Peterson, City Engineer SUBJECT: Transition Plan - Americans with Disabilities Act CAO RECOMMENDATION: Adopt Resolution approving the Transition Plan required by the Americans with Disabilities Act DISCUSSION: The Americans with Disabilities Act of 1990 (ADA) is intended to increase equal access to facilities, services, and other opportunities for disabled individuals, and to prevent unfair discrimination. The Act is divided into five sections: Title I prohibits discrimination against the disabled in employment practices; Title II establishes guidelines and requirements for equal access to the public entities services, Title III sets standards for access to privately owned public access facilities (restaurants, theaters, offices, etc), Title IV concerns telecommunications and Title V contains miscellaneous provisions. Title H directly affects the City. It requires public entities to make their services, programs, and activities "readily available to and usable by individuals with disabilities" (Title II, 35.150). More specifically, under Title II all public entities have the following administrative responsibilities: 1. Conduct a self-evaluation of services provided to the public. The self-evaluation examines City programs and services in search of barriers to disabled access. The City has conducted such a survey and, as a result, modified programs in many areas. 2. Designate at least one employee as the City's ADA Compliance Officer. The City Administrator has appointed the Personnel Director to this responsibility. 3. Establish a grievance procedure for resolution of complaints regarding accessibility. The City has a formal complaint procedure which allows complaints of potential discrimination to be filed with the City department involved or with the City's designated ADA Compliance Officer. Complaints may be written, using the City's complaint form if desired, or filed verbally. All verbal complaints must go to the Compliance Officer. 4. Develop a Transition Plan for the removal of architectural barriers. The Transition Plan must: (a) prepare an analysis of physical barriers to access City facilities; (b) detail methods for barrier removal; (c) present a schedule for modifications; and (d) identify an official responsible for plan implementation. This work has been started but not completed and documented. This report, along with the attached plan and resolution, complete the administrative requirements of Title II. 1 1 / 11111111►►i�ullllllllll� city o� san �u�s o�ispo do COUNCIL AGENDA REPORT Identify Barriers An "Analysis of Barriers" to access report was prepared by the Building Division of the Community Development Department under the direction of Tom Baasch, the Chief Building Official. The final document was completed in February, 1994. In addition to reviewing barriers to access, the analysis also identified each area of deficiency where City facilities did not meet ADA compliance. The degree of total non-compliance was identified, as well as a cost category and a recommendation to correct the deficiency. Fire Station 1, the Water Reclamation Plant and Water Treatment Plant were not included in the study due to construction pending or under way at each facility. The estimated cost to correct all of the identified deficiencies was $1.5 million. In recognition of the high cost to retrofit buildings and other facilities, the ADA Act does not require the removal of all barriers nor rehabilitation to meet full compliance with all ADA requirements. The Act requires that all public provided services be made accessible by relocation of services to accessible sites, by making special accommodations, or by removing the barrier. If more than one barrier exists to a service, only one need be removed to provide access and show compliance with Title II. A good example is the entrance to City Hall. The main front doors are not accessible to wheel chairs. Access would be expensive and have a significant impact on the appearance of the building. The provision of directional signing to an alternate entry that is accessible would satisfy this deficiency. Methods for Removal Whereas the "Analysis of Barriers" document identifies barriers to services (and other ADA issues), compliance with Title II requires a listing of decisions or methods used to provide barrier removal and assure access to services. Staff reviewed all the deficiencies listed in the document and selected those items which fell into three categories of barriers to each City provided service and listed the preferred removal method/strategy for each. The three categories of barriers were identified a follows: A) barriers which deny access to buildings; B) barriers within buildings which deny access to services; and C) barriers within buildings which deny access to public restrooms. The selected strategies are described in Attachment 2. Schedule of Modifications Title II requires adoption of a schedule of implementation. The schedule can either be rigid or fixed or fluid to account for changing public demand or financial conditions. Staff has proposed the adoption of the latter type of schedule (Attachment 1). The proposed schedule is based upon setting of priorities for implementation of each of the three categories of access barriers described in Attachment 2. Staff believes that the priority listing should be as follows: a) first priority: access to buildings; b) second priority: access to services; c) third priority: access to restroom facilities. . 2 �����►n�►ilullllllllip°1°�u���UIU city of San i:aIS OBISPO INS== COUNCIL AGENDA REPORT Staff further believes that, not withstanding the above priorities, the citizens should have an active voice in setting the project implementation schedule or modifying priorities for projects. As such, staff proposes to continue use of the Human Relations Commission (HRC). For the past two years the HRC has reviewed a proposed list of potential projects, received input from the disabled community and made recommendations to the City Council of specific projects to implement. Thus, also described in Attachment 1, is inclusive language describing the public's role in setting of priorities for implementation. Finally, "services" can be defined as not only access to programs or activities within buildings, but also access to facilities used by the public, specifically access to public sidewalks. Thus, the implementation schedule also includes a separate section dealing with the eventual conversion of all public sidewalks to allow full access. In conclusion, with limited funding available the above process will assure the timely completion of the highest priority projects and the eventual elimination of all barriers to access described in Attachment 2. Any implementation of any program (streets maintenance, storm drainage, MIS or ADA) is dependent upon funding. The City Council has committed thus far to spending approximately 20% of Community Development Block Grant (CDBG) funding (a federal grant program) toward implementation of Title H (a federal mandated program). Currently, half of that amount is directed toward access to public sidewalks and half toward access to public buildings. The Council adopts a two-year budget and during that process