SUBJECT: GP/PD 1455: The correction of the map for Ordinance no. 1175
(1990 Series) to reflect the actual area rezoned from R-3-H to
C-C-H-S. The rezoning area is a portion of a one-third-acre
site on the southwest corner of Dana and Nipomo Streets.
CAO RECOMMENDATION
Introduce to print an ordinance to replace Ordinance No. 1175 (1990
Series) with a revised map exhibit reflecting the Council's previous
rezoning action.
DISCUSSION
situation
I
The City Council granted final passage to Ordinance no. 1175 on August 7,
1990. Recently, staff discovered that the map attached as an exhibit to
the ordinance was inaccurate, and showed a greater area being rezoned
than the Council approved. The City Clerk determined that the council
must reintroduce the ordinance to correct the map.
The applicant had applied for, and was granted, a rezoning of a portion i
of a site on the corner of Nipomo and Dana Streets. The portion to be
rezoned contains an old warehouse building, used as a brewery and soda
works factory in the early part of this century. The rezoning would
place the building site in the Central Commercial zone, and allow its
conversion to retail commercial uses. The remainder of the site, which
contains residences and a nonconforming antique store, would remain in
the medium-high-density residential (R-3-H) zone. The map inadvertently
showed the entire property, rather than just the portion to be rezoned.
CONSEQUENCES OF NOT TARING THE RECOMMENDED ACTION
The incorrect map will continue to be a part of the ordinance, and may
cause confusion about what area was rezoned, especially since the wording
of the ordinance does not specify the area, but instead refers to the
map.

ORDINANCE NO. (1992 SERIES)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE ZONING REGULATIONS MAP TO DESIGNATE
AN AREA ON THE SOUTHWEST CORNER OF DANA
AND NIPOMO STREETS AS CENTRAL COMMERCIAL, WITH A
HISTORICAL AND SPECIAL CONSIDERATIONS OVERLAY (C-C-H-S)
(GP/R 1455)
WHEREAS, the City Council has held a hearing to consider
the zoning map amendment request GP/R 1455, for property shown on
Exhibit A, attached; and
WHEREAS, the City Council makes the following findings;
Findings•
1. The proposed zoning map amendment will not adversely affect
the health, safety, or welfare of persons living or working in
the vicinity.
2 . The map amendment is appropriate at the proposed location and
will be compatible with surrounding land uses.
3 . The map amendment conforms to the general plan and meets
zoning ordinance requirements.
4. The Community Development Director has determined that the
proposed map amendment will not have a significant effect on,
the environment and has granted a negative declaration of
environmental impact.
5. The "Special Considerations" overlay zone is to require
Planning Commission review of impacts on the creek and
compatibility with the adjacent residential neighborhood.
BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Zoning map amendment GP/R 1455 for
property shown on Exhibit A, attached, is hereby approved.
SECTION 2 . This ordinance, together with the names of
councilmembers voting for and against, shall be published once in
full, at least (3) days prior to its final passage, in the
Telegram-Tribune, a newspaper published and circulated in this
city. This ordinance shall go into effect at the expiration of
thirty (30) days after its final passage.
