SUBJECT: Consideration of a City Council Use Permit to to allow the Chamber of Commerce to
erect a tent in the Mission Plaza.
CAO RECOMMENDATION:
Adopt a resolution approving the use permit request.
DISCUSSION:
The Chamber of commerce sponsors an annual "SLO EXPO" event in the Mission Plaza. he
Chamber wants to use a tent to house food booths, to make it easier to comply with Health
Department requirements. Council approval is required by the Municipal Code for tent permits.
The tent would be located in front of the trellis area in the Plaza, and would be approximately 20
feet by 50 feet. A similar tent was approved by the Council for last year's SLO EXPO.
The tent ordinance also requires inspection and approval of the tent by the Building Official, Fire
Marshal and Health Officer. These officials have reviewed the tent plans, and support the
application.
The conditions of approval in the attached draft resolution provide for the annual use of a tent for
the SLO EXPO event, without subsequent hearings by the Council. The conditions also provide for
a revocation process, if conditions of approval are violated, or if written complaints are filed. These
provisions are similar to those often adopted for intermittent uses, as defined in the Zoning
Regulations.
ALTERNATIVES
The Council may wish to direct staff to prepare a draft amendment to the Municipal Code
delegating authority over tents to the Building Official or Administrative Hearing Officer, to avoid
the need for Council hearings on this type of application.

RESOLUTION NO. (1992 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING A USE PERMIT FOR INTERMITTENT TENT USE
AT MISSION PLAZA (TP 161-92)
WHEREAS, the Chamber of Commerce applied to the Cityfor authorization to erect a
tent on city-owned property at Mission Plaza on September 19, 1992, said tent to be used for
the "SLO EXPO" event, which would be open to the public; and
WHEREAS, on September 1, 1992, the Council conducted a hearing to consider the Tent
Permit Application 161-92, as provided in Section 15.24.050 of the Municipal Code.
NOW, THEREFORE, the Council of the City of San Luis Obispo approves the Tent
Permit Application based on the following findings:
SECTION 1. Approved Use of Tent
The tent may be used for the preparation and sale of food by vendors approved by the applicant.
SECTION 2. Findings
1. Occupancy of the tent structure for assembly purposes will not constitute a fire hazard,
if conducted in accordance with all provisions of the city's Fire Prevention Code.
2, The proposed tent will not be detrimental to public safety, interest, or welfare.
SECTION 3. Conditions:
1. Tent may be erected for a period of not more than three consecutive days for the "SLO
EXPO" event during the month of September each year. Thirty days prior to the
proposed event, the applicant shall notify the Fire Marshall, Community Development
Director, and Health Officer of the proposed dates. Notification shall be in writing, and
shall include information regarding proposed dates and times of the sale, and shall
include a copy of the approved site plan (Exhibit A). Any proposed changes to the
approved site plan or to the type of activity allowed by this use permit must be clearly
noted.
2. The use permit shall be subject to review by the Council, who may order a public
hearing if any of the following occur:

a. There are violations of any of the conditions of this use permit.
b. Changes are made to the site plan or the activities allowed by this use permit.
C. Written complaints from citizens or the Police or Fire Departments are received
by the Community Development Department.
d. the Council determines that conditions within the community have changed to the
extent that warrants further review at a public hearing.
3. Applicant shall comply with all provisions of the Uniform Fire Code.

Dear Greg:
Please find enclosed all information required for application of
a tent permit for the San Luis Obispo Chamber of Commerce.
The Chamber .has met several times with Larry Tolson, Public Works
Dept. and Ren McCool, Fire Dept.. to discuss each of their
requirements regarding use of a tent in Mission Plaza. The
Chamber has met and agreed to all their specifications.
FIRE DEPARTMENT:
1. Minimum 20 ft. fire lanes.
2. Tent certificate stating it is made of fire
retardent material.
3 . Minimum of 3 ft. doors.
4. Only sterno-burners allowed (no propane to be
used) .
PUBLIC WORKS DEPT:
1. No stakes allowed in erecting the tent.
2. Location approved, no obstructions involved.

E. STATEMENT OF PURPOSE: Due to the strict County health
regulations for outside food service, it has been very
difficult for the Chamber to get "food booths" to
participate in their annual SLO EXPO event; therefore,
we propose to house all food participants (14) under one
tent who need to comply with the health regulations.
F. LENGTH OF TIME: One day, Saturday, September 19, 1992 .
10: 00 am to 4 : 00 pm.

H. PARKING: Marsh and Palm Street parking structures.
We feel we have met all requirements to insure a safe event for
