DISCUSSION During the Council meeting of December 5, 1995, the Council reviewed Section 1.2.1 of the Council Policies and Procedures. Section 1.2.1 outlines procedures for placing items on the Council agenda by individual Council Members. The Council agreed to amend this section by deleting the second sentence of the existing policy and adding language which will allow individual Council Members to agendize matters of special urgency. In providing this direction, Council asked staff to return with a recommended amendment for final adoption which includes a generalized definition of "urgency". Working with the City Attorney, a recommended amendment has been drafted and is offered for final adoption by the City Council. A legislative draft of the amendment is provided as Attachment 1, with the implementing resolution offered as Attachment 2. ATTACHMENT 1. Legislative Draft 2. (1995 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING A MANUAL ENTITLED "COUNCIL POLICIES AND PROCEDURES" WHEREAS, the establishment of procedural rules for the conduct of meetings of the City Council will promote and enhance a more efficient and effective means of conducting the public's business; and WHEREAS, the Council has previously adopted a manual entitled "Council Policies and Procedures" which sets forth such rules; and WHEREAS, the Council's Policies and Procedures were most recently updated in 1993 through the adoption of Resolution No. 8252; and WHEREAS, on December 5, 1995, the City Council ,directed an amendment to those procedures related to Section 1.2.1, "Placing an Item on the Agenda (Council Member)". NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis Obispo that: 1. Section 1.2.1 is hereby amended to read as follows: "Any Council Member may request an item be placed on a future agenda during Communications, and upon consensus of amajority of Council, staff will prepare a staff report if formal Council action is required. An individual Council member may place an urgency item on an agenda ivith a minimum of 72 hours legal notice and a memorandum-from the Council Member to the Council and staff setting fourth the substantive issues of the item. For the purpose of this paragraph, urgency shall arise in those limited situations where an item requires immediate action, and the need to take immediate action came to the attention of the Council Member subsequent to the distribution of the agenda" 2. All other provisions of Resolution No. 8252 shall remain in effect.
