Per our conversation, Building Inspector Mark Ellery did a

Staff has also reviewed the plans submitted under application
' #20414 , to correct the occupancy concerns.
It has been determined that the area marked "den" on the
application may not be occupied for sleeping, as well as the
' bedroom that was not open to inspection.

Dear Rob:
tIn response to your letter of May 6, 1992, I would like to offer the following information.
t When I moved in to my house at 1677 McCollum Street in 1986, I immediately rented out the
bedroom which was on the lower(garage) level of the house and began to work on an adjoining
part of the garage as a family recreation room. I did this without permits because I was short
' of money and impatient to get the extra room done. After it was completed, I regretted not
getting permits for the work and began looking in to having it "legalized."
I had plans for a garage drawn by a licensed contractor who checked out the work that had
' already been done and said it appeared to him that it had all been done to code and that there
shouldn't be any problem in having it approved. I submitted the plans and permit application
in 1987 which were returned to me for modifications. By that time I had gotten a few estimates
t on the construction and realized it was way out of my budget, so I shelved the project until I
could better afford it.
Over the years I have continued to make improvements on the lower level, always intending
' to eventually build a garage to make it all legal. However, the cost of the garage would be
about$25,000 according to the plans I had drawn,and it has not been feasible for me to borrow
that kind of money. I work as a secretary at Cal Poly and am the sole support of two teenagers.
' To supplement my income I have continued to rent out the lower rooms to Cal Poly students.
Because we are so close to Cal Poly, those rooms are in great demand and I have been very
selective about choosing tenants. My boarders have all been very mature and well behaved and
' have been a positive addition to our family and to the neighborhood. None of them has every
caused any kind of problem for me or the neighborhood..
I recently decided to finish off the remaining 8' x 10' space in the garage to use as an
' office/storage area by having drywall put up and a window installed. The drywall was up and
the window framed in from the inside when the "stop work notice".was posted. When Mark,
the inspector, came to the house to talk with me and Marc Burns, my contractor, about it, he
t told us we would have to obtain permits for the entire project including building a garage or
carport and in the meantime we had to stop construction. When we told him we were almost
through with the window, he said the only way we could finish it would be to obtain an over-
the-counter permit for a window installation and he assured us there would be no problem in
doing so. Marc left immediately to run some errands and to get the permit. While he was gone,
his workers continued working on the window, thinking there would be no problem in getting
the permit. When Marc returned, he told us the permit had been denied. Since then, Marc nor
t anyone else has done any work on the house, with the exception of loosely laying a piece of
carpet on top of the concrete floor.
Eric Schmidt,a Cal Poly architecture student,is currently working on plans for the lower level
' and a carport. We intend to comply with whatever modifications the City requires to bring the
lower level up to code. My mother has agreed to loan me the money for the carport so
financing is not a problem. Dennis Lerda,a licensed contractor, will begin construction on the
' carport immediately upon the permits being approved, and he expects the project to take one
to two weeks. If everything goes well and the permit process doesn't take too long, we should
have everything done and be back in the good graces of the City of San Luis Obispo by the end
' of June.
I realize the pressure the City is under to preserve family neighborhoods and I fully support
those efforts as I was forced to move from my previous home in a residential neighborhood
t because the student rental next door to us was making our lives unbearable.I would never have
any part in creating that kind of environment for my neighbors, not to mention that I couldn't
live with it myself. Even though I've had boarders in what the City would consider an "illegal
' structure," our home and its occupants have never posed any kind of inconvenience or
disturbance to our neighbors. In fact, my neighbors on both sides have been well aware that
I have student boarders living in our garage conversion, and both assure me that they have no
complaints whatsoever.
' As to the Notice to Cease Occupancy, we currently have two Cal Poly student boarders living
in the downstairs area - one in the room that was existing when I bought the house, and the
' other in the larger room which I had finished six years ago. Both students have been with us
since the beginning of Fall Quarter, and it would be an extreme hardship for them to have to
move at this point in the quarter. Both rooms have been inhabited for many years and all
' improvements have been done to code,with very minor exceptions which will be corrected soon.
Since I have people working diligently and quickly to comply with City requirements, I am
requesting that our boarders be allowed to stay through the end of the quarter (June 15), at
' which time they had planned to move out anyway. And by that time, the construction should
be almost finished. Please call me at work at 756-2234 to let me know how you feel about this.
I am doing my best to comply with City requirements and to bring this unfortunate matter to
' a positive conclusion. Thank you for your consideration.

' On May 5, 1992, Community Development Department staff inspected
property you own at 1677 McCollum. Staff noted that a garage had

' Please be aware that the situation described above does not meet
zoning ordinance regulations, and appears to violate San Luis
Obispo Municipal Code Section(s) U.H.C. 301 altered structure,
' U.H.C. 1001 (N) improper occupancy, M.C. 17. 16. 060 required
parking.
We request that you take action to comply with these ordinance
' requirement(s) by ceasing to occupy those areas altered without
permit and obtain a demolition permit to remove the conversion.
' Your property will be reinspected on or about May 26, 1992, to
determine if further enforcement action is necessary.

The Wildflower Hostel has three sleeping rooms with eight beds and a
' kitchenette. A large tree-shaded backyard provides a comfortable resting place for
weary travelers. On the covered patio are a ping pong table, barbecue, and picnic
table for hostelers' use. Basketball and tennis courts are a short walk away.

3. A manager must be on-site at all times the hostel is open, to supervise the guests and
' enforce the rules.
4. Secure parking for at least six bicycles shall be provided.
' 5. This approval allows a maximum occupancy of 20. Any increase in occupancy levels will
require approval of a new use permit.
' 6. At any time the Planning Commission may review the use permit if written complaints
from citizens or the Police Department are received by the Community Development
Department. At such review hearing, the Planning Commission may add, delete or
' modify conditions of approval or may revolve the use permit.
' 7. The site must be cleared of construction materials and debris prior to occupancy of the
moved building.

BACKGROUND '

On May 11, 1994, the Planning Commission approved a use permit to allow operation of a hostel '
at this address. The hostel opened for business on May 23, 1994. The hostel was approved as
a two-phase plan: phase 1 to contain eight beds, and phase 2 to increase to 16 beds. An '
increase to 16 beds would require certain additional code requirements be met, including

' Dear Council Members and Planning Commission:
' It has come to our attention the possibility of a hostel being directed for our neighborhood. We
would like the city to reconsider this move for the following reasons.
' Due to the influx of transients already in the railroad area, an addition of an overnight stay
compounds this already existing problem merely by the attraction of low-end overnighters, or
let's say, slumberers. The neighborhoods and existing businesses have slowly been dressing
t themselves up over the years. A hostel would be out of scale in what is becoming a rather
fashionable part of town to live in.
' The idea of a hostel is romantic and the proximity near the train station makes it seem
convenient; however, this is not Europe, nor does our unique landscape resemble it. In Europe,
' train travel is economical, where in the U.S., it is not as common, yet expensive.
