SUBJECT: Amendment to the Human Relations Commission enabling Ordinance and
Bylaws
CAO RECOMMENDATION: (1) Introduce to print an Ordinance amending the Human
Relations Commission's enabling Ordinance by adding Sexual Orientation status to the
listing that the Commission advises the City Council on, and (2) by motion adopt a
resolution amending the Commission's by-laws to reflect the same change.
DISCUSSION:
As set out in their current enabling ordinance and bylaws, the Human Relations
Commission (HRC) is responsible for advising the City Council "in its actions to create an
environment within the City in which all persons can enjoy equal rights and opportunities
regardless of race, religion, sex, national origin, age, physical, mental, or. economic
status". The HRC would like to add sexual orientation to this listing and has unanimously
requested staff to forward this request to the City Council for action. The Commission
unsuccessfully attempted to add sexual orientation to their ordinance and bylaws several
years ago. At that time, sexual orientation was not considered a protected class by the
State or Federal Government, and as such, the request never moved forward. Now that
the State has acted in this regard, the HRC is recommending that Commission include
sexual orientation in their listing. A petition supporting this change has been attached
(See Attachment 3).
To accomplish this addition requires an amendment to the HRC's enabling ordinance and
bylaws, and such, both of these documents have been prepared for City Council
consideration.
FISCAL IMPACT:
Approval of this recommendation will not result in any cost to the City.

AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING CHAPTER 2.56 OF THE SAN LUIS OBISPO
MUNICIPAL CODE, REGARDING THE PURPOSE AND FUNC'T'ION
OF THE HUMAN RELATIONS COMMISSION
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That certain amendments are hereby made to Chapter 2.56 of the San
':Luis Obispo Municipal Code, to read as follows:
Chapter 2.56 - Human Relations Commission
SECTION 256.010 ESTABLISHED
There is hereby established the Human Relations Commission, originally appointed
by motion of the Council in January, 1964.
SECTION 2.56.020 PURPOSE
It is the purpose of the Human Relations Commission to advise the Council in its
actions to create an environment within the City in which all persons can enjoy equal rights
and opportunities regardless of race, religion, sex, se ' r'eti , national origin, age,

physical, mental or economic status. The Human. .:.:Rela::....tions Commission shall make
recommendations to the Council or the City Administrative Officer on how these social
concerns and human needs can best be addressed.
SECTION 256.030 FUNCTIONS
The functions of the Human Relations Commission are:
A. To promote mutual understanding and foster harmonious relations between
persons and groups within the community, and provide a forum for residents to discuss
problems relating to human rights and relations;
B. To receive and investigate complaints concerning community tensions and acts
of discrimination, and cooperate with and assist other human services groups which have
similar purposes;
C. To make recommendations to the Council when action is proposed as a means
to insuring community cooperation and understanding;
D. To evaluate perceived inadequacies in human rights and services and to
recommend possible action;
E. To review and evaluate all City-funding requests from groups which provide
human services; to provide liaison to recipients of grants-in-aid monies, through personal
contact and required activity and budget reports;
F. Such duties, including studies and research, as the Council deems necessary and
appropriate and assigns.to the Commission.
SECTION 2.56.040 MEMBERSHIP
The Human Relations Commission shall consist of seven members who are
representative of diverse groups within the City and who have a demonstrated interest in
social issues.
SECTION 2.56.050 TERMS OF OFFICE
A. Commissioners shall be appointed by the Council for terms of four (4) years,
commencing immediately upon appointment. Commissioners shall serve at the pleasure of
the Council. Any.Commissioner may be reappointed, providing that no appointees shall
serve more than two consecutive terms (8 years).
B. Vacancies shall be filled by the Council, for unexpired terms. Appointment for
a partial term following an unscheduled vacancy shall not preclude the appointee from
serving two (2) consecutive full terms following the completion of the partial term, provided
the partial term is less than two (2) years.
SECTION.2. A summary of this ordinance, together with the ayes and noes, shall
be published once in full, at least five (5) days prior to its final passage in the Telegram-
Tribune, a newspaper published and circulated in said City, and the same shall go into effect
at the expiration of thirty (30) days after its said final passage.

