The tree in question was a large Italian Stone Pine located at 288 Hermosa Way in San Luis Obispo. At that time, Ms. Wardell listed "safety and roots interfering and encroaching on the sewer system" as the basis for her removal request. The matter was discussed at the October 23, 1991 Tree Committee meeting. All. five members present at the meeting voted to deny the request based on the information given by the applicant. Ms. Wardell was informed of this decision by letter. Staff received a second removal application on April 25. The request was reviewed at the May 21 meeting, however, only two committee members were present. Consequently, no formal decision was rendered and the matter was continued to the next meeting. This request was reviewed by the Tree Committee again at the July 8, 1992 meeting. At that meeting, Ms. Wardell presented plans for an addition to the existing home at 288 Hermosa Way. The addition as proposed would require the removal of the same Italian Stone Pine for which a removal permit had been denied six months earlier. Four Tree Committee members were present at this meeting: Eve vigil, Tom Shevlin, Mike Zohns and Woody Combrink. After reviewing the plans, the members requested that the plans be revised to allow for the preservation of the tree. The committee members felt the tree was an exceptional specimen tree and should be preserved. They felt it was possible to design the addition in such a way so as to allow for its retention. Ms. Wardell was informed that this might be the recommendation of the Tree Committee on May 21 when the project was reviewed by two members of the committee. Ms. Wardell informed me that she felt she was too far along in the design stage to start over and that she would appeal the decision to the City Council. Fiscal Impact: None. (1992 SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO UPHOLDING THE TREE COMMITTEE'S DECISION TO DENY TREE REMOVAL REQUEST AT 288 HERMOSA WAY WHEREAS, the San Luis Obispo Tree Committee feels that the large Italian Stone Pine located at 288 Hermosa Way is an exceptional specimen tree and should be preserved; and WHEREAS, after reviewing the plans, the members requested that the plans be revised to allow for the preservation of the tree; and WHEREAS, they felt it was possible to design the addition in such a way so as to allow for its retention. NOW THEREFORE BE IT RESOLVED that the City Council of the City of San Luis Obispo upholds the Tree Committee's decision to deny the tree removal request at 288 Hermosa Way. (1992 SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE TREE REMOVAL REQUEST AT 288 HERMOSA WAY WHEREAS, Kay Wardell has made application for removal of a large Italian Stone Pine tree located at 288 Hermosa Way due to safety, and roots interfering and encroaching on the sewer system; and WHEREAS, Ms. Wardell had been denied permission for tree removal six months previously and has now presented plans for an addition to an existing home at 288 Hermosa Way which would require removal of the said tree, and WHEREAS, the City of San Luis Obispo grants the request of Ms. Wardell to remove a large Italian Stone Pine located at 288 Hermosa Way. NOW THEREFORE BE IT RESOLVED that the City Council of the City of San Luis Obispo approves the tree removal request at 288 Hermosa Way. Use additional sheets as needed I would like to do an addition and enhance my property at 88 Hermosa bray. The property is in the R-1 zone. The proposed plan meets all the requirements for additions in the R-1 zone including lot coverage and height restrictions. The addition includes a two (2) car-garage and new front entry. (see drawing) In order to make these improvements, an Italian stone pine tree must be removed from the property. The Planning Department has approved the plan. The tree committee has rejected my request for a permit to remove the tree. I cannot proceed with -this plan without removing the tree. I have invested considerable time and money in developing my plan, having the plans prepared and getting approval from Planning. I am appealing the Tree Committee's decision. I would be willing to plant a replacement tree on the property after completion of the addition. That tree would be placed as close as practicable to the location '- of the existing tree. Another possible alternative would be to plant a street tree in a location designated by the City of San Luis Obispo. Mr. Zohns seconded the motion. The motion passed, with Mr. Shevlin voting against it. — 288- HERMOSA (Italian Stone pine) Dr. Brown presented the application and did not think the structural damage was all due to the tree and that its removal would leave a visual "hole". He favored retention of the tree. The rest of the Committee agreed with Dr. Brown's comments. Mr. Combrink moved to deny the removal request. Mr. Zohns seconded the motion. The motion passed unanimously. — 1308 GARDEN (Tree of Heaven). -j Dr. Brown presented the application and favored removal of both trees, as they were causing damage to the property. Mr. Combrink agreed that one trunk was damaging the foundation, but did not favor removal of both. Ms. Vigil did not favor removal and suggested making part of the parking lot a 24" box planter area if the removal was approved. Mr. Zohns stated he did not view the correct tree. Mr. Shevlin was concerned about legal conflicts between the two property owners and also felt the largest easterly trunk should be retained. The Committee felt that other options and alternatives should be considered for this situation rather than simply removing the trees. Mr. Combrink felt the buildings on site would be demolished long before the trees started creating major site problems. Mr. Combrink moved to deny the removal request. Mr. Shevlin seconded the motion. Ms. Vigil presented the application request. Mr. Martin recapped the previous meetings, during which, the Committee had considered this application; noting that the last time, the applicant was requested to attempt a redesign of the plan to accommodate the tree. The applicant discussed the removal request and distributed copies of the remodel plans and pictures of site damage. Mr. Combrink maintained that the tree should be saved and that the applicant could design around it, as it was an exceptional specimen of that species. Mr. Zohns agreed with Mr. Comrbink's comments, as did Mr. Shevlin. Ms. Vigil noted that the design plans presented were the same ones as presented last time, reminding the applicant that the item was continued previously to — allow for re-design options. Hence, she reiterated her agreement with retaining the tree. Mr. Combrink moved to deny the removal request. Mr. Zohns seconded the motion. The motion passed unanimously. Palos Verdes Estates, Ca. 90274 Re: 288 Hermosa Ms. Wardell, This letter is to inform you that your recent request to remove the large Italian stone pine at your property in San Luis Obispo has been denied. The San Luis Obispo Tree Committee voted unanimously in favor of retaining the tree. Upon inspection of the tree, the committee and myself saw no reason for concern over the safety of the tree. The tree is sound structurally and poses no threat to nearby structures. As for the ongoing sewer problem, there are products available that can alleviate the root problem. Many toilet bowl cleaners , for instance, contain copper sulfate which inhibits root growth in sewer lines. Another solution would be to simply replace the old tile with PVC pipe and be rid of the problem for good!
