Jonas, Community Development Director 0 Prepared By: Pam Ricci, Associate Planner SUBJECT: Request to amend the zoning map from O -PD (Office, with the Planned Development overlay) to C -R -S (Retail - Commercial, with the Special Consideration overlay), and possible re- consideration of an amendment to the Land Use Element (LUE) map designation from General Retail to Office, for property located at the northeastern corner of Prado Road and Elks Lane at Highway 101 (40 Prado Road). CAO RECOMMENDATION Consider appropriate action, or final passage of Ordinance No. 1316, approving a negative declaration with mitigation measures, and amending the zoning map from O-PD to C -R -S for property located at 40 Prado Road, based on findings. DISCUSSION Situation On December 3, 1996, the City Council adopted Resolution No. 8609, amending the LUE map designation from Office to General Retail, and introduced Ordinance No. 1316, amending the zoning map from Office, with the Planned Development overlay (0-PD) to Retail Commercial with the Special Consideration overlay (C -R -S). The LUE map amendment went into effect on January 2, 1997. Ordinance No. 1316, the rezone ordinance, is now ready for final passage. Significant Impacts The City Council has adopted the initial study of environmental impact ER 7 -95 which concludes that a Mitigated Negative Declaration will be filed for the project. No significant fiscal or environmental impacts are anticipated. ALTERNATIVES Council may choose to not grant final passage to the ordinance amending the zoning designation of the property from O -PD to C -R -S. However, such action would generate an inconsistency with the LUE designation of General Retail for the property, which went into effect on January 2, 1997. To correct that inconsistency, Council should adopt a new resolution reversing their December 3, 1996 action, and amending the LUE designation for the site from General Retail back to Office. GP/R 7 -95 Page 2 Because the Mayor has ;publicly stated that he no longer supports the zone reclassification, staff scheduled a public hearing to amend the LUE designation for the site back to Office in order to provide the Council with the flexibility to act at this meeting should it choose this alternative. Adoption of the Draft Resolution "A" will reverse the General Plan amendment and deny the zone change, based on.findings. Attached: Ordinance No; 1.316 Draft Resolution denying amendment Vicinity Map the rezoning request & reversing the general plan Draft Ordinance "C" ORDINANCE NO. 131((1996 Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE ZONING MAP FROM OFFICE WITH THE PLANNED DEVELOPMENT OVERLAY ZONING (O -PD) TO RETAIL COMMERCIAL WITH THE SPECIAL CONSIDERATION OVERLAY ZONING (C -R-S), FOR PROPERTY LOCATED AT 40 PRADO ROAD (GP /R 7 -95) WHEREAS, The Planning Commission conducted public hearings on November 6, 1996, and November 13, 1996, and recommended denial of amendments to change the designation on the City's Land Use Element map from Office to General Retail, and to change the zoning map from Office with the Planned Development Overlay Zoning (O -PD) to Retail - Commercial with the Special Consideration Overlay Zoning (C -R -S), for property located at 40 Prado Road; and WHEREAS, the City Council conducted a public hearing on, December 3, 1996, and has considered testimony of the applicant, interested parties, the records of the Planning Commission hearings and action, and the evaluation and recommendation of staff; and WHEREAS, the. City Council finds that the proposed general plan amendment and rezoning are consistent with the General Plan and other applicable City ordinances; and WHEREAS, the City Council has considered the draft Mitigative Negative Declaration of environmental impact as prepared by staff and reviewed by the Planning Commission. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Environmental Determination. The City Council finds and determines that the project's Negative Declaration - adequately addresses the potential significant environmental impacts of the proposed general plan map amendment and rezoning, and reflects the independent judgement of the City Council. The Council hereby adopts said Negative Declaration and incorporates the following mitigation measures into the project: 1-3 City Council Ordinance No. 1316 (1996 Series) Page 2 1. In reviewing the subject amendment requests, the Planning Commission and City Council shall determine whether Figure 5 in the LUE needs to be amended to Provide compensating land area for the removal of the subject site from the South Higuera governmental offices pole to accommodate the future space needs of governmental offices. 2. The proposal shall be modified to rezone the site C -R -S. With the "S" overlay zone, the special considerations for the site can be documented in the ordinance approving the proposed zone change. The existing zoning regulations require the processing of an administrative use permit with the development of a site that has the "S" overlay zone. Therefore, the specific improvements needed and any special requirements related to development, beyond strictly environmental mitigation measures, could become conditions of the required use permit approval. 