CAO RECOMMENDATION: Introduce ordinance to print (1) repealing Chapters 15.04 and 15.20 and Section 17.16.100 of the San Luis Obispo Municipal Code, and (2) creating a new Chapter 15.04 adopting the 1994 editions of the Uniform Codes and the 1993 edition of the National Electrical Code with amendments. DISCUSSION: Background Every three years the Uniform Codes are republished to incorporate all code changes accepted by majority vote of the Class "A" members of the International Conference of Building Officials attending annual code development meetings. The State of California adopts and amends the most recent edition of the Codes, which are subsequently published by the Building Standards Commission. State law mandates that local jurisdictions enforce the most recently adopted codes (known as the California Building Standards Code, Title 24) beginning 180 days following the date of publication by the Building Standards Commission. As a result, the 1994 editions of the Uniform Codes will become effective on December 29, 1995. Because of the mandate to enforce the California Building Standards Code, the City realistically has no choice other than adoptionof the new codes. Without this action, the Building & Safety Division will be faced with enforcing two sets of codes: the 1994 codes for issues subject to State jurisdiction and the 1991 codes (current municipal code) for all other matters. Confusion among designers, builders, and enforcement staff involved with both types of projects will be eliminated by establishing one set of standards. In addition, this action will be an opportunity to include amendments to the California Building Standards Code which address unusual local conditions in the City of San Luis Obispo as allowed by Section 18941.5 California Health and Safety Code. The proposed ordinance contains the findings necessary to justify the recommended modifications. Technical Summary The proposed ordinance will repeal existing chapters of the municipal code which (1) adopt and amend the 1991 codes and (2) establish local standards for solar water heating. The ordinance will (1) create a new chapter adopting the 1994 codes with previous amendments and (2) relocate requirements from Chapter 17 of the municipal ��I�►��►IIUIIIII�III°111 l� City Of San L"I S OBS SpO COUNCIL AGENDA REPORT code to Chapter 15 as an amendment to the 1994 Uniform Administrative Code (UAC). ' Although the 1994 Uniform Codes have been reformatted to be consistent with other model code groups, the technical content remains basically the same as the previous edition. Past code adoptions by the City of San Luis Obispo have included administrative and technical amendments to the Uniform Codes and the National Electrical Code (NEC) to address special situations or conditions in our city.. Staff has determined that the amendments previously adopted have not become part of the next edition of the codes through the ICBO code change process or by State of California amendment. Since there has been no change in special "climatic, geologic, or topographic" conditions in San Luis Obispo, staff recommends that previous amendments be carried over to the new codes. The deletion of solar water heating requirements in Chapter 15.20 is due to the fact that the current California Energy Code accomplishes a far greater amount of energy conservation than is provided by the City's local amendments for the occupancies covered. The planning review process will continue to require solar water heating as a planning application approval condition when required by other authority or policy. Brief summaries of all proposed code amendments in this adoption cycle are found in Attachment 1 to this report. Amendments retained from previous code adoptions with no changes: ■ Clarification of membership and function of the Board of Appeals and the Board of Appeals for Disabled Access. ■ References to City Council resolutions instead of Uniform Administrative Code tables for fees. ■ Fire-resistive requirements for construction in the commercial fire zone (same as Fire Code amendment). ■ Deletion of parapets and fire-resistive corridor construction as a trade-off for expanded fire sprinkler requirements. ■ Prohibition on the use of wood shingle and shake roof coverings (same as Fire Code amendment). ■ Additional requirements for the disposal of on-site surface drainage. ■ Foundation and concrete floor slab requirements due to expansive soil conditions. ■ Fire-resistive requirements for awnings. ■ Additional requirements for swimming pool construction or abandonment. ■ Grading limitations and additional requirements. ■ Floodproofing requirements (parallels existing flood prevention regulations). ■ Reference to regulations for construction in flood areas and adjacent to waterways. ■ Requirements for water well permits. ■ Continuation of existing administrative regulations for unreinforced masonry building mitigation in the Uniform Code for Building Conservation. Amendment retained from previous code adoption with minor modification: I ■ Requirement that all new buildings be equipped with an automatic fire sprinkler ����►�►►i��IIIIIII�I ��I11 City Of San suis OBISPO Njj% COUNCIL AGENDA REPORT