SUBJECT: Disadvantaged Business Enterprise Plan for SLO Transit
CAO RECOMMENDATION:
Adopt a resolution approving the Disadvantaged Business Enterprise Plan for SLO Transit
DISCUSSION:
In order to receive grants from the Federal Transit Administration (FTA), SLO Transit must
have an approved plan for including qualified disadvantaged business enterprises (DBEs) in
its contract procurements. A DBE is "a small business concern whose management and daily
business operations are controlled by one or more socially and economically disadvantaged
individuals who own it". Socially and economically disadvantaged individuals include
women, Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans,
Asian-Indian Americans, and "any other individuals who can satisfactorily demonstrate social
and economic disadvantage".
SLO Transit's existing plan, written in the early 1980's for the bus yard construction grant,
had a goal to award 10 percent of contract work to DBE's. When this plan was resubmitted
with the City's recent FTA Section 9 grant application, the FTA rejected the plan and
requested a revised plan based on a 13 percent goal.
The goal of SLO Transit's revised DBE plan is to award 13 percent of the transit contracts
and subcontracts to DBE's. Specifically, one percent would go to women and 12 percent
would go to other socially and economically disadvantaged individuals. Failure to meet the
13 percent annual goal would carry no sanction or penalty but would require thorough
documentation of efforts to locate and assist DBE's who were qualified to submit bids.
FISCAL IMPACT:
SLO Transit is eligible to receive about $400,000 per year in federal operating and capital
grants, which are contingent on FTA approval of the DBE plan.

RESOLUTION NO. (1993 SERIES)
A RESOLUTION OF THE SAN LUIS OBISPO CITY COUNCIL
APPROVING THE DISADVANTAGED BUSINESS ENTERPRISE PLAN
FOR SLO TRANSIT
WHEREAS, SLO Transit, the municipal transit system for the City of San Luis
Obispo, is eligible to receive operating and capital grants from the Federal Transportation
Administration; and
WHEREAS, federal regulations require a recipient of financial assistance to have an
approved plan for including qualified disadvantaged business enterprises (DBE's) in its
contract procurements; and
WHERREAS, SLO Transit intends to afford DBE's every practical opportunity to
participate in its contracts for operations and capital improvement; and
WHEREAS, SLO Transit recognizes the need for an established DBE plan and goal;
NOW, THEREFORE, BE IT RESOLVED by the San Luis Obispo City Council to
approve the Disadvantaged Business Enterprise Plan for SLO Transit.