3. Consistent with the recommendations included in the Seismic Safety Element, a detailed soils engineering report needs to be submitted at the time of building permit which considers special grading and construction techniques necessary to address the potential for liquefaction. 4. The project shall utilize porous paving, landscaping, or other design elements to reduce surface water runoff consistent with Land Use Element Policy 6.4.7. 5. The developer shall replace any deficient storm drains crossing Prado Road and /or provide on -site detention facilities to the satisfaction of the Public Works Director. If oversizing of the storm drain is desired by the City, then the City will be responsible for the cost differential for installation of the larger storm drain. With submittal of precise development plans for the project, the developer shall prepare a site drainage analysis evaluating the capacity of existing storm drain to accommodate projected run -off. 6. The finish floor of project buildings shall be raised to a minimum of 136.5' elevation to be consistent with the City's Flood Damage Prevention Regulations. 7. The developer shall install an oil and gas separator at an appropriate location in the storm drainage system to the approval of the Public Works and Utility Directors. The separator must be regularly maintained to ensure efficient pollutant removal. 8. Since the project involves the grading of more than five acres of land, the developer shall obtain a National Pollutant Discharge Elimination System (NPDES) permit from the Central Coast Regional Water Quality Control Board (Cal /EPA). 9. Consistent with Municipal Code Section 15.04.040 X. (Sec. 3307.2), all graded surfaces shall be wetted, protected or contained in such a manner as to prevent dust or spill upon any adjoining property or street. The following measures shall �y y City Council Ordinance No. 1316 (1996 Series) Page 3 constitute the project's dust management plan and shall remain in effect during all phases of project construction: a. Regular wetting of roads and. graded areas (at least twice daily with complete coverage of all active areas); b. Increasing frequency of watering whenever winds exceed 15 mph; C. Cessation of grading activities during periods of winds over 25 mph; d. Direct application of water on material being excavated and/or transported onsite or offsite; e. Watering material stockpiles; f. Periodic washdowns, or mechanical street sweeping, of streets in the vicinity of the construction site; and g. Non - potable water is to be used in all construction and dust control work. 10. The project shall include: bicycle parking and shower and locker facilities for employee use; shared -use parking reduction; on -site food facilities to encourage employees to stay on site during the lunch hour; extensive tree planting in the parking areas to help reduce evaporative emissions from automobiles; - provision of a bus stop and shelter; pedestrian friendly site planning to the approval of the Architectural Review Commission; and roadway changes that minimize the impact on pedestrians and bicyclists. 11. Consistent with the Circulation Element, the applicant shall widen Prado Road across the property's frontage to provide for a four -lane arterial street. The specific design of these street facilities (including the extent of interim and permanent frontage improvements for pedestrians and transit access) shall be T City Council Ordinance No. 1316 (1996 Series) Page 4 established and must be accepted by the City as a prerequisite to the submittal of development plans for the 40 Prado Road property. 12. As a prerequisite of development, the applicants shall execute an agreement with the City, to be recorded against the land, to not oppose the formation of an assessment district or other financing mechanism (to the City's approval) that includes the 40 Prado Road site and is established for the purpose of constructing the Prado Road interchange, related new facilities and modifications to existing facilities. The specific contents of this agreement shall be established to the satisfaction of the City as a prerequisite to the approval of development plans for the 40 Prado Road property. As a further mitigation measure, the applicants shall dedicate slope easements for the future Prado Road overpass and northbound on -ramp to State Route 101 consistent with the standard diamond design identified in the Prado Road Project Study Report (PSR). Easements may provide for interim parking area and landscaping, but shall exclude all permanent buildings. 13. The recommendations of the traffic study which call for the eventual realignment of the City corporation yard driveway with the new street on the eastern edge of the project shall be incorporated into the project approval and design. 