system. Modification to the existing amendment will provide an exception for small buildings (not exceeding 1000 square feet of floor area) constructed for office, retail, storage, or garage use. Experience over the past few years found that this exception is needed to accommodate small projects where the cost of a fire sprinkler system is disproportionate to the total project cost (parallels Fire Code amendments). Amendment that is new to Chapter 15 of the municipal code: ■ Requirements for underground wiring at electric and communication service connections moved from Chapter 17 with minor clarification. Attachment 2 illustrates actual text changes for all proposed amendments to the Uniform Codes and the National Electrical Code. Conclusion This code adoption will continue the incorporation of all special construction requirements unique to San Luis Obispo into nationally recognized "building codes". The recommended action is a "housekeeping' function retains previously established amendments and maintains compatibility with all State regulations (Title 24) . The placement of all construction regulations in the same chapter of the municipal code benefits designers, builders, and enforcement staff. CONCURRENCES: The City Engineer's office concurs with floodproofing and grading provisions as amended. The Fire Department supports efforts to consolidate local construction requirements in one document and concurs with the proposed amendments. FISCAL IMPACT: There are no significant fiscal impacts. Proposed Ordinance (Available for review in the Council Reading File. ) 14 — Attachment 1 DISCUSSION OF AMENDMENTS PROPOSED CHAPTER 15.04 OF THE SAN LUIS OBISPO MUNICIPAL CODE SECTION 15.04.010 ADOPTION OF CODES The 1994 editions of the Uniform Administrative, Building, Mechanical, Plumbing, Housing, and Dangerous Building Codes, the 1994 Uniform Code for Building Conservation, and the 1993 National Electrical Code, including appropriate appendices, are adopted in this section. SECTION 15.04.020 BUILDING OFFICIAL DESIGNATED This section continues existing text and names the staff person referenced throughout the Uniform Codes. SECTION 15.04.030 AMENDMENTS; UNIFORM ADMINISTRATIVE CODE (UAC) A. Section 204.1 is amended to specify the number of members on the Board of Appeals and to establish this board as the appeals board for all of the adopted construction and hazard abatement codes. Section 204.2 establishes the Appeals Board for Disabled Access, includes a statement of the Board's purpose, and adds two physically disabled members to the Board of Appeals to create this board. B-E. Sections 304.2, 304.3, 304.5.2, 305.8, and 308.3 are amended to replace fee tables in the UAC with a reference to City Council resolutions establishing fees. F. Section 308.3 is relocated from Section 17.16.100 of the Zoning ordinance and added to the UAC. This section establishes requirements for underground electric and communication services for new projects. Minor changes have been included for clarification. G. Fee tables in the UAC are deleted. See item B-E above. SECTION 15.04.040 AMENDMENTS; UNIFORM BUILDING CODE (UBC) A. Sections 102 thru 109 of the UBC are deleted because administrative provisions are contained in the UAC. Appendix chapters are deleted for the following reasons: Chapter 3-Division III establishes an alternate code (CABO One and Two Family Dwelling Code) for residential occupancies, which is not adopted by the State of California. Chapter 10 references the Uniform Building Security Code. This 2 document is a necessary code in areas where crime is prevalent. Experience has not shown a need for this additional regulation for San Luis Obispo. Chapter 11 contains access standards for the physically disabled which are superceeded by State of California accessibility requirements found in the California Building Code. Chapter 12-Division I mandates alternative requirements for interior ventilation. The California Energy Code (Part 6, Title 24, California Building Standards Code) contains extensive ventilation requirements for commercial occupancies which superceed this chapter. Chapter 13 references the Model Energy Code, which is superceeded by California Energy Code (Part 6, Title 24, California Building Standards Code). Chapter 15 concerns reroofing. Historically, the Building & Safety Division has not experienced problems resulting from reroofing projects in the City and has determined that implementation of the permit and inspection requirements of this chapter are unnecessary. Chapter 16-Division I establishes criteria for snow load design and is not applicable to the San Luis Obispo area. Chapter 19 establishes criteria for concrete exposed to freezing and thawing, which is not applicable to the San Luis Obispo area. Chapter 21 establishes structural design requirements for masonry construction in high-wind areas (wind speeds exceeding 80 mph), which is not applicable to San Luis Obispo. Chapter 23 contains structural requirements for conventional light- frame construction in high-wind areas (winds speeds exceeding 80 mph), which is not applicable to San Luis Obispo. Chapter 30, which regulates elevators, dumbwaiters, escalators and moving walks, is