Negotiations with the Association to develop a successor agreement were begun in April, 1994. The City's negotiators were Ken Hampian, Assistant City Administrative .Officer, Wendy George, Assistant to the CAO, and William Avery of Avery & Associates. The Association's negotiating team consisted of a number of fire personnel headed first by Fire Captain Ed Marcom, then Fire Captain Bob Wilkinson and finally Fire Engineer Duncan Osborne, along with Anthony Spitileri, their negotiator. After lengthy negotiations, a tentative agreement has been reached which was ratified by the Association membership. The following is a summary of the significant changes and cost items included in the agreement. Terms of the Agreement: Length: 36 months Year 1: No salary increase. July 1, 1994 - $50.00 increase in uniform allowance to $750.00 per year. February 26, 1995 -All paid time will be considered hours worked for the purpose of determining Fair Labor Standards Act overtime. Year 2: July 1, 1995 - 2.5% salary increase. August 15, 1995 - $15.00 increase in medical insurance to $415.00 per month. Year 3: July 1, 1996 - 3.5% salary increase. Other: Effective July 1, 1995, each employee will be allowed to sell back up to 72 vacation hours annually. Also, first choice vacation slots will continue to be available for use even- if canceled by the originally selecting employee. Finally, reopeners to the contract were included as follows: 1.) Prior to the conclusion of the trial program for the 3-person paramedic engine companies the parties will meet and confer on a) engine company staffing; and b) the Station 1 captain's incentive.. 2) Upon notice from the City, the Association will meet and confer on an apprentice program. 3) Within ninety days, the City and Association will complete the meet and confer process on the addition of a bumping procedure for the layoff policy. 4) Within ninety days, the parties will determine which existing side letters and General Operations Manual policies fall within the scope of representation and should be incorporated in the Memorandum of Agreement. FISCAL IMPACT: This agreement would cost approximately $17,900 for Year 1. This cost reflects the benefits given, with no salary increase. Total compensation cost for Year 2 would be approximately $67,000 which is the cost of the salary increase plus benefits given. Total cost for Year 3 would be approximately$86,100, reflecting salary costs only. ALTERNATIVES: Do not approve the resolution and direct staff to negotiate a different successor agreement. This alternative is not recommended as the agreement presented falls within Council parameters for Years 1 and 2 and Year 3 should also fall within acceptable City parameters, based on past negotiations and what staff can reasonably predict for the future. (1995 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO FIREFIGHTERS' ASSOCIATION FOR THE PERIOD OF JULY 1, 1994 - NNE 30, 1997 BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: Section 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Firefighters' Association, attached hereto as exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. Section 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. Section 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Bob Wilkinson, President SLOFA; Wendy George, Assistant to the CAO; William Statler, Finance Director. JORG S CITY ATTORNEY r1ry C- 3-S Mr 'ING AGENDA DA 6:1& ITEM #_ MEMORANDUM August 31, 1995 TO: City Council Members FROM: Ken Hampian, Assistant City Administrator SUBJECT: Agenda Item C-3 Firefighters' Memorandum of Agreement At the request of the Firefighters' Association we are removing item C-3, approval of the Firefighters' Association Memorandum of Agreement, from the September 5, 1995 agenda. While the terms of the agreement have been ratified by the Association, we are having difficulty reaching accord on the language of some of the articles in it. Both parties will be meeting in the near future to develop acceptable language and this item will be placed on a future agenda once the difficulties are resolved.
