Dater �ion September 21, 1995 To: The City Councils of San Luis Obispo County From: William Yates, Mayor- Morro Bay Recommendation: That the seven City Councils of San Luis Obispo County agree to meet annually to discuss matters that affect the cities and that the 1996 meeting be held in the City of San Luis Obispo. Discussion: The mayors of the seven cities of San Luis Obispo County meet regularly to discuss matters that affect all cities. During these meetings, it has become clear that in order to affect changes that would ultimately benefit all cities, we must get together and communicate with one another. It is felt by the mayors that without unity among the cities, we will continue to remain in a relatively weak position when it comes to negotiating with other agencies. These future meetings will cause, the mayors believe, a unification of our voices that will provide strength to attaining our common goals. San Luis Obispo Mayor Allen Settle has graciously offered to host the 1996 meeting in his City. The City of Morro Bay is dedicated to the preservation and enhancement of our quality of life, and strives to provide a level of municipal service and safety consistent with and responsive to the needs of the public. I thank-you for your courtesy and cooperation in helping to coordinate and approve procedures to be used at that meeting. I have spoken with all of you regarding the meeting,though I have not yet spoken with Mr. Montandon as to.specific procedures and I hope he and I will have spoken shortly after this letter goes out. I wish to summarize how we intend to conduct the meeting and the agreement of all City Attorney's as to those procedures. We discussed,and agreed upon, the following: 1. Minutes: The City Clerk of the City of Nlorro Bay will be the "recording secretary" for the meeting. She will handle the tapes and prepare proposed minutes. She will be appointed as "recording secretary"by each of the respective Councils at the beginning of the meeting solely for the purpose of recording the minutes of this particular meeting. She will then prepare brief action minutes and forward them to each City Clerk along with duplicates of the tapes of the meeting. Each City will then approve the minutes at a regular meeting of their own Councils. If there are changes,they will need to be coordinated through the City Clerk of the City of SEP727-95 WED 12:04 Bf HUNT & ASSOCIATES ` FAk TiO, 805 594 1295 P, 3 City Attorneys Page 2 Morro Bay to prevent each City from adopting different minutes. It is hoped that by using an action minute format we can reduce changes to zero. 2. Ouoru : The City CIerk will establish quorums are present for each individual entity by requesting a statement from each respective Mayor. Each respective Mayor will identify the quorum and give the names of each Council Member present. The City Clerk will also confirm proper Brown Act Notice has been given prior to the commencement of the meeting. 3. Action: Action will be taken by each individual Council. There will be a motion and a second by each Council so that motions and seconds will be properly recorded in the minutes. Each Mayor will then call the vote for each City and the recording secretary shall record the vote. Each resolution voted on and passed will reflect the motion and second from each City present as well as the vote. 4. "Parliamentarian": It is agreed,that as the hosting City the City Attorney for the City of Morro Bay shall sit as "parliamentarian"and assure Brown Act compliance. Tv►•o issues were raised regarding Brown Act compliance. We wish to have assurance that proper notice was given for the meeting as to all jurisdictions,and that will be confirmed at the outset of the meeting. Secondly,a number of City Attorneys raised precautionary notes that the Councils remain restricted to properly noticed agenda topics. It is generally agreed that since this is a "special meeting" of "historic"proportions, we need to stay closely within the identified agenda items and not go afield on tangents. I shall be alert to these possibilities, but I shall hope my voice will never have to be heard in the context of the meatills. I tend to approach "parliamentary rules" simply for the purpose of facilitating the work of the Councils and will only raise issues along those lines to help them clarify motions and action or when absolutely necessary to protect the rights of members to be heard,. It is my experience that Mayor Yates runs an excellent meeting. So,frankly, I doubt I will ever need to speak. From discussing this matter with all of you, I understand only Mr. Lyon and myself will be present at the meeting. Please feel free if any of you do attend, to talk to me if you see any concerns in the handling of the meeting and we shall certainly address them,or,of course, take any action you feel is appropriate to protect your Councils. I appreciate all of your courtesy and cooperation in the handling of this meeting. I note that it is anticipated,though certainly not etched in stone,that the City of San Luis Obispo will be hosting the next meeting.
