SUBJECT: INTERIM HAZARDOUS WASTE GENERATOR INSPECTION
FEES
CAO RECOMMENDATION
Adopt a resolution setting interim fees for hazardous waste generator inspections.
DISCUSSION
Background
Senate Bill (SB) 1082 (Calderon Bill) of 1993 (Health and Safety Code chapter 6.11)required
the Secretary of the California Environmental Protection agency (Cal/EPA) to develop and
implement a unified hazardous waste and hazardous materials management regulation program.
The program, known as the Unified Program,was to be managed by a Certified Unified Program
Agency(CUPA). The program was to establish a single hazardous waste permit fee for each
facility or business handling and/or storing hazardous materials by consolidating, coordinating
and making consistent the following six programs:
* Hazardous Waste (generator and treatment program)
* Aboveground Storage Tanks (AST) (spill prevention and countermeasure plan)
*Underground Storage Tanks (UST)
* Hazardous Materials Release Response plans and Inventory
* Risk Management and Prevention(acutely hazardous materials) -
* Uniform Fire Code(UFC) (Hazardous materials response plans/inventories) -
On October 22, 1996, City Council conceptually approved consent allowing the County to
become the CUPA with the City to act as a Participating Agency(PA). As a PA,the City would
be responsible for performing all six program elements of the Unified Program within the city
limits, while the County performs outside those limits. On December 3, 1996 the Council
approved an agreement with the County for the implementation of the element requirements.
Waste Generator Fees
As it is currently structured, the Fire Department administers the Unified Program and the
Utilities Department(Pretreatment Section) provides all the required field/site inspections. The
City has established and collects hazardous materials fees for all the above referenced programs,

with the exceptions of Hazardous Waste Generators and the State surcharge fees established as part
of SB 1082. To date,the County Environmental Department has performed all the Waste
Generator inspections(127 generator sites)within the City and has established and charges fees
annually relating to this program. As part of the PA Program,the City will now be assuming this
responsibility and must establish an appropriate fee.
It is recommended that Council adopt the County's current waste generator fee structure for this
program until such time as a required Cost For Services Study can be performed and a single fee
billing system can be implemented with the County. As summarized below,it may take up to
eighteen months in cooperation with the County to establish a single fee and billing system for all
the Program Elements. By maintaining the County's present fee structure,there would be no
immediate change for waste generating City businesses which fall within the regulations of the
current Unified Program.

CONCURRENCES
The Director of Finance, Fire and Utilities Departments concur with this recommendation.
FISCAL IMPACT
Since 1989, the County of San Luis Obispo(Environmental Health Department)has carried out the
inspection and enforcement program for the waste generators within our City. The City will now
be assuming this responsibility. Adopting this resolution would result in an increase of hazardous
materials program revenues by approximately$11,000. These revenues will help offset staff costs
anticipated with start-up, implementation and administration of the new Unified Program.
ALTERNATIVES
• No charge for the program and absorb these costs in the General Fund.
0 Establish anew fee structure for cost recovery before performing a joint cost of services study.

RESOLUTION NO. (1998 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
SETTING INTERIM FEES FOR
HAZARDOUS WASTE GENERATOR INSPECTIONS
WHEREAS, on December 5, 1996,the City entered into an agreement with the
County of San Luis Obispo for the purpose of implementing the elements of a unified
hazardous waste and materials management regulation program, and
WHEREAS, the City currently charges fees for all the elements of this program
except hazardous waste generator inspections, which are currently set and charged by the
County; and
WHEREAS, the goal of the program is to establish one permit/fee; and
WHEREAS, it is the City's goal to perform a comprehensive cost of services
study, in cooperation with the County, in order to establish a unified rate structure that
fully recovers in the future the cost of providing these services; and
WHEREAS, in the interim, it is necessary to set fees for this service.
NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo that it adopt the County's fees for these services as provided in Exhibit A(Waste
Generators) into the City's current fee schedule; however,the city's fees in the future will

change as the County's fees change,until such time as a comprefiensive cost of service
study is completed.