14. Project approvals shall incorporate the recommendations of the traffic study regarding the alignment and changes to Elks Lane to insure that adequate emergency access continues to serve the site and the surrounding area 15. As a prerequisite of development of the 40 Prado Road site, the applicant shall design and construct a pedestrian- bicycle bridge crossing San Luis Obispo Creek on the north side of Prado Road. The bridge must be installed and fully accessible to the public at the time that occupancy is granted for the first retail establishment on the 40 Prado Road site. [This project is eligible for a City Traffic Impact Fee (TM credit.] 16. All buildings shall be provided with adequate sound - proofing to meet the City's Noise Element requirements for interior noise levels based on the sound created by departing aircraft. 17. No radio transmissions shall be allowed that would interfere with aircraft operations. 18. The property owner shall grant an avigation easement to the City of San Luis Obispo via an avigation easement document prepared by the City. 19. Future site development shall incorporate: �f tP City Council Ordinance No. 1316 (1996 Series) Page 5 * Skylights to maximize natural day lighting. * Operable windows to maximize natural ventilation. * Energy - efficient lighting systems for both interior and exterior use. In the event operable windows and skylights are not feasible alternatives for tenant operational reasons, buildings should be designed to exceed energy conservation standards in the California Energy Code by 10 %. 20. Site development shall include a solid waste recycling plan for recycling discarded building materials, such as concrete, sheetrock, wood, and metals, from the construction site. The plan must be submitted for approval by the Community Development Director, prior to building permit issuance. 21. Future site development should incorporate facilities for interior and exterior on- site recycling. 22. Parking lot lighting shall be designed to be directed downward and not cast glare onto adjacent properties. The specific design of lighting shall be to the approval of the Architectural Review Commission. The ARC shall carefully review the height and type of lighting fixtures. 23. Qualified archaeologist will be retained to monitor project grading and trenching activities. If excavations encounter significant paleontological resources, archaeological resources or cultural materials, then construction activities which may affect them shall cease until the extent of the resource is determined and appropriate protective measures are approved by the Community Development Director. The Community Development Director shall be notified of the extent and location of discovered materials so that they may be recorded by a qualified archaeologist. 24. If pre- historic Native American artifacts are encountered, a Native American monitor should be called in to work with the archaeologist to document and remove the items. Disposition of artifacts shall comply with state and federal laws. A note concerning this requirement shall be included on the grading and construction plans for the project. 25. If the Community Development Director determines that the above mitigation measures are ineffective or physically infeasible, he may add, delete or modify the mitigation to meet the intent of the original measures. 7 City Council Ordinance No. 1316 (1996 Series) Page 6 SECTION 2. Finding . That this Council, after consideration of the proposed rezoning to change the City's zoning map designation from Office with the Planned Development Overlay Zoning (O-PD) to Retail - Commercial with the Special Consideration Overlay Zoning (C -R -S) for property located at 40 Prado Road, makes the following findings: I.. The proposed C -R -S zoning is consistent with the goals and policies of the General Plan LUE related to General Retail uses given that the site is in the general identified geographical areas for retail expansion, and the requisite economic analysis of downtown was submitted and accepted. 2. The proposed C -R -S zoning is consistent with the goals and policies of the General Plan LUE related to Public and Cultural Facilities Policies since there is enough area in the current government office pole (Social Services Area) to accommodate the long -range growth needs of regional offices of government agencies. 3. The proposed "S" overlay zoning will document the special considerations for the site which are: the need for extensive area -wide circulation improvements, including the planned development of a full freeway interchange at Highway 101 and Prado Road; the 80 -foot wide PG &E power line easement; flood zone issues; and airport land use compatibility concerns. The C -R -S zoning will require the processing of an administrative use permit to establish proposed uses. 4. The proposed development of the site is appropriate and will be compatible with surrounding land uses because site changes to accommodate retail development can be adequately evaluated and regulated with the required processing of an administrative use permit and architectural review. 