CAO RECOMMENDATION: Adopt resolution approving the Memorandum of Agreement BACKGROUND: The Memorandum of Agreement (MOA) between the City of San Luis Obispo and the San Luis Obispo's City Employees' Association (SLOCEA) expired on July 1 , 1992 after a term of five years. As provided for in that agreement, the City entered into negotiations with SLOCEA in March of this year to develop a successor agreement. The City Council in closed session was briefed on March 17, 1992 on the various issues of mutual concern and economic considerations. Bill Avery, the City's chief negotiator, Ken Hampian and the Personnel Director then met for several sessions with the Association's negotiating team led by Paul Bechely of Employee Representation Service, a professional negotiator from Los Angeles. A closed session was held with Council again on June 16, 1992 where they reviewed an updated status report and directed staff to suspend negotiations indefinitely pending clarification from the State on the potential fiscal crisis California cities are facing. Again, Council and staff met in closed session on July 21, 1992 and Council authorized staff to resume negotiations. A tentative agreement was reached in late July and ratified by a majority of the Association members soon thereafter. The agreement reflects and strengthens the continued cooperation between the Association and the City to address issues of mutual concern in a productive manner. Following is a summary of the significant changes and cost items included in the agreement. The agreement is within the economic guidelines previously discussed with Council. Economic Issues: Year 1 1 July 92 - 2.5% salary increase for all employees in the unit. The Police Records Clerks I and II receive a range adjustment of 5% based upon changes to the job description resulting from the 1991 classification study 1 July 92 - Standby pay is increased $5 per day so employees on standby receive $30 for each week day, $35 for each weekend day and IAIIitmIIIgjjjll►jjjjj� city of san L.is 0.131 SPO COUNCIL AGENDA REPORT Memorandum of Agreement between the City of san Luis Obispo and the SLO City Employees' Association for the period 7/1/92 - 6/30/94. Page 2 holiday of such assignment. 1 December 92- City's contribution toward employees' health insurance increased from $285 to $355 per month and by an additional $40 per month to $395 effective 1 December 93 through 1 July 94. 1 December 92 - Vacation sell back - Employees with 80 hours of accrued vacation may request payment for ip to 24 hours of unused vacation leave provided an employee's overall performance and attendance practices are satisfactorylubject to the availability of budgeted funds. Year 2 1 July 93 - 2.5% salary increase. I Other Issues: To comply with recent legislative mandates, the MOA includes provisions required by the California Family Rights Act of 1991 and the Americans with Disabilities Act i (ADA): I Family Leave: Employees with one or more years of continuous service are entitled to up to four months of family leave within any 24 month period to care for newborn or newly adopted children; or for a child, parent or spouse with a serious health condition. ADA: The City and Association agree ,:hat the City shall take all necessary actions to comply with the provisions of this Act. Page 3 FISCAL IMPACT: Estimated increased costs in this agreement are $209,000 for year 1 and $233,400 for year 2. These are total compensation costs which include benefit costs. Funding is available in the existing fund balances for FY 92-93. Funds will be appropriated in FY 93-94 as part of the two year financial planning process in accordance with this agreement. ALTERNATIVES: (1) Do not approve the resolution and direct staff to negotiate a different successor agreement. This is not recommended as the agreement as presented is consistent with the Council's previous direction and the City's employer- employee relations policies. (2) Defer adoption of the resolution until the final State budget is approved and the City has a clearer understanding of the state's cuts in City funding. Likewise, this is not recommended since the current agreement has expired, the salary increases agreed to by the Association are significantly less than those of other City employee groups and when the State will finalize its budget is still unknown. To ask the employees to continue to postpone a reasonable adjustment to 'their salaries is not in keeping with the City's tradition of equitable compensation for its employees. (1992 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO CITY EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JULY 1 , 1992 - JUNE 30, 1994 BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: Section 1 . The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo City Employees' Association, attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. Section 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. Section 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Tim Girvin, President SLOCEA; An McPike, Personnel Director; William Statler, Finance Director.
