RECOMMENDATION: Adopt a resolution upholding the Tree Committee decision to approve the removal request DISCUSSION: On November 2, 1992, City staff received an application for tree removal from Jack Sutcliffe. The tree in question was a 45 foot tall Canary Island Pine located at 1034 Mill Street in San Luis Obispo. The tree is currently uprooting the existing handicap ramp and front porch of the house. At this point the tree has reached approximately 25% of its potential size-.and will possibly cause further damage to the main structure, if allowed to remain. For this reason, staff approved its removal. The tree was posted for removal on November 17, 1992. On November 30, 1992, Mr. Raphael Brady contacted the Public Works Department to appeal the decision to allow the tree to be removed. John Atiya, tenant of 1034 Mill Street, was notified of the appeal and informed that the matter would be forwarded to the Tree Committee for review at the December 9, 1992 meeting. The request was reviewed at the December 9, 1992 Tree Committee meeting. The property owner, Jack Sutcliffe, was present at this meeting and expressed his concerns over the tree to the Committee members. The members present at this meeting were Dr. Howard Brown, Eve Vigil, Tom Shevlin, Woody Combrink and Mike Zohns. After review of the tree and Mr. Sutcliffe's concerns, the members voted unanimously to approve the request. The tree was again posted for removal on December 10, 1992. On December 21, 1992, Mr. Brady contacted the Public Works Department to appeal the Tree Committee decision. The occupants at 1034 Mill Street were informed of this and the removal was put on hold. We have been unable to contact Mr. Sutcliffe to date. John Atiya was informed of this latest delay and was told the matter would be decided by the City Council. NOW THEREFORE BE IT RESOLVED that the City Council of the City of San Luis Obispo upholds the Tree Committee's decision to approve the tree removal request at 1034 Mill Street.
