SUBJECT: Department of Conservation Grant for Recycling Containers in
Three City Parks
CAO RECOMMENDATION
By motion, receive report and approve contract with the County to provide
recycling containers in Santa Rosa, French and Laguna Lake parks.
DISCUSSION
Background
In October of 1991, the County was awarded a grant from the Department of Conservation
(DOC), Division of Recycling to provide recycling collection containers in major parks
throughout the county. Within the grant proposal the City requested recycling containers
for Santa Rosa and Laguna Lakes parks and Mission Plaza. Since Mission Plaza has since
been provided with recycling containers, staff recommends placing containers in French
park.
Program Description
The containers are in clusters of one, two and three, based on the anticipated volume of
materials. The containers will be clearly marked to accept aluminum, glass and plastics.
Signs provided by the County will be used to maintain consistency with County park
containers and to avoid added costs. City crews will collect the materials from the
containers and drop them off at the SLOCO Recycles sort yard. City staff will also be
responsible for maintaining the containers. For a twelve month period SLOCO Recycles
will weigh the materials and report the amounts to the County Solid Waste Coordinator.
The success of the program will be assessed by the DOC based on the amounts of materials
collected.
Fiscal Impacts
Parks staff estimates that servicing the containers will entail 3 to 5 hours of work per month
depending on the intensity of container use and, as such, can be accommodated with
existing personnel schedules.

Concurrences
The Public Works Department staff will be responsible for transfer of recyclables and
maintenance of containers as stated above. Public Works has reviewed this project and
concurs with the recommended action.
Conclusion
The City has provided collection containers for recyclable materials in the downtown area
and in Mission Plaza. Providing the infrastructure for recycling in public areas increases the
amounts of materials diverted from the landfill, demonstrates to the public that the City is
aggressively seeking solutions to solid waste and resource management problems, and
provides an opportunity to promote recycling to a broad segment of the population.
Contracting with the County to receive park containers will expand public exposure to
recycling opportunities within the City.

SAN LUIS OBISPO COUNTY PARKS RECYCLING PROJECT
CITY AND COUNTY GRANT AGREEMENT
This contract, dated September 7 , 199� by and between San Luis Obispo
County (sometimes referred to as "County') and the City of San Luis Obispo (sometimes
referred to as "City"),
WITNESSETH
WHEREAS, The County of San Luis Obispo desires to provide the public with
convenient, cost effective opportunities to recycle throughout the County; and
WHEREAS, the County of San Luis Obispo applied for a grant from the California
Department of Conservation (sometimes referred to as "DOC"), in January 1991 for recycling
bins in parks throughout the County; and
WHEREAS, the City of San Luis Obispo joined with the applicant County in requesting
the use of some of the recycling bins; and
WHEREAS, the County was awarded the grant from the Department of Conservation
in October, 1991 and entered into a contract in January, 1992 with the DOC to provide
funding for beverage container recycling bins at major parks throughout the County, a copy
of which is attached hereto and incorporated by reference as Exhibit A; and
WHEREAS, the County has procured the components of the bins and is beginning
assembly of the bin clusters as desired by the City of San Luis Obispo ; and
WHEREAS, the parties are desirous of entering into the agreement in view of the
significant benefit to the residents from the beverage container recycling bins; and
WHEREAS, it is necessary to demonstrate and report to the State of California the
commitment of all parties to the conditions of the grant as described below;

NOW, THEREFORE, in consideration of the benefits to residents and in consideration
of the mutual conditions, promises and agreements set forth herein, the County and City do
hereby mutually covenant and agree as follows:
1. The County will provide up to 9 clusters of bins to the City, subject to the
terms and conditions of the contract with the DOC, referenced above.
2. The City will keep and maintain in good condition and repair the clusters for the
length of the contract.
3. The contract term is twelve months, after which time the City will retain and
may continue to use the bins.
4. The City agrees to manage and ensure service for the park recycling program for
the chosen City park(s). The City agrees to ensure that the City program is
properly certified with the DOC Division of Recycling, as necessary.
5. In order for the County to meet the terms of the above referenced contract with
the DOC, the City agrees to report to the County Solid Waste Coordinator the
volume and type of material collected each month by the 5th of the following
month, in a format substantially represented as Exhibit B.
6. The City agrees to provide prior approval to the DOC consistent with the
contract referenced above, Exhibit A, for materials relating to this program, and,
in addition, that those materials will contain a statement acknowledging funding
by the DOC.
7. The City agrees to continue to maintain and report on the use of the bin clusters
in accordance with above referenced time and format until the date of
termination. The parties understand and agree that the contract with the DOC
referenced above may be modified by the DOC to incorporate program
schedule changes. Therefore, the parties agree that the County may modify the
reporting schedule and time period to be consistent with any changes by the
DOC.

