SUBJECT: Appeal of Tree Committee decision to grant a tree
removal permit at 1034 Mill Street.
RECOMMENDATION:
Adopt a resolution upholding the Tree Committee decision to
approve the removal request
DISCUSSION:
On November 2, 1992, City staff received an application for tree
removal from Jack Sutcliffe. The tree in question was a 45 foot tall
Canary Island Pine located at 1034 Mill Street in San Luis Obispo. The
tree is currently uprooting the existing handicap ramp and front porch
of the house. At this point the tree has reached approximately 25% of
its potential size-.and will possibly cause further damage to the main
structure, if allowed to remain. For this reason, staff approved its
removal. The tree was posted for removal on November 17, 1992.
On November 30, 1992, Mr. Raphael Brady contacted the Public Works
Department to appeal the decision to allow the tree to be removed.
John Atiya, tenant of 1034 Mill Street, was notified of the appeal and
informed that the matter would be forwarded to the Tree Committee for
review at the December 9, 1992 meeting.
The request was reviewed at the December 9, 1992 Tree Committee
meeting. The property owner, Jack Sutcliffe, was present at this
meeting and expressed his concerns over the tree to the Committee
members. The members present at this meeting were Dr. Howard Brown,
Eve Vigil, Tom Shevlin, Woody Combrink and Mike Zohns. After review of
the tree and Mr. Sutcliffe's concerns, the members voted unanimously to
approve the request. The tree was again posted for removal on
December 10, 1992.
On December 21, 1992, Mr. Brady contacted the Public Works Department
to appeal the Tree Committee decision. The occupants at 1034 Mill
Street were informed of this and the removal was put on hold. We have
been unable to contact Mr. Sutcliffe to date. John Atiya was informed
of this latest delay and was told the matter would be decided by the
City Council.

in an architectural manner and continues to recommend.removal of
the tree; and
WHEREAS, the City Council of the City of San Luis Obispo has
heard the appeal of Raphael Brady to deny the removal of the 45
foot Canary Island Pine located at 1034 Mill Street and has
reviewed the minutes of the Tree Committee.
NOW THEREFORE BE IT RESOLVED that the City Council of the City
of San Luis Obispo upholds the Tree Committee's decision to
approve the tree removal request at 1034 Mill Street.

The minutes of the November 5, 1992 regular meeting were approved as
submitted.
2. TREE REMOVAL REQUESTS
Dr. Brown presented the applicant's request.
)e applicant discussed his concerns, citing damage to the handicap ramp
id the front porch.
The Committee discussed the removal request and voted unanimously to
approve the removal request and require a 15- gallon Canary Island pine as
a replacement tree.

Dr. Broom presented the applicant's request.
Mr. Combrink at d he was hesitant to vote on th rees' removals as he
was unable to close examine the tree in the ckyard. He was concerned
about removing the tree om the skyline a suggested continuing the
item so Committee members d be able o get into the backyard to view
that tree.
The applicant discussed eras proble foundation settling, and the
damage and liability Fa" by the trees. identified the three trees
covered by the remove equest and discussed t difficulty in access for
construction purp s.
Ms. Vigiljen the trees were assets and that the trees we probably
helpin o stabilize the soil. She did favor removing the tr adjoining
e ighbor's property.

has caused damage to a "Rama addition" to the porch, by rising
above the ground level as littie as 4 to 5 inches.
Removal or the nine tree will not repair the damage. or

It is my hope that this reouest be taken seriously. and
a solution found that doesn't involve the removal or a thriving
