SUBJECT:
Sewermain Improvement Project: Freeway 101 Easements, Toro and
Broad Streets, Specification No. 93-36.
CAO RECOMMENDATION:
By Motion, Reject All Bids for the Sewermain Improvement Project:
Freeway 101 Easements, Toro and Broad Streets, Specification No. 93-36.
Authorize the Re-advertising of the Sewermain Improvement Project and
Contract Award by the CAO if the Lowest Responsible Bid is within the
Engineer's Estimate.
DISCUSSION:
On August 17, 1993 the City Council authorized staff to advertise the
Sewermain Improvement Project. There was some delay prior to advertising
for the issuance of the encroachment permit by Caltrans required for the
work. The project specified that the City would accept a variety of
methods for trenchless repair subject to approval by the Utilities
Engineer. This was imperative as one of the lines crosses under the
freeway. The project specifications were prepared by the Utilities
Department based on information received from field personnel. Bids were
opened on October 13 and turned over to the Utilities Department for
further review.
After the bid opening, through discussion with some of the Contractors,
the Utilities Department determined additional work would be required to
breach two severely damaged points in the lines. This work was not
provided for in the original contract. This work was reflected in some
of the bids but not in others. If awarded to the low bidder, the
additional work would have been done as a change order. The estimate
received from the low bidder after the bid opening to do the extra work
was substantial and would place them as the second low bidder had it been
included in their bid. Due to the inequity in the bids, the Utilities
Department has requested the rejection of all bids and the modification
of the Special Provisions. Public Works staff has reviewed the situation
with Utilities and agrees that it is most appropriate to revise the
Special Provisions and re-bid the project.
FISCAL IMPACT:
The 1993-95 Financial Plan (page E-13) identifies $ 176, 000 for the
sewermain replacement program. Of this amount, $ 27, 800 has been
identified for a prior project, leaving a balance of $ 148, 000 to support
this project.
Engineer's Estimate $ 75, 000
Contingencies $ 5. 000
TOTAL: $ 80, 000
