DISCUSSION The Memorandum of Agreement (MOA) between the City and the San Luis Obispo City Employees' Association ( SLOCEA) expired on December 31, 1996 after a term of thirty months. As provided for in that agreement, the City entered into negotiations with SLOCEA in November of 1996 to develop a successor agreement. The City Council, in closed session, was briefed on November 19, 1996 on the various issues of mutual concern and economic considerations. Bill Avery, the City's chief negotiator, Wendy George, Assistant to the City Administrative Officer, and the Personnel Director them met with the Association's negotiating team led by Paul Bechely, a professional labor relations representative. A tentative agreement has been reached which was ratified by a majority of the Association membership, then subsequently reviewed by Council on January 7, 1997 in closed session. The agreement reflects and strengthens the continued cooperation between the Association and the City to address issues of mutual concern in a productive manner. The agreement is well within the economic guidelines previously discussed with Council. Following is a summary of the significant changes and cost items included in the agreement: Term: 2 years Salary: 1 January 1997 - 3% increase for all employees in the unit 1 January 1998 - 3.5% increase for all employees in the unit Retirement: The City will report to the Public Employees' Retirement System (PEELS) the employees' contribution toward retirement (79/6 of salary) as compensation for the purposes of calculating retirement benefits, which are based upon years of service, age and the final year's compensation. This program, "Employee Paid Member Contribution" or EPMC, carves with it a cost of approximately .7% which shall be paid by the employees upon implementation, on or about 1/1/98. This benefit is cost neutral to the City. Vacation Sell-back: The amount of accrued vacation time an employee may cash in at year end will increase from 30 hours to 40 hours. FISCAL IMPACT The cost of this agreement is approximately $128,700 in year one and $151,600 in year two. Funding is available in the e3dsting fund balances for FY96 -97. Funds will be appropriated in FY97 -98 as part of the upcoming two year financial planning process in accordance with the agreement. (1997 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO CITY EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JANUARY 1, 1997 - DECEMBER 31, 1993 BE IT RESOLVED, that the City Council of the City of San Luis Obispo hereby resolves as follows: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo City Employees' Association (SLOCEA), attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Tim Girvin, San Luis Obispo City Employees' Association, and Ann Slate, Personnel Director.