RESOLUTION NO. (1993 Series)
AMENDMENT TO THE HUMAN RELATIONS COMMISSION BY-LAWS
WHEREAS, the State of California recently added sexual orientation to its listing of
protected classes; and
WHEREAS, as a result of the State's action, the Human Relations Commission
wishes to change its bylaws to include sexual orientation in the listing they advise the City
Council on.
NOW,. THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. That the amended by-laws of the Human Relations Commission are hereby
approved and adopted.
2. That sexual orientation will be added to the listing that the Human Relations
Commission advises the City Council on.

HUMAN RELATIONS COMMISSION
CITY OF SAN LUIS OBISPO
ARTICLE 1. PURPOSE
It is the purpose of the Human Relations Commission to advise the Council in its actions
to create an environment within the city in which all persons can enjoy equal rights and
opportunities regardless of race, religion, sex, i rTentatt , national origin; age,
physical, mental or economic status. The Human Relations Commission shall make
recommendations to the City Council or the City Administrative Officer on how these
social concerns and human needs can best be addressed.
ARTICLE 2. TERMS OF OFFICE
Commissioners shall be appointed by the City Council for terms of four (4) years,
commencing on April 1. Commissioners shall serve at the pleasure of the City Council..
Any Commissioner may be reappointed, provided that no appointee shall serve more than
two (2) consecutive terms (8 years).
ARTICLE 3. MEETINGS
A. The Commission shall hold a regular meeting each month but not less than ten
(10) times a year.
B. Meetings will be held at 5:30 p.m. the first Wednesday of each month.
C.. The Commission meetings shall be open to the public and shall be held at City Hall
or other previously announced locations at specific times as required by California
law.
D. A quorum shall consist of a majority of the Commissioners currently serving.
E. All actions of the Commission shall be decided by a majority vote or consensus
and shall be directed through the Commission Chair.
F._ Minutes of each meeting shall be forwarded to the City Council and be available
as a public record.
G. The Chairperson or any three members of the Commission may call a special
meeting providing a week's prior notice is given in writing to each member.
H. All Commission meetings shall be conducted according to Robert's Rules of Order.

I. All members present must vote, except when abstaining due to a declared conflict
of interest.
J. Any member with a declared conflict of interest shall not vote on or participate in
any discussion of any item or in any manner attempt to influence the decision on
that item.
ARTICLE 4. SUBCOMMITTEES
Subcommittees consisting of less than a quorum of the Commission shall be appointed,
as needed, by the Chairperson. Study committees may include non-commission
members who shall have no voting power.
ARTICLE 5. OFFICERS
A. The officers shall be a Chairperson and a Vice-Chairperson who shall be elected
at the Commission meeting in April for one-year terms.
B. The Chairperson shall preside over all meetings of the Commission, prepare all
meeting agendas and perform such duties as directed by the Commission.
C. The Vice-Chairperson shall serve in the absence or incapacity of the Chairperson.
ARTICLE 6. WORK PLAN
The Commission shall develop a work plan on an annual basis. The work plan shall be
a description of the activities that will be undertaken in order to meet the goals and
objectives of the Commission.
ARTICLE 7. AMENDMENTS
By-law amendments shall be submitted for Council approval by the affirmative vote of the
members present at a regular meeting of the Commission, provided that such
amendments shall have been discussed by the Commission on the agenda of at least two
meetings prior to the vote. The members shall receive the proposed amendments in
writing at least ten (10) days prior to the first reading.

SUBJECT: PETITION IN SUPPORT OF THE PLAN TO AMEND THE HRC'S ORDINANCE AND

We strongly urge the Human Relations Commission and the City Council to amend

this effectively if its own ordinance and bylaws discriminate by excluding a
segment of our community.

and fear and instead take a leadership role is promoting tolerance and under-
standing in San Luis Obispo. Please vote to amend the NRC 's ordinance and
bylaws to include sexual orientation.
