DISCUSSION: In reviewing the City of San Luis Obispo's grant application, Caltrans staff has requested minor changes in Resolution No. 8038 (1992 Series), adopted by Council on July 21, 1992, which authorized a Proposition 116 grant application for two transit coaches. The requested change adds the following two clauses: "WHEREAS, Policy 19 of the CTC Proposition 116 Non-Urban County Program Policy Guidelines allows San Luis Obispo Council of Governments (SLOCOG), subject to CTC approval to transfer its applicant status to another public agency that accepts the rights and responsibilities to implement and deliver the project; and WHEREAS, SLOCOG by resolution, has recommended that the City of San Luis Obispo be approved as the eligible applicant;" I In addition, the new resolution resolves that "the City Council of the City of San Luis Obispo accepts from SLOCOG the transfer of applicant status and all management and financial responsibilities of the project." Responsibility for managing this project and acquiring the buses has always been presumed by staff as the City's. This clause merely formalizes that assumption. FISCAL IMPACT: As stated in the original Council agenda report, this Proposition 116 grant application requires no match on the part of the City. ATTACHMENTS: 1 - Original Resolution 2 - Amended Resolution hw\app.rpt RESOLUTION NO. 8038 (1992 Series) A RESOLUTION AUTHORIZING THE APPLICATION FOR STATE OF CALIFORNIA, CALIFORNIA TRANSPORTATION COMMISSION CLEAN AIR AND TRANSPORTATION IMPROVEMENT ACT NON URBAN COUNTY TRANSIT PROJECT FUNDING WHEREAS, the Clean Air and Transportation Improvement Act of 1990 allows for the purchase of Transit Coaches to enhance transit service; and WHEREAS, the City of San Luis Obispo is the hub of the consolidated regional transit system and transit is a priority service of the City Council; and WHEREAS, the City of San Luis Obispo can act as the applicant agency; and WHEREAS, all funds identified in the project application are committed to the project by the eligible applicant; and WHEREAS, other funding sources will be utilized to complete this project if the project costs exceed those identified in the application including funds from the Gas Company if compressed natural gas alternate fuel engines are used; and WHEREAS, the City of San Luis Obispo has the financial and institutional ability to accept the legal liabilities associated with this project; and WHEREAS, Clean Air and Transportation Improvement Act (CATIA)funds allocated will not supplant funds previously planned, programmed or approved for the purpose for which the CATIA funds were awarded; and WHEREAS, the San Luis Obispo . Area Coordinating Council by resolution recommends that the City be approved in this application request. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis Obispo approves the application for these CATIA funds and asks that the California Transportation Commission approve our request and authorizes the Mayor to execute the documents.
