Services No significant effect is expected. F. Utilities Adequate sewer and water distribution facilities are available to serve the proposed use. Water use is not expected to be significantly greater than with residential use. No significant effect is expected. G. Noise Levels Outdoor school activities will generate increased noise levels between 8: 30 a.m. and 3 : 00 p.m. These noise levels will be noticeable from approximately one dozen residences located within 100 yards of the school site, and may occasionally interfere with quiet activities of the five closest dwellings. Noise generated by Chorro Street traffic will be louder than noise from the school for other nearby residences. The incremental increase in daytime neighborhood noise levels is not expected reach a level which would be considered a significant effect. H. Geologic and Seismic Hazards and Topographic Modifications No significant effect is expected. I. Air Quality and Wind Conditions No significant effect is expected. J. Surface Water Flow and Quality No significant effect is expected. R. Plant Life No significant vegetation will be removed. No significant effect is expected. L. Archaeological/Historical Only minor grading and construction will occur, with minimal subsurface disturbance to the site. No significant effect is expected. N. Aesthetic The parking improvements proposed are not consistent with city guidelines for appropriate streetscape improvements in residential zones. However, the site is in a mixed-use neighborhood, and the Planning Commission will evaluate compatibility with the neighborhood at a public hearing. The commission will have the authority to modify proposed improvements, or deny the project, based in part on its aesthetic impact. Even without further modification, the aesthetic impact of the project is not judged to constitute a .significant effect. 0. Energy/Resource Use The proposed project will not significantly affect the use of water or . other resources. P. Other No other types of significant effect are expected. III. As you probably know the school has asked permission to open a private elementary school on Meinecke Street in two houses whose addresses are 814 and 850 Meinecke Street. The Planning Commission turned down their request. The directors of the school have gone out of their way to make sure that the school will not be a burden on the neighborhood which presently has a mixture of residential and commercial uses. The directors have staggered the starting and ending times of,the various classes so as to minimize traffic at any one time and have made sure that classes start and end outside of the normal rush hours of the day. The E.I.R. done by the City staff indicated that there were no negative impacts related to the proposal and there were no neighbors from this block in opposition at the hearing. San Luis Obispo prides itself on the excellent education available in town. My wife and I are both educators and we believe that quality schools like Greenhills are an important extension to the existing educational framework of the town. Schools are an acceptable use in this zone and it is hard to believe that additional -hospital/office facilities with their related high traffic have been approved for construction less than two blocks away in an identical neighborhood mix while this project with no impact has.been denied. We understand that the application was turned down at the Planning Commission and is being appealed to the City Council. We are interested in sending our son,who will be in third grade next Fall,to Greenhills. There are very few options for education in San Luis Obispo. We have sent him to one private school and he now attends a public school in the city. We have been working closely with the Baraschs are convinced that Greenhills will offer a unique and quality educational option which we want to take advantage of. We = wanted our son to go there last year,but the Baraschs did not allow enough time last year to get - through the planning process. Placing our child in this private school will make a direct contribution toward easing the burden on the public schools at a time when their resources are severely stretched. The Council should do everything in its power to contribute to adding such choices in our city. It is remarkable that,with all the problems of curriculum, staff,budget, and so forth,the most significant hurdle to opening this school is the city approval process. You must not keep them from opening. We understand that there are no zones other than"public facilities"where a school can be located without special permits—and that the public facilities zones are all occupied by public schools. This street,which we know very well from use of the medical offices located on it, seems Ike a perfect location for a school. There is very little residential use on the street,which also has Casa de Vida, offices, and a bank. The school has bent over backwards to mitigate every possible environmental impact, including traffic(they will enter and exit from Santa Rosa and Chorro, not Meinecke), noise,.and parking (which they will place next to Mid-State Bank off Santa Rosa). As we understand it,a few residents from Chorro Street have taken it upon themselves to object to the school. As we see it,the school will have very little effect on them and will benefit many families from the neighborhood and throughout the city. This is a perfect location for a school. Please find in favor of granting them the conditional use permit. We hope we can find the time to attend and speak at the Council meeting, but, rl not,please take our concerns into account. I also have taught elementary grades with the arts permeating the school day. The children learned exceedingly well. They were, in fact, above grade level in academics at the end of the year. More- over, they enjoyed school and their parents were delighted. I've lived in the Foothill area of San Luis Obispo almost thirty-five years and some changes have distressed me. I taught Cal Poly students for over twenty-five years , and they are fine young people. However, they have infiltrated our residential areas and their cars and loud parties have proved a problem. That is no excuse for people from other neighborhoods objecting to Greenhills School. I believe they are venting their general frustrations . Greenhills School poses no problems of a similar nature.The childrenreither drive cars that will be parked at all hours on the street nor will they have noisy parties at night. I understand there are more than the required parking spaces for parents and visitors. With no owner-residents on the block, and no complaints from the businesses, who has a legitimate right to complain? I petition the mayor, and the other city officials , to cooperate in establishing this new educational establishment in our city. As an owner/educator for nine years in this community, I have continued to see the need for quality schools escalate in the recent years. Our school presently has an enrollment of 63 children and we have just finished the re- enrollment process for next year. Because of a high returning rate of students, we had only three spaces to fill. Consequently, we sent out 106 letters to families who we were not able to accommodate in our school. These are dedicated, sincere parents who are looking for an alternative education for their children. School owners/administrators do not enter this field for fame or fortune, for rarely are either of these things ever gained. They enter, rather, because they have a vision of what education can be like. They have ideas and goals and want to provide this for interested families. We are fortunate to have someone now, Janine Barash, in our community who wants to take on this awesome responsibility. The two properties are not adjacent to each other and will require constant movement of personnel and students between the two properties. Movement from one property to the other will make internal operations external, creating more exposure to the neighborhood. 