superceeded by Part 7, Title 24, of the California Building Standards Code. Chapter 34 contains minimum standards for life-safety requirements in existing buildings. As a maintenance item, this issue is covered by the Fire Code. B. Section 508 is amended to ensure that automatic fire sprinkler systems 3 required by local amendment to the UBC per Section 904.2.2 can be used as a substitution for fire-resistive construction. C. Section 601.5.8 is added to require fire-resistive construction for alteration of buildings located in the commercial fire zone, except buildings equipped with an automatic fire sprinkler system. D. Section 709.4.1 is amended to include a trade-off for installing an automatic fire sprinkler system in a building by allowing elimination of required parapets at exterior fire-resistive walls. E. Section 904.2.2 is amended to require an automatic fire sprinkler system in all new buildings containing Groups A, E, I, or H occupancies and in new buildings containing other occupancies over 1000 square feet, as well as all new dwelling units. This code provision has been modified from the previous adoption to exempt small commercial buildings from fire sprinklers. Experience has shown that the tremendous cost of the underground portion of a sprinkler system is not proportionate to the overall cost of a small building under 1000 square feet, and therefore represents a reasonable risk in the quest for built-in fire protection. Where significant alterations, additions greater than 1000 square feet in floor area, or occupancy changes occur for existing buildings, this section requires the installation of fire sprinkler systems. Sections 904.2.2 thru 904.2.8 are deleted because they are superceeded by this new Section 904.2.2. F. Section 1005.7 is amended to allow the elimination of fire-resistive corridor construction in all B and M occupancies with an occupant load less than 100 if the building is equipped with a fire sprinkler system. This amendment is a trade-off due to additional fire sprinkler requirements of Section 904.2.2. G. Section 1503 is amended to prohibit wood shingle and shake roof coverings. An exception allows the use of wood shakes or shingles for a new addition to an existing building currently roofed with wood shakes or shingles. H. Section 1804.7 is amended to provide criteria for controlling surface drainage from new development which impacts adjacent property. I-J. Sections 1806.1 and 1806.5 are amended to establish minimum foundation requirements due to the expansive soil in the San Luis Obispo area, and are considered standards in-lieu-of a soils report. AA (o 4 K Section 1806.6 is amended to require that anchor bolts be held in place prior to concrete placement to allow verification of proper location and embedment during inspection. L. A revised Table 184-D requires greater foundation depths due to expansive soil in the San Luis Obispo area, and is considered a standard in- lieu-of a soils report. M. Section 1924 establishes minimum criteria for concrete slab-on-grade construction due to expansive soils in the San Luis Obispo area. The requirements are considered standards in-lieu-of a soils report. N. Section 3206.2 is amended to limit awning construction to flame-retardant coverings except where installed on single family dwellings. O. Section 3405 is amended to reference the UAC, since the administrative sections of the UBC have been deleted. P. Appendix Section 421 is modified to include additional requirements for residential swimming pool construction. Hydrostatic uplift, pool access, pool lighting, and pool abandonment are regulated by amendment. Q-S. Appendix Chapter 31, Division I, establishes standards for flood-resistant construction. Appendix Section 3104.2 is amended to allow the City Engineer to establish additional flood-prone areas. Sections 3106 and 3107.2 are amended to include the local requirement to elevate or floodproof buildings to one foot above base flood elevation, which is consistent with Municipal Code Chapter 17.84 (Flood Damage Prevention Regulations). T. Appendix Section 3304 is amended to include additional items which clearly establish the intent of grading regulations in San Luis Obispo. U. Appendix Section 3305 is amended to clarify application of grading regulations to work within waterways, and to establish jurisdiction of the City Engineer for subdivision grading. V-W. Appendix Section 3306.1 is amended to clarify limitations for grading within a waterway. Section 3306.2 includes minor modifications to exempted work categories. Section 3306.3 is added to allow grading in advance of building permit issuance under certain conditions. Section 3306.4 is added to require City Council authorization for certain types of grading projects; an exception exempts minor stockpile operations. X. Appendix Section 3307 is amended to add a requirement for dust control in conjunction with grading operations and to allow emergency grading. 