takes input from the public (including the disabled); its various Commissions and Committees (including the HRC); and the City staff before adopting priorities, goals, objectives (for 2 years) and capital improvement projects for 4 years. Implementation of the schedule is proportionate to the funding available and is the responsibility and right of the City Council. Identify Responsible Official The fourth and last part of the Transition Plan requires the City to designate at least one employee to implement the Transition Plan. The proposed plan assigns this responsibility to the City Administrative Officer. Acting within his authority, he can then assign responsibility for the program to a department head. What projects have occurred to date? Playground facilities in Meadow, Throop, Santa Rosa, Johnson and Laguna Lake parks have been installed to ADA standards. Currently under construction are: a) new Parks and Recreation office building; b) new Fire Station No. 1; c) Marsh Street reconstruction for sidewalk access; d) curb ramp reconstruction project for sidewalk access; and e) restrooms at Santa Rosa and French Parks. Currently out to bid is a restroom remodel project in Mission Plaza. Work 3 �3 city of San tins osIspo COUNCIL AGENDA REPORT scheduled for design and construction is: a) rehabilitation to the front door of City Hall; b) rehabilitation of the Historical Museum; c) rehabilitation of the Swim Center; and d) three additional park recreation areas. CONCURRENCES: This report has been reviewed by the Personnel Department staff and is presented with their concurrence. FISCAL BIPACT: The American with Disabilities Act is one of the true federal "unfunded" mandates. It does not provide funding, but mandates local governments provide all access modifications. The total estimated liability represented by all of the barriers to access identified on Exhibit B is $900,000. Two years ago, the City became eligible for CDBG funds and identified partial use of those funds for correcting access deficiencies. In the 1994/95 budget, $60,000 was set aside for sidewalk ramp reconstruction and $40,000 for Mission Plaza Restroom revisions. In the 1995/96 budget, 5150,000 was set aside for ramp reconstruction in the Central Business District. The 1995/96 allocation will not be used for that purpose and the Council will be asked to direct that $118,000 be used to provide ADA access to the County Museum. Other projects (providing ADA access) have been funded by the General Fund. The funding of future projects is dependent upon the availability of CDBG funds, and the priority assigned to General Fund projects which include aspects of ADA compliance. Priority for implementation of projects addressing removal of barriers to access to Public Buildings: First Priority: All buildings owned, maintained, and used by the City, and which the public is expected to enter, shall be made accessible. Access will be considered available when at least one point of access is available to the public to gain entry to each public floor of the building. Second Priority: All public services provided shall be made accessible to the public. Public access will be available when the public can participate in all public activities carried on at the location. Third Priority: Restroom facilities in all accessible buildings owned, maintained, and used by the City shall be made accessible. Access will be considered available when at least one restroom per gender per floor or a single "special purpose" restroom, that is open to the public, of a building which has public access and barriers to access and services removed. When restrooms are separately available for men and women, there shall be also be separate barrier free facilities. B. Curb Ramps at street intersections. The City has identified 1846 points where pedestrians must cross into a street from a sidewalk. More than 40% of these crossing points already have some sort of transition ramp provided. The remaining 60% do not. The City adopts the following priorities for placement of ramps: First priority: Place ramps where no ramp exists. Considering input from elderly and disabled persons, ramps shall be installed in the following order: A. Locations requested by persons with disabilities that would benefit from the ramp. B. Central business district. C. Adjacent to Senior Center. D. Adjacent to senior housing facilities. E. Along arterial streets. F. Around public parks. G. Remaining locations. Second priority: Construct ramps at locations where groups or individuals request specific custom installations. C. Priority for Non-Buildings. Although not required by ADA Transition Plan Guidelines, the City is committed to providing access to services at non-building locations, ie. parks, swim facilities, etc. The City's goal is to have all such facilities accessible within a reasonable period of time. D. Setting of Schedule. The City Council shall direct the Human Resource Commission (HRC) to conduct public hearings, appropriately advertised, during January of each odd numbered year to receive input from the public regarding locations and kinds of barriers that should be removed. The HRC, after receiving testimony,shall review the requests received, staff input, and prepare a recommended program of barrier removal for inclusion in the City's two year budget. The HRC recommendation shall be included in the budget proposal presented to the City Council for their consideration. In addition the ADA prohibits discrimination against disabled persons. Title II of the Act requires public entities to make their services, programs, and activities "readily available to and usable by individuals with disabilities". This part of the Act does not require that all facilities be made accessible; public entities may relocate services to accessible sites or remove architectural barriers to current facilities. On the basis of the regulations the Public entity must prepare a Transition Plan that: 1. Identifies physical barriers in the public entity's facilities that limit the accessibility of its programs or activities to individuals with disabilities; 2. Describes in detail the methods that will be used to make the facilities accessible; 3. Specifies the schedule for taking the steps necessary to achieve compliance; and 4. Indicates the official responsible for implementation of the plan. Attached, as Attachment 2, is a listing of those items, which if eliminated would provide three categories of access to City provided services. The three categories of access barriers are determined to be: a) barriers to buildings; b) barriers to services within buildings; and c) barriers to restroom facilities within buildings. Each of the barriers within each of the categories is listed with a specific method by which the barrier will be removed. It is also noted that removal of the barrier may not be necessary should the building become vacant or the service relocated to a facility fully ADA accessible. Attached, as Attachment 1, is an implementation schedule of the modifications described in Exhibit B. The schedule recognizes the importance of the public's ability to modify priorities within that schedule, as well as the City's ability to fund those priorities.
