CAO RECOMMENDATION Adopt the resolution ordering territory designated as the "Broad Street Annexation Area" annexed to the City of San Luis Obispo. BACKGROUND On December 17, 1992 the Local Agency Formation Commission (LAFCo) approved the Broad Street Annexation and deleted the area from County Service Area No. 22 (resolutions attached) . LAFCols action is the last discretionary approval required, and it formally transfers jurisdiction for the 78 acre annexation area from the County to the City. This step culminates over six years of property owner and city efforts toward annexation. Under state law, there is one more step before the annexation becomes effective. A public hearing must now be held by a "conducting authority" to allow property owners a final opportunity to comment. LAFCo designated the City of San Luis Obispo as the conducting authority for the property owner hearing. In this role, the City Council acts on behalf of LAFCo to receive written property owner protests. Prior council approvals remain in effect, and no further council approvals are needed. If a 50 percent or more landowner protest is not received, the conducting authority must adopt a resolution approving the annexation. Previous City Council actions on the Broad Street Annexation include: ■ November 17, 1992: adopted Resolution No.. 8087 exchanging property revenue between the City and County of San Luis Obispo; ■ August 4, 1992 : finally adopted Ordinance No. 1216 rezoning approximately 78 acres in the Broad Street Annexation area to C-S-PD, C-S-S, and M-S zones; ■ July 21, 1992 : adopted Resolution Nos. 8034 and 8035 amending the general plan from Rural-Industrial and Interim Conservation/Open Space to Service- Commercial/Light Industrial, and recommending LAFCo approval of the Broad Street Annexation; X&'/ ��►�����u►�uIIIIIIuI� �����I City of San tuts OBISp0 COUNCIL AGENDA REPORT Staff Report Page 2 ■ June 16, 1992: adopted Resolution No. 8023 certifying the Final Environmental Impact Report for the Broad Street Annexation. LAFCo's action culminates several years of efforts, first by Southern California Gas Company and annexation area property owners, and more recently by the City, to annex this 78 acres. The process involved extensive public review and numerous meetings between city staff and annexation area property owners, and grew out of the City Council's 1991 workprogram which designated the Broad Street Annexation as an "A-1" priority. CONSEQUENCES OF NOT TARING THE RECOMMENDED ACTION If a 50 percent landowner protest is not received and the resolution approving annexation is not adopted by the City Council, responsibility for final action rests with the County Board of Supervisors. DISCUSSION Annexation procedures are governed by the California Government Code, which requires a public hearing by a "conducting authority", acting on behalf of LAFCo, to give annexation area property owners an opportunity to protest before an annexation becomes final. At the protest hearing or within 30 days of the hearing, the conducting authority must determine whether or not there is 50 percent or greater landowner protest of annexation, based on written comments received 'at the hearing. There are two possible outcomes: 1) 50 percent or more of the landowners do not protest annexation: The City Council finds that the owners of property equal to one-half or more of the total assessed value of the annexation area ($11, 576, 819) do not protest annexation. The council must then adopt a resolution finding that a 50 percent landowner protest was not received, and approving annexation and forwarding the resolution to LAFCo for recording. 2) 50 percent or more of the landowners protest annexation: The City Council finds that the owners of property equal to one-half or more of the annexation area's total assessed value protest annexation. Council would then adopt a resolution finding that 50 percent landowner protest has occurred, and forward the resolution to LAFCo. This would conclude annexation proceedings, and no further action on the annexation could be taken for one year. �B� 1°u����►iIUIIIIIIpIpu�u�i��U�N city of San Luis OBISPO COUNCIL AGENDA REPORT Staff Report Page 3 What's Next If there is no 1150 percent protest, " the City Clerk -then forwards the council resolution, plus a $350 Board of Equalization fee, to the Executive Officer of LAFCo who issues a "certificate of completion. " The certificate is then recorded and sent to the City, County Assessor and Auditor, State Board of Equalization, and the Secretary of State, finalizing annexation. The boundary change would take effect upon recording, and tax transfer becomes effective starting with the new fiscal year on July 1, 1993 . ALTERNATIVES Alternative actions available to the council include: 1. Adopt resolution approving annexation. This would complete annexation proceedings, and the annexation would become effective upon issuance and recording of the certificate of completion. 2. Adopt resolution finding 5o percent landowner protest. This would terminate annexation proceedings for at least one year. After that time, if the City wished to pursue annexation it would need to reapply to LAFCo. 3. Do not adopt a resolution approving annexation, even though a 50 percent or more of the area's landowners do not protest annexation. LAFCo's approval is considered the final discretionary approval of annexation. Under state law, if 50 percent or more of the area's landowners do not protest, the conducting authority must adopt a resolution approving the annexation. If the conducting authority does not act, the County Board of Supervisors would then have the authority to take final action on the annexation. 4. close the public hearing and continue consideration of the item to determine the percentage of landowner protest. If there is substantial landowner protest at the hearing, council may wish to close the public hearing and continue consideration of the item for up to 30 days to determine the exact percentage of landowner protest. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San Luis Obispo hereby orders the territory described in Exhibits A and B annexed, and directs the City Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902. 5 of the Government Code to the executive officer of the Local Agency Formation Commission of San Luis Obispo County. Repropose deferred projects during the next CIP cycle: Swim Center improvements , Multi-Purpose Room improvements , pool area landscaping, Sinsheimer Park fencing, stadium outfield drainage, and stadium backstop renovation. Committee consensus is that the deferred projects are essential to the Joint Use areas. It is felt that a multi-purpose room at the swim center would be a valuable multi-use, fund generating addition to the Sinsheimer Park complex. We are also concerned that the maintenance of the baseball stadium not be minimized . It is heavily used by semi-pro teams, youth baseball , the high school , Cal Poly, Babe Ruth, and the Recreation Department. Laguna Junior High: 1 . That Laguna Junior High become a Joint Use Site. This location is needed to provide playing space for SLO Girls Softball. There are committed funds in the Sinsheimer Park Fund of $7 , 500 . 00 for this project contingent upon Laguna Junior High becoming a Joint Use Site. C.L. Smith: 1 .