2. The area is much to small for the use. Think of it this way, would you like to have 45 people in each house next to you if you lived there? At certain times of the day these 45 people will be outside, in the backyards, affecting the environment adjacent to the properties. 3. Chorro-Meinecke Streets are already very congested. Those of us who live on Chorro have a difficult time backing out of our driveways . Two hundred or more cars generated from the proposed school would make it even more congested. Closing of Von ' s Grocery store has already added to the traffic, with people going to trade at Lucky and Williams. We very seldom have empty parking spaces in front of our homes. The proposed parking spaces in back of the school along with the additional projected parking spaces at Midstate bank is not ample . Furthermore, Midstate could decide in the near future to sell or develop the lot , which is prime land facing Santa Rosa St. The parents and staff of the school would then be parking on Meinecke and Chorro St . The West side of Meinecke still has families that have lived there 30 to 5t years . Gradually students are taking over their parking spaces , even though they live on the other side of Chorro. Neighbors complained to the city when a skiploader started to tear up the driveway and the interior of the garage at 814 Meinecke . The city representative was told that only the driveway was being replaced, instead the whole front yard was cemented, a tree uprooted and illegal conversion was made to the garage, which now houses students . The two houses are surrounded by students , in fact the house in between is occupied by several students . They are home in between classes-which would be while the school would-be in session. The students -z- very often lie out in the sun, drinking beer, play ball in the street, are often loud and sometimes use foul language. This is not a very healthy environment for young children. There is also a lot of reckless driving on Meinecke -turning in the middle of the street, sudden turning into a driveway and backing out ,very fast traffic up and down the street . Any given day there are over thirty-three cars parked from Chorro to Santa Rosa on Meinecke. In addition there are cars parked on yards , some in driveways overhanging the sidewalks . The back yard where the children are to play is not large enough to run and play, in addition it is shady. This would be unfair to the children. Most of the permanent residents have lived in their homes twenty to fifty-five years . We cannot afford, nor want to move from our homes. We are close to the bus, grocery and drug stores . It ' s not right that our neighborhood is not safe from people that want only to change for their benefit , Please help the long time residents preserve our neighborhood. We have two children, ages 7 and 9 years, who currently attend one of the public schools in San Luis Obispo . Although I am a strong supporter of public education and am very involved at the school my children attend, I am an advocate For choice in education . Our community currently has limited alternatives to public schools . Two of the private schools in San Luis Obispo are Montessori based, and the other has a religious base . I respect the Montessori ideology and am an active parishioner at the Old Mission, but as far as private schools go, more choice is needed . The Greenhills School would give the community an additional choice. I know Janine Barasch, the Director of the Greenhills School , well . She and I have worked together extensively for the PTA of the school our children attend . She is a highly qualified individual and is one of the strongest advocates For the betterment of children that I know . I note that this location is in a residential district zoned for R-1 use. As stated in the Planning Department review a school is a permitted use on the basis that it serves the neighborhood. In this instance this is not the case. A private school in this location would not serve the neighborhood, but would mostly attract students residing outside the neighbor- hood. My understanding is that there have been many inquiries about placement of a student and that they have been citywide, with a number from outside the City. This obviously raises the question of traffic and circulation. Since this is not a conventional elementary school located in an area where a large percentage of the students can walk to school , the published studies of traffic generation do not apply. Therefore , a rational method must be used to estimate the traffic. It is reasonable that most students will be transported by private auto. Further, there will be little opportunity for car pools since the residences are diverse. The 90 students might arrive in 90 vehicles , but it is reasonable to believe that there will be some car pooling so that the number might be reduced to as few as 75 . For traffic volume calculations each drive by drop off is 2 trips. One inbound and one outbound. Thus the 75 drop offs would generate 150 trips . Assuming that lunch would be on-site, this would happen twice a day. For student service alone the trips could be 300 trips per day. Staff, deliveries and services will generate additional trips . The morning drop off is critical . In addition to the 150 trips generated by students being dropped, there will be some staff and employees arriving so that the total would probably be about 160 to 170 trips. This could be in as little as 15 minutes , with a peak of 80 trips in 5 minutes. I note that the street is usually lined with parked cars . This would require stopping in the street to unload. The site is much too small to provide an on-site loading area. It can be expected that students will be discharged on both sides of the street, requiring some to walk across the street mid-block. Major traffic congestion would not result, but there would be confusion, inconvenience and some hazard caused by vehicles stopped in the traffic lanes and the students walking between parked and moving cars. A mid-block school crossing would not be a logical mitigation. Some momentary queueing at the intersections with Santa Rosa and Chorro streets can be expected, but should last less than 10 minutes . The proposal is to pave the entire street yard to provide parking. This inconsistent with residential use. Since this would not provide enough parking, the overflow is to be provided in a separate lot. This is an unimproved vacant lot owned by a bank and located 2 blocks away on Santa Rosa Street. This has two faults . First , drivers will not park 2 blocks away if street parking is available closer. Most of the time street parking will not be available , but many drivers will cruise in search a closer space before going to the lot. Second and more important, the lot will not be controlled by the permit applicant and is subject to sale and/or development with subsequent denial of continued use . Use that is approved with reliance on this parking is speculative. I urge you not to approve this use unless a complete traffic and parking study, as part of a full environmental evaluation, shows that traffic circulation and safety can be adequately mitigated .
