Cox, Parks & Streets Manager1 SUBJECT: State-Local Transportation Partnership Program Agreement CAO RECOMMENDATION Adopt a resolution authorizing the execution of Program Supplement No. 003 to State-Local Transportation Partnership Program Agreement No. SLTPP-5016. 'DISCUSSION The State-Local Transportation Partnership Program provides a pool of state money, dispersed by CalTrans, to be spent on street projects that improve the carrying capacity of the street or extend the life of the existing pavement by more than 10 years. Applications are submitted to CalTrans and the percentage to be paid is determined by the value of the projects submitted and the amount of money appropriated by the legislature. Reimbursements are made based on the application estimate or the actual construction cost, whichever is less. Although the application is initially approved, CalTrans does not enter into the Reimbursement Agreement until after all work is complete. The Reimbursement Agreement is based on an application submitted in June 1991 for work during the summer of of 1993. The reimbursement rate for 1993 was 2157%. Reimbursement process instructions for this project were received by the City on August 28, 1993, after CalTrans was notified of bid price. The work was accomplished under Project 93-14A. The elgible portion of the work covered by the application was $275,700. The Agreement now before the Council will thus provide a reimbursement to the City of $59,468. FISCAL IMPACT Execution of this Agreement will provide the City with $59,468 as the State share of work accomplished on project "Street Reconstruction and Resurfacing Project, Grand Avenue from Monterey to Slack Street," City Plan No. 93-14A. These funds will be deposited in the Capital outlay Fund. Attachments: Resolution Agreement pattn=2.agd/dc6 RESOLUTION NO. (1993 Series) PROGRAM SUPPLEMENT NO. 003 STATE-LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5016 WHEREAS, the State of California through the State-Local Transportation Partnership Program, encourages the expenditure of local funds for street improvement projects, and WHEREAS, the City completed project Street Reconstruction and Resurfacing Project, Grand Avenue from Monterey to Slack Streets, City Plan No. 93-14A, that included pavement overlay and rehabilitation, and WHEREAS, completion of that project now qualifies the City for a 21.57% State reimbursement of project costs in the amount of $59,468. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis Obispo hereby approves Program Supplement No. 003 to State-Local Transportation Partnership Program Agreement No. SLTPP-5016 and authorizes the Mayor to execute the documents. This Program Supplement is adopted in accordance with Paragraph 3 of Article I of the aforemen- tioned Master Agreement under authority of Resolution No. approved by the Local Entity on (See copy attached) . The Local Entity further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with any covenants or remarks setforth on the following pages . It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the agreement were executed after that determination was made. The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $59468 to be encumbered and reimbursed as follows : FY 92-93 $ 59468 FY 93-94 0 FY 94-95 0 Any increase in State Partnership funds will require a revised program supplement . Any decrease in State Partnership funds will require a revised finance letter. 2 . The State Funds Share is calculated based on the lower of the approved eligible application amount or the eligible award amount . 3 . Within 120 days of project completion a Final Report of Expenditures must be transmitted to the Caltran' s District Local Streets and Roads Engineer. 4 . The Reimbursement Ratio for this Cycle 3 (92/93) project is 21. 57°a . 5 . In accordance with the State and Local Transportation Partnership Program Guidelines dated April 1992, Section IV, Project Eligibility, the 10% allowance for construction engineering and contingencies is not eligible after Cycle 2 .
