SUBJECT: Permit Fee Credit for Cost of Structural Analysis
CAO RECOMMENDATION:
Adopt a resolution establishing a credit to be applied to building
permit and/or Architectural Review application fees for
strengthening or replacing an unreinforced masonry (URM) building
in an amount equal to the cost of the structural analysis required
by the City's URM strengthening program.
DISCUSSION:
Current City ordinance establishes an unreinforced masonry building
strengthening program through adoption of Appendix 1 of the 1991
edition of the Uniform Code for Building Conservation (UCBC) . The
administrative regulations added to the Appendix, which originated
with the passage of Ordinance No. 1203 on February 4, 1992, require
that URM building owners have a structural. analysis conducted to
determine the extent of compliance with the strengthening
provisions within 18 months beginning January 1, 1993.
City Council approval of Ordinance No. 1203 included direction to
staff to develop a program which offers a building permit fee
credit for the cost of the required structural analysis. City
staff and the Seismic Task Force (membership is provided as
Attachment 1) studied the concept and prepared the proposed
resolution specifying limitations and conditions under which a fee
credit could be granted. In summary, the amount of the proposed
fee credit could not exceed the reasonable cost to obtain the
required structural analysis, and could only be applied to the cost
of a future building permit or Architectural Review application for
strengthening or replacing the URM building.
CONCURRENCES:
The Finance Director concurs with the recommendation. The Seismic
Task Force and the Chamber of Commerce Board of Directors have
endorsed the proposed resolution. The Downtown BIA will be acting
on a resolution of support on November 10, 1992.
FISCAL IMPACT:
There will be reduced revenue to the City by implementation of the
fee credit, but the occurrence is difficult to estimate. Without
a mandatory schedule to complete URM strengthening, it is difficult
to anticipate when building permit applications will be submitted.

RESOLUTION NO. (1992 Series)
A RESOLUTION OF THE SAN LUIS OBISPO CITY COUNCIL
ADOPTING A FEE CREDIT FOR PERMITS
TO STRENGTHEN UNREINFORCED MASONRY BUILDINGS
WHEREAS, the City of San Luis Obispo's Municipal Code
authorizes the establishment of various fees for delivery of
municipal services; and
WHEREAS, the City of San Luis Obispo's Municipal Code
requires that owners of unreinforced masonry buildings cause a
structural analysis to be conducted of the building; and
WHEREAS, the City of San Luis Obispo encourages the
reduction of hazards associated with buildings of unreinforced
masonry construction; and
WHEREAS, the City of San Luis Obispo desires to provide a
financial incentive for strengthening unreinforced masonry
.buildings; and
WHEREAS, it is in the public interest and serves an
important municipal purpose to provide such an incentive for the
strengthening of unreinforced masonry buildings by establishing a
credit to be applied to certain city fees for the costs of said
structural analysis; and
WHEREAS, the City Council held a noticed public hearing
concerning this fee credit on November 17, 1992.
NOW, THEREFORE, BE IT RESOLVED that the City Council. of. the
City of San Luis Obispo hereby establishes a credit to be applied
to the fees for an architectural review application, plan review,
and/or building permit for strengthening or replacing an
unreinforced masonry building, subject to the following:
A. The work is in accordance with the adopted unreinforced
masonry building strengthening provisions;
B. The amount of the fee credit shall be limited to the
total documented cost to provide .the engineering
analysis required by the administrative provisions of
the Uniform Code for Building Conservation or the
combined architectural application, plan review, and
Building Permit fees, whichever is less;
C. The amount of the fee credit shall not be applicable to

work undertaken in conjunction with the• strengthening
project which creates additional floor area;
D. The amount of the fee credit may be applied to a new
building project which will replace an existing
unreinforced masonry building and shall. be applicable
to all work involved;
E. The costs associated with the structural analysis are
reasonable and appropriate, subject to' approval by the
building official.