5. A Mitigative Negative Declaration was prepared by the Community Development Department on October 31, 1996, and adopted by the City Council on December 3, 1996, which describes significant environmental impacts associated with project development. The Mitigative Negative Declaration concludes that the project will not have a significant adverse impact on the environment subject to the mitigation measures listed above from initial study ER 7 -95 being incorporated into the project. SECTION 3. Approval. The request to change the City's zoning map designation from Office with the Planned Development Overlay Zoning (O -PD) to Retail - Commercial with the Special Consideration Overlay Zoning (C -R -S) for property located at 40 Prado Road, is hereby approved. — F City Council Ordinance No. 1316 (1996 Series) Page 7 SECTION 4. Win. 1. The zoning map is hereby amended as shown in Exhibit "A ". 2. The Community Development Director shall cause the change to be reflected in documents which are on display in City Hall and are available for public viewing and use. SECTION 5. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage. The proposed rezoning is inconsistent with the goals and policies of the General Plan, specifically Policy 3.1.3 that requires the submittal of a detailed expansion Plan to evaluate whether proposed development is aesthetically and functionally compatible with existing development in the area. The Council finds that the Project would result in adverse traffic and circulation impacts to the area and be incompatible with surrounding development. SECTION 2. Denial. The request to rezone the property located at 40 Prado Road from Office, with the Planned Development Overlay Zoning (O -PD), to Retail - Commercial, with the Special Consideration Overlay Zoning (C -R-S), is hereby denied. SECTION 3. General Plan Amendment. OFFICEMAX (unable to obtain information on salary ranges) Number of Employees Salary / Waizes Employees Store Mgr./Division Mgr. 6 Associates 30 -35 Total Employees 40 Assuming that OfficeMax is similar to the other two tenants, you can see this project would result in approximately 10 - 15 head of household wage level jobs and several mid -level jobs in addition to hourly jobs at less than $10.00/hour. This total does not include the restaurant because we were not able to obtain those numbers. The addition of these head of household level jobs is a significant contribution to our community especially considering the payroll multiplier effect in other sectors of the local economy. The addition of this project would be similar to many new manufacturing employers who might locate here and employ 120 - 140 people. It is clearly not all "minimum wage clerk jobs" as suggested by some people. Dodie, I hope this will help. I was disappointed to see in Saturday's paper that council member Kathy Smith will not consider approval of the project or my extension request. Let me clear the air: (1) I did not phone Mayor Settle to express my opposition to his initial vote in favor of the Prado rezoning; and (2) I consider Dave Romero a friend and I and supported him during this last election. Nevertheless, I believe Mayor Settle's announced decision to change his vote is correct; I do not find Councilman's Romero's logic in supporting the rezoning to be in the long term best interests of our city. Readers should understand that rezonings in SLO require two public hearings. Some people are of the opinion that first hearings set matters in concrete. Not so. Would it have been better for the Mayor to have said nothing and simply changed his vote at the final hearing? Or was he wiser by announcing in advance that he intended to change his vote? No matter. The game's not over until its over. Back to Romero. Dave is an engineer and numbers and a certain logic are important. Dave lists some good arguments to support his view, primarily the loss of sales tax revenues to neighboring cities because of their wi71mguess to accept big box retailers. But what are the results of doing so? I look at those other cities and I ask myself; is that what I want San Luis Obispo to be? No. San Luis Obispo has already had experience in allowing retail centers outside of downtown and look at the mess we have made of that! Take a critical look at Madonna Plaza and Central Coast Mall What a disconnected mess they are. We don't need another disconnected commercial shopping center even if we were to impose more demanding design standards. Take a critical look at Madonna Road. What a monstrous design! ! We have it because the dollars R Page 2 added up to cheap! What happens when Mr. Madonna comes in wanting a big boxer for his Froom Ranch property on Los Osos Valley Road? Should we say yes and have four separated retail commercial centers? And the Dalidio request? Should a big boxer be ok'ed there as well? I think the two Madonna