5 Y. Appendix Section 3308 is amended by adding definitions of "Average Cross Slope" and "Waterway". Z. Appendix Section 3309.3 is modified to reduce the amount of grading to 500 cubic yards or less to qualify as "regular grading". AA. Appendix Section 3309.4 is amended to require additional details on grading plans. AB. Appendix Section 3309.8 is amended to require that "engineered grading" (grading in excess of 500 cubic yards) include plans prepared and signed by a registered engineer or architect. AC. Appendix Section 3309.10 is added to limit the maximum grading allowed in relation to the slope of the lot. Section 3309.11 is added to provide a reference to flood management policies that may affect grading permits. AD. Appendix Sections 3310.2 and 3310.3 and Appendix Tables A-33-A and A- 33-B are deleted because they are superceeded by administrative provisions and fee references in the UAC. AE. Appendix Section 3311 is amended to include guarantees for restoration of a graded site and cost recovery for damage to public right-of-way. AF. Appendix Section 3316.1 is amended to include erosion control for all areas disturbed as a result of grading operations. AG. Appendix Section 3318.3 is added to require verification of graded elevations prior to start of building construction. AH. Appendix Table A-33-A1 is added to establish criteria for implementation of Section 3309.10. SECTION 15.04.050 AMENDMENTS; UNIFORM CODE FOR BUILDING CONSERVATION (UCBQ A. Appendix Chapters 2, 3, and 4 are deleted because they are superceeded by the UBC or disabled access and energy regulations of the California Building Standards Code. B-C. Sections 606.2 and Appendix Section A101 are amended to be consistent with the unreinforced masonry strengthening program originally established by Ordinance No. 1203 (1992 Series), which addresses all buildings of unreinforced masonry construction. D. Appendix Section A109.2 is amended to include masonry infill walls and to 6 recognize use of the State Historical Building Code for strengthening designs. E. Appendix Section A115 is added to include all administrative regulations for the City's unreinforced masonry building mitigation program originally created by Ordinance No. 1203 (1992 Series). SECTION 15.04.060 AMENDMENTS; UNIFORM MECHANICAL CODE (UMC) Sections 103.2 thru 117 of the Uniform Mechanical Code (UMC) are deleted because administrative provisions are found in the UAC. SECTION 15.04.070 AMENDMENTS; UNIFORM PLUMBING CODE (UPC) A. Chapter 1 is deleted because administrative provisions are found in the UAC. B. Section 315.4 is amended by requiring a layer of sand in sewer trenches to ensure a uniform laying bed for pipe and to counteract effects of expansive soil conditions found in the San Luis Obispo area. SECTION 15.04.080 PERMITS REQUIRED FOR WELL CONSTRUCTION This municipal code section establishes permit criteria for new water wells and requirements for capping abandoned wells. There are no changes from the previous adoption. SECTION 15.04.090 AMENDMENTS; NATIONAL ELECTRICAL CODE (NEC) Article 230-70(a) is amended to require that the electric service disconnecting means be accessible at the exterior of building or in an equipment room directly accessible from the exterior and adjacent to an exterior wall. An investigation fee, in addition to the permit fee shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. Reinspection fees may be assessed when the permit card is not properly posted on the work site, the approved plans are not readily available to the inspector, for failure to provide access on the date for which inspection is requested, or for deviating from plans requiring the approval of the building official. My suggestion to do this comes at the end of this letter. How does classifying moved buildings as new construction acts as an obstacle to house moving?There are many ways, but in general, it is obvious that almost any dwelling built prior to the current code cycle will have code deficiencies; in other words, any dwelling more than about 3 years old will not be up to code. If moved, it must be brought up to code. Some examples.of potentially serious problems: •A structural system (that portion of a building which holds it up and resists wind and earthquake) may be perfectly serviceable and safe, but not be to current code specifications. Having to make major structural changes—bringing up to current code standards—can be a death sentence for many buildings. • Materials that, though historic and serviceable, don't conform to current code standards, and must be replaced, often at significant cost. • Having to meet standards upon change of occupancy classification that are radically more stringent than if the building underwent the same change of occupancy but remained on its original site;for example, handicapped access requirements for new buildings are subject to no limitation, regardless of cost of providing them,whereas for existing buildings, the value of access requirements may not exceed 20%of the cost of the base project. Precedents For Relaxing Code Requirements to Promote Public Policies Public policy is often used to override strict model code requirements in the interest of satisfying some competing societal goal. One example I am aware of for moved buildings is an exemption from California Building Code Title 24 energy conservation requirements. The strict energy requirements that apply to new construction would be impossible