ARTICLES
1. Evaluation: The Grantee is hereby advised that its performance under
this grant will be evaluated, and submitted to the Director of the
Department of Conservation within 30 days after the termination of
this grant.
2. Communications: All official communication from the Grantee to the
Division shall be directed to the Grant Manager as designated by the
Chief at: Division of Recycling, 1025 P Street, Sacramento, CA. ,
95814.
3. Modifications - Chances: The budget of any project within the grant
may be revised up to twenty percent (20%) from one line item to
another without increasing the total amount of the project.
By written change order, the Grant Manager may, at any time during
the effective period of the Grant, order changes within any project
without invalidating this grant, so long as such changes do not
increase the amount due, extend the term or result in substantial
change in the Scope of Work. The latter changes shall require a
formal Grant Amendment.
4. Written AmDrovel of Project Changes: The Grantee must obtain prior
written approval from the Grant Manager before making changes to the
grant. All requests should include a description of the proposed
change and the reasons for the change. Such changes should include
any budget line item revisions, minor task modifications, management
staff adjustments, and changes in grantee/subcontractor or the scope
of work.
S. Subcontractors: The Grantee shall be entitled to make use of its own
staff and such subcontractor(s) as are mutually acceptable to the
Grantee and the Division. All subcontractor(s) specifically
identified in the Scope of Work are considered to be acceptable to
the Division. Any change in subcontractor(s) which have been found
to be acceptable by the Division, shall be subject to either a grant
amendment or written change order. All contracts between the Grantee
and Subcontractors shall be subject to approval of the Grant Manager.
5. Subcontractor Work: It is understood and agreed that the Grantee and
each subcontractor shall comprise the "grantee team." The Grantee
shall function as the Prime Grantee (hereafter referred to as
Grantee) of this project and shall manage the performance of the
technical/expert subcontractors. All references to the "Grantee"
herein refer to the Prime Grantee unless otherwise noted.
The Grantee, its subcontractors and their employees shall be
responsible in the performance of the Grantee's work under this grant
in .. exercising the decree of skill and care required by customarily
aeeeated good professional practices and procedures. Any costs for
failure to meet the foregoing standards, or otherwise defective
services, which causes redundancy shall be borne by the Grantee and
not the Division.
The Grantee shall , be responsible for scheduling and assigning
subcontractors to specific tasks, . coordinating subcontractor
accessibility to the Division staff, and submitting completed
products to the Grant Manager.
7. comRetitive Bid Reauirements: In the event a subcontractor is
changed or added to those identified as subcontractors in the Gran
Proposal, the Grantee shall purchase services from the lowest
responsible bidder or pay the difference between the low bid and the
one selected. All payment requests shall document the competitiv
selection by including copies of at least three bids for services
subject to this condition. This condition may be waived upon Grantee
certification that due to the unique nature of the service a sole
source purchase is justified.

14. Ownership of Drawincs, Plans and Specifications: The Division shall
have separate and independent ownership of all drawings, design
plans, specifications, notebooks, tracing, photographs, negatives,
audio and video productions, films, recordings, original artwork,
productions, reports, findings, recommendations, data and memoranda
of every description or any part - thereof, prepared under this
Agreement, and the originals of all copies thereof shall be delivered
to the Division upon request.
The Division shall have the full right to use said originals and
copies in any manner when and where it may determine without any
claim on the part of the Grantee, its vendors or subcontractors to
additional compensation.
15. Copvricht and Trademarks: The Grantee agrees to establish for the
Division good title in all copyrightable and trademarkable materials
developed as a result of this Agreement. Such title shall include
exclusive copyrights and trademarks in the name of the State of
California.
As used herein, "copyrightable material" includes all materials which
may be copyrighted as noted in Title 17, United States Code, Section
102, as follows: 1) literary works, 2) musical works, including any
accompanying music, 4) pantomimes and choreographics, 5) pictorial,
graphic and sculptural works, 6) motion pictures and other audio
visual works and 7) sound recordings. As used herein, "trademarkable
material" means any material which may be registered as a trademark,
service mark or trade name under the California Trademark Law, cited
at Business and Professions Code (B&PC) Section 14200-14342.
"Trademark" is defined by B&PC Section 14207. "Service Mark" is
defined by B&PC Section 14206. "Trade Name" is defined by B&PC
Section 14208. Grantee agrees to apply for and register all
copyrights and trademarks, as hereabove defined, in the name of the
State of California, for all materials developed pursuant to this
Agreement which may under the applicable law be copyrighted or for
which a trademark may be registered. Failure to comply with this
article when such failure results in the loss of the exclusive right
of the State to use, publish or disseminate such materials, when such
failure and result occur during the term of the grant, -constitutes
breach of grant.
16. Special Conditions: This is not a complete list of all possible
special conditions. DOR reserves the right to place special terms
and conditions on the Grantee which may vary with each project
receiving funds during the term of the Grant Agreement.
Site Visits: DOR will conduct periodic site visits, at its own
expense, to monitor the progress during the grant term. In some
cases, slides or photographs may be required in order to document
progress or to publicize results. Also, interim verbal or written
progress reports may be required to supplement the more formal
monthly status reports. Additional copies or special due dates for
any written materials may be specified.
Compliance: The Grantee shall comply fully with all applicable
federal, state and local laws, ordinances, regulations and permits
and shall secure 'any new permits required by authorities having
jurisdiction over the project(s) , and maintain all presently required
permits. The Grantee shall ensure that any applicable requirements
of the California Environmental Quality Act are met in order to carry
out the terms of the grant.
Payment: Payments shall be made to Grantee no more than once every
thirty (30) calendar days in arrears for performing only those
services as specified in the Scope of work and Budget Sections of
this Agreement, and upon evidence of satisfactory progress and
approval by the Grant Manager. Such evidence shall consist of
written progress reports and receipt of any deliverables as required
by the grant.