Road centers should be fixed before we make other messes. If those properties were properly utilized, it is altogether feasible that one or two 'economy boxes' could be integrated and the land used much more efficiently both from a city planning standpoint and, more importantly, from a shopper's standpoint. And, what is wrong with keeping the Prado zoning as it is? Nothing. Office commercial does not mean "government -type offices" as characterized by Romero. Why can4 our new economic coordinator strive to capture office based "industry" that is non- govemmental? This is an excellent location for that type of economic base of which we have essentially none. The property is close to 101 and close to the airport. Office based industry, on the whole, will provide higher salary jobs than will minimum wage - paying commercial retailers. We shouldn't be throwing in the towel so soon. The types of jobs we generate are extremely important to our well being. I disagree strongly with Romero when he .states, "To me, 'scatteration' means SLO shoppers scattering to nearby communities rather than shopping here in compact San Luis Obispo." A future San Luis Obispo with Prado Road, Froom Ranch, Dalidio, Madonna Plaza, Central Coast Plaza and Downtown will not be "compact" in any sense of the word. Such a distribution of retail commercial centers will represent "scatteration" at its worst. Lastly. Dave mentions staff approval and consultant support during this review process, but makes little of the Planning Commission's unanimous disapproval of the project. If we are to always agree with staff and consultants why not do away with the Planning Commission and the citizen impute they represent? For that matter, why not do away with the City Council and let the staff and consultants run the city? I know why. Cities are places of human habitation. And human beings are not always logical or predictable. Cities are places where two plus two doesn't necessarily add up to four. Sometimes less, sometimes more, sometimes a sum beyond belief and it is that unexpected sum that has made San Luis Obispo so special. According to the $65,000 traffic analysis for this rezoning project (prepared by the same firm which the City hired to do the study of the Prado Road overpass), South Higuera will function adequately after the 40 Prado Road project is built. The traffic report reaches this conclusion even after buildout of the Marigold Center project, the Food -4 -Less project, 8 other projects which are currently being considered by the City or County, and growth projections for all other parts of the City out to the year 2010! I have included excerpts from the traffic report for your review. Your article also comments upon the denial of the rezoning being a part of a SLO quality of life decision. The project site is currently approved for an office complex containing 36,000 square feet more floor area and buildings 15 feet taller than the proposed retail tenants. The already approved 121,000 square foot, 50 -foot tall office complex will be far more visible at this location than the. proposed retail uses. The proposed retail building is set back about 500 feet from the highway and is 15 feet shorter than the approved office project. With respect to your comments regarding additional detailed information being required prior to City Council "conceptual approval ", I'm not certain what you mean. The General Plan policies affecting this project were fully reviewed at the time this project was conceptually reviewed by the City Council. In the initial report to the City ;Council, the staff addressed issues such as timing relative to the overpass, conformance with retail policies, etc. The City Council determined that the rezoning application should proceed subject to a traffic study and an economic analysis. Your City Engineering staff agreed with the conclusions of the traffic study. The economic study required by the City was completed and it shows minimal impact upon downtown SLO and positive effects both in terms of revenue to the City and in capturing retail sales which are documented by both the project economic consultant and the UCSB Economic Forecast Project to be leaking out of San Luis Obispo. The economic study did point out some impacts to a few businesses where there is direct product overlap. Your suggestion that these very expensive, detailed studies may need to be prepared speculatively in advance of the applicant having City Council feedback regarding broad brush policy issues doesn't seem to be a reasonable expectation. Detailed studies should be done as a follow -up to "big picture" discussion by the City Counciljust what was done for this project. I believe the planning staff approach to the sequence of consideration for this project was fair and the most reasonable way to proceed. Council members having second thoughts or changing their minds is unfortunate, unnecessarily expensive, and disturbing to applicants and prospective tenants. A different conceptual review process