for most moved buildings to meet. In recognition of that, for energy purposes the state code treats moved buildings as existing construction, which is subject to lesser standards when remodeled. Thus,the building code already contains at least one provision for treating moved buildings as existing construction rather than new construction. Other examples don't apply to moved buildings as such, but illustrate the point of balancing competing goals by providing code exceptions. Examples: •The UBC distinction between additions to existing construction (the additions must be to code,the existing portions not)versus new construction. •Seismic retrofit provisions for existing unreinforced masonry buildings call for strengthening to a level far below that required for new construction. •The lessened standards that apply across the board to historic buildings in California, no matter what the code question at issue.The guideline here is to require only what is reasonable to impose upon such buildings rather than requiring a strict application of the code. So,there is ample precedent for code exceptions to further some important public policy goal. For moved buldings, I would like to see the code take a reasonable approach to public safety, rather than be punitive towards moved buildings. I'll make my proposal in a moment, but first . . . The Economics of House Moving Vs. New Construction In addition to the possibility of obtaining a nice house with, say, hardwood floors and interesting historic interior finishes, a traditional reason for moving a house has been economy. It was a way for a family to get a house for less than it would cost to build one. Absent regulatory obstacles, economy is still possible. Using my current house move project with which you are all familiar,the Stenner residence, I'll share some basic economic information with you to make my point. This is a one-story, relatively simple, 1000 square foot residence. The cost of moving the building is about$7,000. Building a new foundation, reassembling the cut-up building on the foundation, reconnecting plumbing,wiring, etc.that was severed for the move, and reconnecting to utilities brings the total cost of the move to$20,000. We figure that for another$5,000 to$7,000 worth of refurbishing costs,the house will be ship-shape and ready to live in. City building permits are extra, but should'arnount to a few thousands of dollars at most.Thus, a"new"house could be had this way for around$30 per square foot, compared to$75-$90 per square Schmidt to Council, UBC,Page 2 MEETING AGENDAFw CDD DIR RICHARD A. Unfortunately, no action has been taken since then to implement this adopted policy.The regulatory obstacles remain intact. Some elements of the construction codes before you constitute obstacles to moving houses. I wish to call to your attention an important provision of the Uniform Building Code, and request that you address it as part of this code revision cycle. (There are also non-UBC issues that act as obstacles, and I have appended a partial list of those to the end of this letter, also for your attention.) As you are aware, you can adopt your own modifications to the model codes. I request that you do so in order to carry forth the intent of your policy regarding removal of regulatory obstacles to moving houses. Regarding time pressures,the Council could accept my recommendation outright, incorporate it into the revisions, and move ahead immediately. Alternatively, you could request staff analysis at your next meeting for discussion prior to your first adoption.You'd still have plenty of time for the ordinance to go into effect in early January. If time ran short, you could adopt the new codes anytime in December as urgency measures and still meet an early January effective date. The issue deserves attention, and time should not be used as an excuse for pushing it aside. Existing Council Policy— 1994 Housing Element The element's Housing Conservation goal is to "conserve existing housing supply..." Under this are policies: "1.23.1.The City shall discourage the demolition of sound or rehabilitable existing housing." "1.23.3. Since older dwellings can often be relocated and refurbished for considerably less cost than for a comparable new dwelling, and since older dwellings may offer spatial and material amenities unavailable in new dwellings, the City, in the interest of both economy and housing variety,will encourage rehabilitating such dwellings rather than demolition." And an implementing program for policy 1.23.3: "1.23.11.The City will remove regulatory obstacles to the relocation and rehabilitation of dwellings that would otherwise be demolished due to redevelopment of their site This is adopted Council policy. Regulatory Obstacles to House Moving In the Model Form of the Uniform Building Code It is clear that the Council's policy is to protect existin housing, even if that housing must be moved to avoid demolition. Significant UBC obstacles to this policy are in Section 3404,which classifies moved buildings as new construction. Under the UBC, new construction must meet the code's most stringent standards. By contrast, modifications to existing construction do not require the