SUBJECT: Memorandum of Agreement between the City of San Luis
Obispo and the Mid- Management /Confidential Employees'
Association for the period 1/11/93 - 12/31/93.
CAO RECOMMENDATION:
Adopt Resolution Approving the Memorandum of Agreement
BACKGROUND:
The Memorandum of Agreement (MOA) between the City of San Luis Obispo and the
San Luis Obispo's Mid - Management /Confidential Employees' Association
(SLOMM /CEA) expired on December 31, 1992 after a term of five years. As provided
for in that agreement, the City entered into negotiations with SLOMM /CEA in
December 1992 to develop a successor agreement. The City Council in closed
session was briefed on December 15, 1992 on the various issues of mutual concern
and economic considerations. The City's chief negotiator, Personnel Director Ann
Slate, and the other members of the City's negotiating team Ken Hampian and Jim
Gardiner, then met for several sessions with the Association's negotiating team led
by Dennis Cox, Streets Manager.
A closed session was held with Council again on January 5, 1993 where they
reviewed an updated status report and Council authorized a tentative agreement. The
agreement was ratified by a majority of the Association members on January 6, 1993.
The agreement reflects and strengthens the continued cooperation between the
Association and the City to address issues of mutual concern in a productive manner.
Following is a summary of the significant changes and cost items included in the
agreement. The agreement is within the economic -guidelines previously discussed
with Council.
The Significant Issues:
■ TERM - One year
111 SALARY - No salary increases
IN INSURANCE CONTRIBUTION - An increase of $70.00 per month, from $290
to $360 per month, to be applied toward health insurance premiums
■ RETIREMENT - No change to existing benefit

■ POLICY ISSUES - Family Leave

Lay -off Procedure: Employees shall receive a 60 -day notice
in the event of lay -offs. With the mutual consent of the
employee and the Department Head, an employee who has
been notified of a lay -off may leave City service during that
60 days and receive payment for the remaining days.
Pay for Performance: The approach to determining
employee pay increases continues to be performance based
but does not provide for any automatic increases (e.g.
COLA). As stated above,'there will be no salary increases
at this time.
■ LEAVES - Martin Luther King's Birthday will be observed. Employees shall
continue to receive two floating holidays, resulting in a net increase of one
holiday. (All Employee Associations have now agreed to observe Martin Luther
King's Birthday with the exception of the Firefighters' Association.)
■ CONFIDENTIAL EMPLOYEES - They shall receive the same health insurance
contribution increase and additional holiday.
FISCAL IMPACT:
Estimated increased costs in this agreement are approximately $53,000. Funding for
the first six months covered by the Agreement is available in the existing fund
balances for FY 92 -93. Funds for the second half of the year will be appropriated in
FY 93 -94 as part of the two year financial planning process in accordance with this
agreement.
ALTERNATIVES:
(1) Do not approve the resolution and direct staff to negotiate a different successor
agreement. This is not recommended as the agreement as presented is
consistent with the Council's previous direction and the City's employer -
employee relations policies.

(2) Defer adoption of the resolution until the City's financial plan is approved for
FY 93-95. Likewise, this is not recommended since the current agreement has
expired. There are no proposed salary increases in the Agreement unlike those
for other City employee groups.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO
MID - MANAGEMENT /CONFIDENTIAL EMPLOYEES' ASSOCIATION FOR
THE PERIOD OF JANUARY 1, 1993 - DECEMBER 31, 1993.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
Section 1. The Memorandum of Agreement between the City of San Luis
Obispo and the San Luis Obispo Mid- Management/Confidential Employees'
Association, attached hereto as Exhibit "A" and incorporated herein by this reference,
is hereby adopted and ratified.
Section 2. The Finance Director shall increase the Personnel Services
appropriation accounts to reflect the negotiated compensation changes.
Section 3. The City Clerk shall furnish a copy of this resolution and a copy of
the executed Memorandum of Agreement approved by it to: Dennis Cox, President
SLOMM /CEA; Ann Slate, Personnel Director; William Statler, Finance Director.