is not the answer to the dilemma of City Council members who have changed their minds. I agree wholeheartedly with your assessment that action to deny this rezoning will send a negative message to other potential businesses. As a resident, business owner, and father who's son will be in the job market in about 7 years, I also feel it sends a very chilling message to potential employers who may look into San Luis Obispo as a business location. What are they to think of the process this project went through? Would you hear this story and be encouraged to try to locate in our community? Sincerely, RRM DESIGN GROUP � V E EXECUTIVE SUMMARY This study was undertaken to evaluate the transportation impacts of a proposed shopping center located on Prado Road adjacent to the Highway 101/Prado Road interchange in the City of San Luis Obispo. The proposed project consists of nearly 80,000 square feet of commercial retail and about 4,000 square feet of restaurant on a 5 acre site. Proposed tenants of the retail development are regional attractors including consumer electronics (i.e. Circuit City, Good Guys, Comp USA), discount office supply (i.e. Office Depot, Office Max) and consumer pet supply (i.e. PetSmart, PetCo) and a fast food restaurant. Conservatively, to reflect a range of possible tenants which may be located on the project site in the future, higher trip generation representative of neighborhood or community shopping centers was used in the analysis. The project is estimated to add a total of about 4,900 daily trips and about 460 p.m. peak hour trips to the surrounding street system. This study evaluates existing and future traffic conditions on three corridors and six intersections in the southeastern quadrant of the City for three planning horizons, 1) existing conditions, 2) opening day conditions (mid 1997), and 3) cumulative conditions (2010). In addition to traffic impacts the study evaluates the following: • Pedestrian, bicycle and transit impacts • Alternative alignments of Elks Lane and project access locations • Ultimate Prado Road widening and improvements (beyond 2010) Key Findings and Impacts IFindings of Off -Site Traffic Impacts The near -term and long -term analyses did not result in any significant off -site roadway or intersection impacts requiring mitigation measures based on the City's adopted service level standards. With the addition of project traffic all of the study facilities will operate at a p.m. peak hour LOS D or better. One exception is the southbound segment of Higuera Street between South and Madonna estimated to operate at LOS F with or without the project. Higuera Street from Madonna Road to South Street in the southbound direction operates at an estimated LOS F using the HCM methodology. Since the HCM method produces unreliable results with very short road segments such as this, it is expected Iwam that the segment will actually operate at a much higher service level (under existing conditions the HCM method produces a LOS E compared to an observed LOS B). With the addition of project traffic the roadway segment service levels are identical to without project conditions regardless of the Elks Lane alignment alternative. Cumulative Conditions Long -term traffic operations, representing conditions in the year 2010, were evaluated for each of the study roadway segments both with and without the Project. But you are not the only custodian, nor should you be. We must all. do our part, and on that subject I would like to make a few points. Growth and change cannot, repeat, cannot be stopped. But What is a reasonable level? But I have a good excuse; I was giving birth to our first child. My parents and grandparents chose to live in San Luis Obispo because of its unique small town character and beautiful surroundings. These are also the reasons my husband and I choose to work and raise our family here, I am grateful that the city council took the long term perspective and decided not to break with the general plan, Mayor Settle showed courage and readership when he changed his vote. Yesterday we took our first outing with the baby, I saw that the hills are green again, and just how blue the sky can be. Thank the Council for considering why most of us love San Luis Obispo and exercising their vote against a scattered pattern of development that would not enhance our quality of life. BY BUILDING THE CIRCUIT CITY HERE IN TOWN, LOCAL RESIDENTS ARE MORE LIKELY TO SHOP LOCALLY -NOT JUST AT CIRCUIT CITY BUT IN OTHER LOCAL BUSINESSES RATHER THAN MAKE THE ARDUOUS DRIVE TO SANTA MARIA. IN FACT, I RECENTLY HAD A CONVERSATION WITH THE MANAGER OF A STORE THAT WOULD BE IN DIRECT COMPETITION WITH CIRCUIT CITY AND HE INDICATED THAT HE WOULD PREFER THAT CIRCUIT CITY BE LOCATED IN SAN LUIS OBISPO. HIS FEELING IS THAT ONCE A CONSUMER MAKES THE LONG DRIVE TO SANTA MARIA, TIED CONSUMER FEELS MORE PRESSURE TO BUY IMMEDIATELY WITHOUT COMPARING PRICES AT LOCAL BUSINESSES. I KNOW FROM MY OWN PERSONAL SHOPPING EXPERIENCES THAT THIS HAPPENS FREQUENTLY.