entire existing building to meet current code standards,only those features being added. Therefore,the code discriminates against buildings that are moved.The writers of this Schmidt to Council, UBC,Page 1 foot for new construction. That's a good deal. House-moving isn't for everyone, but it should be a viable option. It is bad public policy to hobble an economical housing alternative available to the creatively adventurous citizen with regulatory obstacles that make `Ns alternative uneconomical or impossible to realize. Houses should be lived in, not crunched and trucked to the landfill! (As I told you several weeks ago, at one point various"regulatory obstacles"tacked onto my project by the city had puffed costs to about$87 per square foot,which made it not only financially infeasible, but economically stupid to pursue.) Finally-- My UBC Proposal I think there is a relatively simple way to remove UBC obstacles to Council house moving policy. It involves a simple exception (the UBC is loaded with"exceptions") in the classification of moved houses, classifying them as existing construction that is being modified rather than"new"construction.The new construction components and systems added—foundation, for example --would be "additions, alterations or repairs"to existing construction, and would need to conform to the letter of the current code.The house itself would be judged by standards that apply to existing construction.This will give both the code official and the citizen seeking to move a house greater flexibility in meeting basic safety issues,while clearing the path of unnecessary obstacles. In specific, I suggest the following:To Section 3404, which states:"Buildings or structures moved into or within the jurisdiction shall comply with the provisions of this code for new buildings or structures,"add an exception: "Exception: Dwellings moved within the City of San Luis Obispo shall be classified as existing buildings. Components newly added,such as foundations or extensions of the existing building,shall be classified as additions,alterations or repairs to existing buildings, In accordance with Section 3403 of this code." Rather than retype Section 3403,which is lengthy, I'd paraphrase it by saying that it requires new features to conform to all code requirements without requiring the existing building to comply with all code requirements.That seems like a fair solution for moved buildings. This UBC amendment will help make the code consistent with the Housing Element. I believe it should go a long way towards eliminating UBC obstacles to conserving existing housing stock by moving houses within the city. In the public's interest, I urge you to adopt this amendment to the UBC. 7hard Schmidt Addendum: Partial listing of other regulatory obstacles to moving houses. 1. Impact Fees for sewer,water,traffic. Is it the Council's intent that these fees should apply to moved dwellings in the same manner as to new subdivisions full of new dwellings? I think a case can be made that they should not, in light of Housing Element policy. Moving housing stock out of the way of development is a good way to conserve housing stock, though not likely to happen so frequently as to drain the city's treasury if impact fees were forgiven for housing relocation. Forgiving fees would act as an incentive for developers to try to move, rather than demolish, housing. (Estimated cost, $11,000 per dwelling). 2. Should water retrofit regulations apply to moved housing? It is hard for the public to understand why an existing dwelling should have to pay for retrofitting off-site bathrooms just the same as new construction.Yet, undercurrent policy, U moved from one site to another, off-site retrofitting is required. (Estimated cost, $2,000 per dwelling.) 3. Should a planning department useep_rmit be required for moving a dwelling?This one baffles me. I'm not able to Schmidt to Council,UBC,Page 3 understand why this is required. Maybe there's some distant history. But today,with all the other permits--building, moving, etc.that must be obtained --this seems superfluous. (Cost$200 to $800 per dwelling). 4. Should moved dwellings be subject to fire sprinkler requirements?The current city code seemingly applies the same standard to both new and moved dwellings,with no apparent exception (if any exterior point of a building is more than 150 feet from the street measured by a path of foot travel, sprinklers are required throughout the building).The proposed revised code is confusing, but it seems to require that even more buildings be sprinklered. Retrofitting sprinklers into an existing building is no minor matter. Frequently (assuming a building is being moved to an already- developed site) retrofitting also requires a new water line to the street(beneath existing development), a larger meter than already services a property, and a new lateral from meter to main,which involves digging up the sidewalk,gutter and street. In such cases,this retrofit requirement can be very costly—far more than the nominal$2 per square foot quoted by the fire department. Is the safety benefit worth a cost which acts as an economic impediment to moving dwellings?Where does the balance lie?
