CAO RECOMMENDATION
Award a contract to Nick E. Pokrajac, Inc. of Templeton in the amount of$1,067,216.76 (Base Bid
plus Alternates) for "Jennifer Street Bicycle and Pedestrian Bridge,SpecificationNo. 94-03B".
DISCUSSION
On July 16 1996 Council approved the plans and specifications and authorized staff to advertise the
project as soon as an agreement was reached with the Railroad. After spending six months working
with Southern Pacific Railroad to resolve the relocation of their signal wires,the project was
advertised on February 22, 1997. Bids were opened on March 27, 1997 with the low bidder being
Nick Pokrajac, Inc. of Templeton, with a base bid of$1,016,791.80. This is within 10%of the
Engineers Estimate of$925,000. See attached bid summary.
Per recommendations by the Cultural Heritage Committee and the Architectural Review
Commission, the bid documents included bid alternates to provide stairways on each end of the
bridge in addition to the ramps required for disabled and bicycle accessibility. Staff recommends
that a contract be awarded including the alternate stairways. Due to the length of ramps required to
gain access to the bridge (over 400' on Osos Street side and 170' on Jennifer Street side), it would be
more convenient for non-handicapped pedestrians to use the stairs.
During the bid period, Nick Pokrajac submitted a request for change to the specifications to allow a
local steel fabricator and design engineer to design and fabricate the bridge as opposed to a pre-fab
bridge manufacturer such as Continental or Steadfast Bridges. After reviewing his request with the
City's bridge consultant,the City determined that it would not be in our best interest to allow a change
in the specifications.This decision was based primarily on the fact that from the time this project was
conceived it was assumed that it would be an "off-the-shelf" prefabricated bridge. Changing the
specifications would cause delays, increase consultant fees and staff time. Based on this, the request
was denied.
CONCURRENCES
In August 1994 a neighborhood meeting was conducted to gather comments about the project and
preferences for the bridge location. Based on a survey conducted as part of this meeting, a majority
of the participants concurred with staffs recommendation for the bridge location at Jennifer Street as
opposed to Swazey, Henry or Penny Lane.

On December 13, 1994,the City Council supported a staff and Bicycle Committee recommendation
to establish the Bicycle Committee bridge alignment that directly connects Jennifer Street with Osos
Street. Following this Council action, conceptual plans were prepared and reviewed by the Cultural
Heritage Committee on March 27, 1995. The Architectural Review Commission granted final
approval to the conceptual plans on May 15, 1995. Community Development Department has
determined that this project will not cause significant harm to the environment and has filed a
mitigated negative declaration of environmental impact. The California Public Utilities Commission
approved the City's application for this project on June 6, 1996.
The City Attorney's Office concurs with award to the low bidder.
FISCAL IMPACT
This project was approved in the 1993/95 Financial Plan (see pages E-7 and E-19)and the 1995/97
Financial Plan(see page E-8 and Appendix B, pages 91-92).

ALTERNATIVES
1. Construct the project with no stairs on either side of the bridge. Compared to staffs
recommendation, this option would reduce the project's cost by $50,425. This would then be
available,if needed,for additional contingencies.
2. Construct the project with stairs on just the Osos Street side of the bridge. Compared to staff's
recommendation,this option would decrease the project's cost by $17,205 and increase available
construction contingencies to $82,106(7.9%).

AGREEMENT
THIS AGREEMENT,made on this day of_,19_,by and between the City of San Luis Obispo,
San Luis Obispo County,California,hereinafter called the Owner,and Nick E. Pokraiac,Inc, hereinafter called the
Contractor.
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1,SCOPE OF WORK: The Contractor shall perform everything required to be performed,shall provide
and furnish all of the labor,materials,necessary tools,expendable equipment,and all utility and transportation services
required to complete all the work of construction of
Jennifer Street Bicycle And Pedestrian Bridge,Specification Number 94-03B
in strict accordance with the plans and specifications therefor,including any and all Addenda,adopted by the Owner,in
strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor,materials,tools,equipment,and services shall be furnished and said work performed and
completed under the direction and supervision and subject to the approval of the Owner or its authorized
representatives.
ARTICLE II, CONTRACT PRICE: The owner shall pay the Contractor as full consideration for the faithful
performance of this Contract, subject to any additions or deductions as provided in the Contract Documents, the
