CAO RECOMMENDATION
Approve Resolution Holding the State of California Harmless for Hazardous Chemical Clean-Up or
Costs Associated with Such Clean-Up for the Proposed MMTTC Site
DISCUSSION
On June 4, 1996 Council approved the siting of the proposed MMTTC at the Amtrak location, from
the existing parking lot at Railroad Square to High Street. Since then, staff has conducted initial
studies on the subject property, including an environmental site assessment.
The environmental site assessment was performed by Meinfelder, INC. Initially, the consultant
sampled eight locations which were determined to have the highest potential for contamination based
on the history of the property. The testing results uncovered soluble lead in one location near the
northern edge of the property. Subsequently, eight additional samples were then taken around the
problem area. A soluble lead plume was found to exist but was established to be very shallow and
therefore determined to not be a threat to the ground water table.
Staff has been working in conjunction with the County Division of Environmental Health who is acting
as the regulatory agency on this project. They have determined that no remediation will need to be
done on the site with the restriction that the area of the soluble lead plume not be disturbed.
This resolution is one of the requirements we must submit to the state before we can receive any
Transit Capital Improvement (TCI) or Proposition 116 dollars which have been programmed for
the purchase of this property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
HOLDING THE STATE OF CALIFORNIA HARMLESS FOR HAZARDOUS CHEMICAL
CLEAN-UP OR COSTS ASSOCIATED WITH SUCH CLEAN-UP ON ANY OF THE
PROPERTIES TO BE PURCHASED WITH TRANSIT CAPITAL IMPROVEMENT(TCI)
GRANT FUNDS AND PROPOSITION 116 GRANT FUNDS FOR THE CITY OF SAN LUIS
OBISPO MULTMODAL TRANSIT TRANSFER FACILITY
WHEREAS, the City of San Luis Obispo is moving forward with the development of a
Multimodal Transit Transfer Center near the Amtrak Station in San Luis Obispo utilizing Proposition
116 and TCI grant funds, and
WHEREAS, The California Transportation Commission has previously conditionally approved
both the Proposition 116 and TCI grant funds for the purchase of property and construction of the
facility, and
WHEREAS, one of the conditions placed on the grant applications requires the City to hold
the State harmless for any clean-up or cost of clean-up of hazardous chemicals found on properties
purchased with Propositon 116 and TC1 grant funds, and
WHEREAS, the City has worked in conjunction with the County Environmental Health
Department who is acting as the regulatory agency, and
WHEREAS, the City has shown due diligence in the discovery of hazardous waste on the
subject property,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis
Obispo does hereby hold the State of California harmless for hazardous chemical clean-up or cost of
such clean-up.