Final Report: The Grantee shall submit a draft of the final narrative
management report thirty (30) days prior to the end of the grant
term. This report will include, but not be limited to:
a. Table of Contents;
b. Slide documentation, if applicable, during all stages of
activity;
C. A brief summary of the organization, the objectives of the
project and how these objectives were accomplished;
d. A discussion of the amount awarded and how the funds have been
used.
e. Any findings, conclusions, or recommendations for follow-up or
ongoing activities that might result from successful completion
of the project;
f. A statement, if applicable, of future intent of public and/or
private support to maintain or further develop the project;
g. A consolidated list of subcontractors, funded by the Grant (in
whole or in part) . Include the name, address, concise statement
of work done, time period, and value of each;
h. A summary of project(s) successes. Provide measurable results
such as tons of litter collected, pounds of each beverage
container type recycled, number of littering citations issued,
etc. ; and
i. A request for final payment should be submitted in conjunction
with the Final Report.
Review comments shall be prepared and transmitted by the State to the
Grantee within Fifteen (15) working days of receipt of the draft
version of the Final Report. After incorporation of revisions of
State submitted comments, the Grantee shall submit to the Grant
Manager one camera ready copy plus five (5) copies of the Final
Report no later than fifteen (15) days prior to the Agreement
termination date.
The State reserves the right to use and reproduce all reports and
data produced and delivered pursuant to this Agreement, and reserves
the right to authorize others to use or reproduce such materials.
Failure to comply with the reporting requirements specified above may
result in termination of this Agreement or suspension of any or all
outstanding payment requests until such a time as the Grantee has
satisfactorily completed the reporting provisions.
Travel: Travel by private or grantee owned automobile, necessary to ?
the performance of this agreement, shall be reimbursed at 24.0 cents
per mile.
Insurances: The Grantee shall obtain, and keep in force for the term

this Agreement, and require its subcontractors to obtain and keep
in force, the following insurance policies which cover any acts or
omissions of the Grantee, or its employees engaged in the provision
of service specified in this Agreement:
a. Worker's Compensation Insurance in accordance with the statutory
requirements of the State of California.
b. Comprehensive personal injury liability insurance, including
coverage for owned, hired and non-owned automobiles.

coverage for owned, hired and non=owned automobiles.

SCOPE OF WORK
Project Title: San Luis Obispo County Parks Recycling
The above named project is to be completed as a result of the award of
this grant, and shall be conducted in accordance with the following
parameters:
1. The Grantee will coordinate with local Cities and companies to
insure that recycling facilities are located at least six marks
throughout San Luis Obispo County.
2. The grantee will provide aareements with local 'uriedictions to
manage the park recyc Ing programs andwi ensure that these
programs are prstperly certified with the Div+g- Recycling.

collected will be reported to the Grantee. 7
3. The Grantee, or subcontractor, will provide agreements to_cnssurre

receptac es is interrupted or removed, the primary grantee is
responsible for ensuring proper servicing of park containers.

All materials designed, reproduced, and distributed under this Grant
Agreement must contain a at=* men* acknowledging_ funding by the

The Grantee will ensure that funding received for this project through
this Grant Agreement will be acknowledged in any resulting publicity.
The Grantee - will provide to the Grant Manager in the final report the
following:
a) A discussion of any problems and/or concerns that may arise
during the course of this project, and the corrective actions
taken;
b) Data on the volume by weight of the amount of recyclables
collected for each type (i.e. , glass, aluminum, plastic) ;
c) Slide documentation of the effectiveness of this project;
d) .Copies of all news articles and any other media coverage, as well
as all promotional and educational materials produced as a
result of this Grant Agreement.
f) Any other requirements outlined in the grant language under final
report.
