CAO RECOMMENDATION Hear and receive all oral and written protest against the proposed annexation; 2. Based on the amount of protest received, act to a) order the boundary change without election, b) order the boundary change subject to confirmation by the voters, or c) deny the boundary change. DISCUSSION Background The Local Agency Formation Commission (LAFCo) adopted a resolution on October 15, 1996, 1) approving Annexation no. 45 (El Capitan) subject to the condition that the City of San Luis Obispo approve a resolution agreeing to the exchange of property tax revenue in concurrence with the resolution adopted by the Board of Supervisors, and 2) declaring the City as the "conducting authority" for subsequent proceedings. The City Council adopted a resolution approving the property tax revenue exchange, in accordance with this resolution, on November 6, 1996. Now the City must conduct. a "protest hearing" to complete the annexation process. Whenever property to be annexed includes property not owned by the annexation applicant, a protest hearing must be held to allow protest by the additional landowners. Project action deadline: There are no State - mandated deadlines for legislative actions, including annexations and prezonings. Site description The site is a trapezoidal essentially flat lot, long and fairly narrow. Eucalyptus trees toward the rear of the site signal the presence of a small creek. A commercial building is presently under construction in the portion of the site nearest Highway 227. Additional trees surround an older house that sits just beyond the commercial site. A dirt road (El Capitan) runs along the southerly property line. The site is flanked by the State Farm Office and residential development to the north, various service -type commercial uses and residences to the south, and railroad right -of -way and residential development to the east. EVALUATION The City Council already recommended annexation to LAFCo. The City Council reviewed the planned development proposal for the site and approved the pre - zoning, paving the way to annexation. With this approval, the owners applied to the Local Agency Formation Commission (LAFCo) and received approval of the annexation. Issues related to the property development inside the city were discussed at these hearings. 2. The other property owners own part of the street. The protest hearing is required because property owners other than the annexation applicant are involved. The other property owners own the southerly half of El Capitan Way and also have access easements over the northerly half. The applicant submitted an annexation request initially that did not include the southerly half of El Capitan, but the City Council and LAFCo both rejected that proposal and required annexation of the full right -of -way area. When a right -of -way is split between two jurisdictions, maintenance and access rights are sometimes difficult to determine over time. The owners of the southerly half of the road will have an opportunity to express objections to or support of the annexation at the hearing. If the annexation is finally approved by the City Council, then the road will be fiilly inside the city limits. However, dedication or condemnation will be necessary for the City to obtain the full street as a dedicated right - of -way. If condemnation is required, the annexation applicant will be required to pay all 3� Council Agenda Report - El Capitan Protest Hearing 850 El Capitan Page 3 costs, including City legal fees. 3. The Council may not change the boundaries approved by LAFCo. If the City Council wants to amend the boundaries of the annexation, it must forward this request to LAFCo for an amendment to the annexation resolution. CONCURRENCES No other departments have concerns with the annexation. FISCAL EWPACT Annexation will result. in additional tax revenues and will also require additional City services. Effects on the City's finances are expected to be minimal. ALTERNATIVES 1. The City Council may approve the boundary change, after receiving oral and written comments at the hearing. This action would finalize the annexation. Recording of the action would then be done by the LAFCo office. 2. The City Council may approve the boundary change subject to a vote by the electorate. This action would delay the annexation and subsequent development of the site. 3. The City Council may deny the boundary change. The annexation would then not take place and the property would remain outside the city limits. Your agency (City, County, or Special District) is the conducting authority responsible for completing subsequent proceedings. Pursuant to Government Code Section 57000 et seq., the conducting authority must take the following actions upon receipt of the Commission's resolution: 1. Adopt a resolution initiating proceedings for the proposal which shall comply with the Commission's resolution and shall 2. Set a date for public hearing on the proposal which shall not be less than 15 days nor more than 60 days after the notice is given. At the public hearing, the conducting authority shall hear and receive all oral and written protest. Based upon the amount of written protest filed and not withdrawn by resident voters or landowners, the conducting authority shall act to either (a) order the boundary change without election, (b) order the boundary change subject to confirmation by the voters, or (c) deny the boundary change. Four certified copies of the ordinance or resolution approving the boundary change. 2. Four conies of the legal description of boundaries approved by LAFCO. 3.
