Declaration of Local Emergency (�U CAO RECOMMENDATION: Adopt resolution ratifying the Mayor's Declaration of a Local Emergency issued March 10, 1995. DISCUSSION: On Friday, March 10, 1995, the Mayor issued a Declaration of Local Emergency. The authority for the Mayor's action comes from Charter Section 407 and Municipal Code Chapter 2.24. The Code provides that within seven days the Council must ratify the Mayor's action or the declaration shall have no further force and effect. It is appropriate at this meeting for the Council to so ratify the Mayor's action, and further, to determine that the emergency has terminated. FISCAL IMPACT: The Declaration of Local Emergency may assist the City in seeking reimbursement for expenses in responding to the flooding, and may further protect the City from liability claims arising out of that response. Settle, Mayor of the City of San Luis Obispo, do hereby declare the existence of a local emergency in the City of San Luis Obispo as a result of flooding, commencing March 9, 1995, and continuing until such time as the threat of flooding has dissipated, or as ratified by the City Council at its March 14, 1995, meeting. (1995 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO RATIFYING THE DECLARATION OF LOCAL EMERGENCY ISSUED BY THE MAYOR ON MARCH 10, 1995. WHEREAS, on March 10, 1995, the Mayor of the City of San Luis Obispo, acting pursuant to the authority granted by Charter Section 407 and Municipal Code Chapter 2.24, issued a declaration of local emergency; and WHEREAS, flooding in the City of San Luis Obispo commencing on March 9, 1995, constituted an extreme peril to the safety of persons and property within the City and threatened to exceed the capacity of the services, personnel, equipment and facilities of the City; and WHEREAS, the peril presented by the flooding has diminished. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Luis Obispo as follows: SECTION 1. The Declaration issued on March 10, 1995, by the Mayor is hereby ratified. SECTION 2. The local emergency is hereby proclaimed to be terminated.
