This property is currently zoned Service-Commercial in the County. CAO RECOMMENDATION Grant final passage to Ordinance No. 1321, amending the Zoning Map to prezone the Spice Hunter / Sonic Annexation at 181 and 191 Tank Farm Road to C-S-S. The annexation area encompasses 14.44 acres between Tank Farm and Suburban Roads. DISCUSSION Situation On April 1, 1997, the City Council introduced Ordinance No. 1321 to print, approving the requested zoning changes. Ordinance No. 1321 is now ready for final passage. The new zoning designation will become effective upon final approval of annexation of the site by the Local Agency Formation Commission. Significant Impacts The City Council has adopted the initial study of environmental impact (ER 1-97) which concludes that a Mitigated Negative Declaration will be filed for the project. No significant fiscal or environmental impacts are anticipated. Consequences of Not Taking the Recommended Action If the council does not give final passage to the ordinance, the zoning designations of the properties would remain as is, until alternative zoning designations are approved. (1997 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO TO AMEND THE OFFICIAL ZONING MAP TO PREZONE APPROXIMATELY 14.44 ACRES SEVICE-COMMERCIAL WITH SPECIAL CONSIDERATIONS FOR PROPERTY LOCATED AT 181 and 191 TANK FARM ROAD (GP/R/ANNX/ER 1-97) WHEREAS, the Planning Commission conducted a public hearing on March 12, 1997 and recommended prezoning the proposed annexation site Manufacturing (Nn; and WHEREAS, the City Council conducted a public hearing on April 1, 1997 and has considered testimony of interested persons, the records of the Planning Commission hearing and action, and evaluation and recommendations of staff in accordance with Section 65800 et. seq. of the California Government Code; and WHEREAS, the potential environmental impacts of the change have been evaluated in accordance with the California Environmental Quality Act (CEQA) and the City Environmental Guidelines. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The City Council finds and determines that the project's Negative Declaration (ER 1-97) with the recommended mitigation therein adequately addresses the potential significant environmental impacts of the proposed project, and reflects the independent judgment of the City Council. The Council hereby adopts said Negative Declaration. SECTION 2. The City Council makes the following findings: 1. The proposed prezoning will not be detrimental to the health safety and welfare of persons living or working in the area or at the site. 2. Prezoning the site Service-Commercial with Special Considerations (C-3-S) is consistent with the general plan land use designation of Services and Manufacturing. 3. Prezoning the site Service-Commercial with Special Considerations (C-S-S) is consistent with the intended use and location of C-S-zoned properties as described in the zoning regulations. 4. A prezoning of Service-Commercial with Special Considerations (C-S-S) is appropriate at the proposed location and will be compatible with surrounding land uses which are primarily industrial, commrcial, and agricultural in nature. SECTION 3: The Special Considerations designation requires use permit approval for all uses proposed on this site. In determining whether or not to grant approval, the following shall be considered: • Land use compatibility Prezoning for Annexation#47: Spice Hunter Page 2 • Aesthetics • Access • Traffic and circulation • Soil contamination SECTION 4: The annexation area shall be prezoned Service-Commercial with Special Considerations (C-S-S) as shown on the attached map marked Exhibit A and included herein by reference. SECTION 5. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in said city. This ordinance shall go into effect upon the date of final action by the City Council on the annexation.
