SUBJECT: PG&E Easement at Stenner Canyon Water Treatment Plant
RECOMMENDATION
Authorize Mayor to Execute the Easement Document with Pacific Gas and Electric Company
for the Stenner Canyon Water Treatment Plant.
DISCUSSION
The Stenner Canyon Water Treatment Plant is currently undergoing a major upgrade of the
existing facilities. A component of the construction work involved the relocation of the existing
PG&E power poles within the City's property. The poles have been relocated to eliminate
conflicts with current construction activities. This relocation necessitates a new easement with
PG&E to allow for maintenance and operation of the electric facilities serving this site, The
attached easement has been reviewed by the City Attorney and has been approved to form.
FISCAL IMPACT
There is no fiscal impact relative to this easement document.

Dear Mr. Henderson:
The City of San Luis Obispo has requested that we provide
electric service to Stenner Canyon Water. In order to do this,
we will have to acquire an easement across the property. That
easement should have already been discussed with you by Mr.
J. T. Haas of our Service Planning Department. Please review
the attached document and map. If it meets with your approval,
sign exactly as indicated on the signature page of the copy
marked "PG&E Co. Copy. " Have you signature(s) notarized using
the. attached jurat(s) , and return the signed document in the
envelope provided. The copy marked "Grantors Copy" with map
attached is for your files.
If you will supply us with a receipt for any notary fees
incurred, we will be happy to reimburse you. Should you have
any questions about this, matter, please feel free to contact me

So that we may provide service to you as quickly as possible,
your earliest attention to this matter will be appreciated.

EASEMENT
CITY OF SAN LUIS OBISPO, a public body of the State of California,
hereinafter called first party, hereby grants to PACIFIC GAS AND ELECTRIC
COMPANY, a California corporation, hereinafter called second parry, the right from time
fo.time to construct, reconstruct, install, inspect, maintain, replace, remove, and use facilities
of the type hereinafter specified, together with a right of way therefor, within a strip or
parcel of land or along a route as hereinafter set forth, and also ingress thereto and egress
therefrom, over and across the lands situate in the County
of San Luis Obispo , State of California, described as o ows:

The parcel of land, situate in Lot 8 of the Subdivision of Rancho
Potrero de San Luis Obispo, described and designated PARCEL 1 in the
deed from State of California to City of San Luis Obispo dated July
22, 1968 and recorded in Volume 1504 of Official Records at page 360,
San Luis Obispo County Records.
Said facilities shall consist of:
Such poles, aerial wires, cables, electrical conductors with asso-
ciated crossarms, braces, transformers, anchors, guy wires and
cables, fixtures, and appurtenances, as second party deems neces-
sary located along the route built on the ground by employees of
second party and approved by first party.
First party further grants to and confirms in second party all
necessary rights for second party' s existing poles and wires located
on said lands.
The legal description of this utility distribution easement was
prepared by Pacific Gas & Electric Company under Section 8730 (c) of
the Business and Professions Code.

Second party shall also have the right from time to time to trim and to cut down and clear
away or otherwise control any and all trees and brush now or hereafter on said strip or said
parcel of land or along said route, as hereinbefore set forth, and shall have the further right
from time to time to trim and to cut down and clear away any trees on either side of said
strip or said parcel of land or along said route, as hereinbefore set forth, which now or
hereafter in the opinion of second party maybe a hazard to the facilities installed hereunder
by reason of the danger of falling thereon, provided, however, that all trees which second
party is hereby authorized to cut and remove, if valuable for timber or wood, shall continue
to be the property of first party, but all branches and brush shall be burned or removed by
second party.
First party shall not erect or construct any building or other structure or drill or operate any
well under or within five feet of the center line of second party's electrical conductors
or within said strip or sarcel of land.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto.
