Jonas Development Director IfPrepared By: Glen Matteson, Associate Planner SUBJECT: Proposed amendments of the General Plan Land Use Element map and text to reflect the City's recent open space acquisition on San Luis Mountain, west of the Highway 101-Marsh Street interchange(Main family property). CAO RECOMMENDATION Adopt a resolution to (1) change the Land Use Element map designation from Interim Open Space to Open Space, and move the urban reserve line and the special design area boundary at the Maino open space acquisition and (2) delete the Land Use Element text references to the Maino property in the sections on Hillside Planning and Optional Use& Special Design Areas. DISCUSSION Situation The City has acquired the Maino family property on the southeastern flank of San Luis Mountain, as part of its open space greenbelt. The Land Use Element shows the southeastern comer of the property as having some development potential. The recommended amendment would make the Land Use Element consistent with the acquisition and the open space easement recorded for the property,by eliminating the land-use designation for development. As a consequence of City ownership, there is no need for the Specific Plan overlay zone which has been applied to this property. In a few months, staff will bring to Council a clean-up zone change for the area already in the city, an annexation of the open space outside the city, and zoning for the open space annexation. Data Summary Applicant: City of San Luis Obispo Existing Zoning: Conservation/Open Space with 20-acre minimum and Specific Plan required (C/OS-20-SP) Environmental Status: Categorically exempt under CEQA Guidelines sections 15307 (actions to . protect the environment)and 15325 (acquisition of open space). Project Action Deadline: This legislative action is not subject to processing deadlines under State law. Evaluation In this area, the boundary between land with development potential and land to be permanently protected as open space was set during the hillside planning program of the early 1980's, based on ground elevation and slope. The boundary was retained during the 1994 Land Use Element 9-/ t . e Council Agenda Report-Maino open space LUE amendment Page 2 update. That update established more specific guidance on the type of development that could occur. A relatively small part of the Maino family property was eligible for carefully located residential,office, or visitor-serving uses. The City has acquired the Maino family property, which is subject to a perpetual open space easement. The City intends to keep the site as open space. The current land use designation and location of the urban reserve line and special design area boundary, and the text, indicate development potential. The Open Space Element maps are sufficiently general that they need not be amended for consistency. No change is proposed for land adjacent to the Maino property to the west and south, and the area occupied by construction equipment (Madonna property). This area would continue to be eligible for development with low-intensity tourist facilities. ALTERNATIVES 1. Not approve the recommended amendment. This action would perpetuate the inconsistency between the General Plan and the restricted use potential of the property. 2. Continue consideration,with direction to staff. (1998 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE GENERAL PLAN LAND USE ELEMENT CONCERNING THE MAINO FAMILY OPEN SPACE (GP 136-97) WHEREAS, the City Council conducted a public hearing on March 17, 1998, and has considered testimony of interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff-, and WHEREAS, the project is categorically exempt under CEAQ Guidelines sections 15307 (actions to protect the environment) and 15325 (acquisition of open space). BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Finding. The proposed changes are consistent with the rest of the General Plan. SECTION 1. General Plan Amendment. The Land Use Element map and text are amended as shown in the attached Exhibit A and Exhibit B. SECTION 3. Document Revision. The Community Development Director shall cause the amendment to be reflected in documents which are available for reference in City Hall and which are available to the public. SECTION 4. Effective Date. This amendment shall take affect at the expiration of 30 days following approval. Land Use Element: Resource Protection - Hillside Policies (6.2.6.K)and Optional Use& Special Design Areas (8.9) The Maine Madonna area includes land west of Highway 101 on the lower slopes of San Luis Mountain and the northeast slopes of the foothill bordering Laguna Lake Park. (1) A specific plan or development plan for the whole area should be adopted before any part of it is annexed, subdivided, or further developed.
