SUBJECT: LEASE OF SURPLUS POLICE VEHICLE
CAO RECOMMENDATION:
Adopt z resolution authorizing the City Administrative Officer to execute lease agreement with the City
of Maricopa for the lease of one surplus police vehicle.
DISCUSSION
In September the City received a written request from the Mayor of Maricopa to acquire two of the
City's surplus police vehicles. Subsequently, conversations occurred between the Chiefs of Police of
both cities. Based on these conversations, follow up discussions among City staff reviewed current
policies,past practices,and future precedents which impact this request.
While it was decided that it would not be in the best interests of the City to make a regular practice of
this action, based on the dire need established for the vehicle and in the interest of helping a small
community meet their public safety needs, staff developed a lease agreement for one surplus police
vehicle. The lease will recover most or all of the expected value of the vehicle over a four year period
while indemnifying the City against claims or law suits involving use or operation of the vehicle.
CONCURRENCES
The Finance Director and the City Attorney concur with the recommended action.
FISCAL IMPACT
The lease agreement will recover the $3,000 expected value of the vehicle over a four year period
rather flan recovering the value in an auction this year.
ALTERNATIVES
■ Council could approve the request for two vehicles. Staff is concerned about future precedents this
may set as well as the deferral of the recovery of the cost of another vehicle.
■ Council could deny the request.

Dear Mr. Kapanicas,
This letter is in response to the request of the City of Maricopa to lease a surplus City of San
Luis Obispo police vehicle. We are glad to assist you in meeting your public safety needs and
have tried to structure this agreement to meet your financial abilities while meeting our fiscal
obligations to the citizens of our community.
Based on the discussions between your Chief Biggerstaff and our Chief Gardiner, we would
propose the following lease conditions.
1. The vehicle to be leased will be a 1994 Chevrolet, our unit #9510. This unit has
approximately 87,700 miles and is delivered "as is" with no implied or expressed
warranty. All repairs and maintenance will be the responsibility of the City of Maricopa.
2. The City of Maricopa will pay $600.00 annually for the lease of the vehicle. This sum
shall be paid in advance and will begin when the City of Maricopa takes possession of the
vehicle. This annual payment will remain.in effect as long as the City of Maricopa uses
the vehicle. The annual payment will end when the vehicle is declared unusable by the
City of Maricopa or upon the receipt of the fifth annual payment at which time the vehicle
shall become the property of the City of Maricopa. Should the vehicle be declared
unusable and disposed of prior to receipt of the fifth annual payment, the City of Maricopa
will return any funds received from the sale or salvage of the vehicle to the City of San
Luis Obispo.
3. The City of Maricopa will maintain $3,000 collision insurance on the vehicle and agrees
to indemnify and defend the City of San Luis Obispo in any claim or lawsuit arising out of
the operation or use of the vehicle during the life of this lease.

Upon receipt of this letter, we will make arrangements for your personnel to take custody of
the vehicle.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN LUIS OBISPO APPROVING AGREEMENT WITH
THE CITY OF MARICOPA FOR LEASE OF
ONE SURPLUS POLICE VEHICLE
WHEREAS,the City of Maricopa, California, has requested assistance in obtaining reliable
surplus vehicles for the use of their police department; and
WHEREAS, the start-up costs for the police department have left the City of Maricopa in a
difficult financial position; and
VVHEREAS,the City of San Luis Obispo has a surplus vehicle which is still serviceable and
will meet their needs;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis
Obispo hereby declares that the City Administrative Officer is authorized to execute the attached
agreement marked as Exhibit A.

I AM WRITING TO REQUEST YOUR ASSISTANCE IN A MATTER OF GREAT CONCERN. I AM THE MAYOR OF
MARICOPA,CALIFORNIA,,A SMALL CITY OF APPROXIMATELY I,300 AND LOCATED IN SOUTH WEST KERN
COUNTY AND NEAR THE COUNTY BORDER OF KERN AND SAN LUIS OBISPO.
THIS IS A OLDER TOWN THAT WAS INCORPORATED IN 1911 AND IN RECENT YEARS CONTRACTED WITH A
NEIGHBORING COMMUNITY FOR POLICE SERVICES. APPROXIMATELY TWO YEARS AGO,PROMPTED BY A
RAISING CRIME RATE AND CITIZEN CONCERN,WE ELECTED TO PROVIDE OUR OWN POLICE SERVICES. WE
HAVE RECEIVED SEVERAL FEDERAL GRANTS THAT HAVE ASSISTED US WITH THE PERSONNEL COSTS,
HOWEVER THE START UP COSTS HAVE LEFT US FINANCIALLY STRAPPED.
WE STARTED WITH TWO OLDER MODEL POLICE CARS,THAT NOW HAVE 135,000 AND 95,000 MILES
RESPECTIVELY AND THEIR CONDITION HAS DETERIORATED TO THE POINT OF NOW BEING UNRELIABLE FOR
OUR OFFICERS TO DRIVE.
OUR CHIEF OF POLICE,GARY BIGGERSTAFF,HAS HAD CONVERSATIONS WITH YOUR CHIEF JAMES GARDNER,
REGARDING THE POSSIBILITY OF OBTAINING TWO OF YOUR CITIES USED POLICE CARS THAT ARE SCHEDULED
TO BE DECLARED SURPLUS CI1Y PROPERTY. I AM TOLD THAT THE USED POLICE CARS HAVE BEEN WELL
MAINTAINED AND ARE STILI,SERVICEABLE FOR AN AGENCY SUCH AS OURS.
UNFORTUNATELY,MARICOPA HAS NO AVAILABLE FUNDS THAT COULD BE USED TO PURCHASE THESE
VEMCLES,SO I WOULD ASK THAT YOU CONSIDER DONATING TWO CARS OR TRADING FOR OUR TWO OLDER
MODEL UNITS WHICH COULD BE SOLD OFF FOR SOME COST RECOVERY.
BEING BORN,RAISED,EDUCATED(CAL POLY GRADUATE IN THE CITY OF SAN LUIS OBISPO),I CAN TRULY
