Boz 5141 San Luis Obispo, CA 93401 L MEET IN AGENDA DATE ITEM # February 22, 1998 Fu�� _ _ �G D DRI Pam Ricci La YAV O FIN DIR Planning Department O PW DIR CHIEF City of San Luis Obispo G POLICE CHF 990 Palm Street D RW DIR San Luis Obispo,CA 93401 D 9M OR ED PERE DIR Dear Pam, I would like to take this opportunity to thank you for the effort you have expended in preparing the staff report on the Use Permit application for Lambda Chi Alpha Fraternity at 1292 Foothill Blvd. There have been many interesting events that have unfolded in this process,which as I'm sure you are aware led to the Planning Commission denial of the application and our subsequent appeal to the City Council,now scheduled for March 17, 1998. This letter will constitute an expansion on our reasons for the appeal. One justification that was used in the denial was that the proposed site is too small and inappropriately situated because of the surrounding uses. I would hasten to point out that Lambda Chi Alpha has an eighteen year operating history on a site half the size of the 1292 Foothill property,and in a neighborhood far less densely populated with students than the proposed. As was pointed out in the staff report,the proposed use meets zoning standards as they have been developed and applied to fraternities,and is surrounded by similar uses. In denying the Use Permit,several of the Planning Commission members mentioned a need to study Fraternities and there impact. This has been the object of my personal efforts and observations over the past 19 years,both as a stadeM and later as a working person. Please allow me to play prophet for a moment and forecast the results of such as study: Cal Poly is growing,a lot. The State has mandated that thousands of students will be added to the enrollments over the next few years. Given the State's propensity for un-funded mandates,there will be very little additional on campus housing available for these thousands of young students. Also,the State will continue to refuse to allow any Cal Poly land to be used for private group housing purposes,due to a myriad of concerns. So these additional students will impact an already tight housing market further,many of them wanting to live in the Alta Vista neighborhood close to campus. That's good news in the long inn for property values,given increased demand,but bad news for the long time residents of the neighborhood who have watched the area steadily become more densely.populated Marry of the long time residents will continue to object to the intensification right up to the point that they can't stand it any more and sell their properties at tremendously inflated prices. Students,being human beings fast,will continue to have a desire to socialize with those of like mind,so fraternities and other social organizations will continue just as they have done for centuries. As it has been in the past,there will be some organizations that function well as neigbbors and community members,as Lambda Chi Alpha has done. Then there will be others that never seem to get the picture,and become an embarrassment to themselves and a blight in their neighborhood The City and the University will need to develop an effective means of eliminating these problem groups while encouraging and recognizing the good ones. It will continue to be most appropriate to locate as many fraternities and sororities as possible in close proximity to the University,just as the General Plan now specifies. The prospect of annexing or setting aside land for a fraternity and sorority row will remain a distant one,since it is a larger project than the organization themselves can afford to undertake,and neither the City nor the University has the available resources to bring such a project about. Seems like a difficult situation,doesn't it? A final issue to be discussed is the building department requirement that we install fire sprinklers in the building,even though we have expressly stated that we plan to remove the current structures within a few year;and build a modem small apartment building Having been given justifications varying from the UBC codes to"resource deficiencies"(i.e.lack of water flow to the area),there is still this puzzling fact: the Use Permit that the Youth Hostel has allows up to 20 persons in residence and does not require fire sprinklers. The proposal for the fraternity is for 13 residents,but would require fire sprinklers? This doesn't make sense. My proposal still stands that if Lambda Chi Alpha has not initiated construction of a new building on site within five years,we will go to the expense of sprinkling the current structures to insure the long-term safety of our members. Any thing else would be wasteful- That astefulThat brings us right back to the proposal at hand Having essentially been left to our own devices,Lambda Chi Alpha and Elame Simer have come up with a proposal that makes sense in trading properties as proposed The bottom line is this:Elaine Simer is going to sell her Youth Hostel property and relocate her business to a location she feels is more appropriate. Someone is going to buy the 1192 Foothill Blvd property and fill it with renters,maybe even another fraternity that doesn't want to subject itself to the process we have gone through. Lambda Chi Alpha will continue to exist,and will continue to do everything possible to be a good neighbor,as many have testified to our ability to do. The question is really whether it is better for us to operate in our current location at 1617 Santa Rosa,or to move to a location near Cal Poly such as 1292 Foothill Blvd Obviously,we feel the latter is a far better choice and we are willing to sustain a substantial cost to do that. This proposed trade involves two established organizations with good operating records. These facts alone bode well for the long-term success of the proposal. This- was a prime oppur- tunity to place each organization in an area more conducive to their organization; SLO Coast Hostel/train station, LCA/Cal Poly. The hostel was approved, but Lambda Chi Alpha' s application was denied. This denial was based on complaints from the neighbors of the proposed LCA site, 1292 Foothill Blvd. The complaints consisted of noise, traffic, parking problems and the organi- zational aspect of LCA. Considering the proximity of the pro- posed site to Cal Poly; one very short block. This is a case of the fly on the elephant . Cal Poly is a large generator of noise, traffic and parking problems. Plus, Cal Poly is all about organization: students, falculty, classes, sporting events:,. :eon- certs, open house. After growing up in San Luis Obispo and attending Cuesta College, and Cal Poly, I have become fairly familiar with fraternities and "frat boys". Plus for 20 years I have live one block from a fraternity(Leff & Osos) and three blocks from another(Upham & Chorro) . Also, LCA has been directly next door to my families house for 18 years. Lambda Chi Alpha is a decent enough organi- Xation and should have their application approved, But I also understand the complaints of the aforementioned neighbors. That is why I am offering the following, as possible attachments to LCA's use permit. These suggestiongs are not based on any one incident with LCA. They are more so on my knowledge of frater- nities; and for that matter, college students. However, after attending the Planning Commission meeting, after reading all the material supplied for both appeals to the City Council , and drawing on my family's 18 years of sharing a backyard fence with the fraternity, I wish to vigorously support this exchange and urge the Council to vote accordingly. Please., please stay focused on the land use issues involved. Unfortunately, the Planning Commission allowed the audience and themselves to range far afield from such issues, even to the point of allowing overlong presentations that were borderline libelous attacks on the hostel owner, Ms . Simer. Overlong ravings about bad fraternity behaviour in general were also allowed, and seemed politically self- serving and unrelated to the land use issues which apply to the suggested exchange. Frankly, as a citizen and voter, I was appalled at the whole process, and expected better conduct from neighbors and city officials. Now, I find a great deal of written material in the hostel appeal which casts more aspersions on Ms. Simer's character, and on the hostel business, in general . For many years, the fraternity has known they were located in a totally inappropriate neighborhood setting. They originally moved into 1617 Sana Rosa without getting a Use Permit. They have made at least three previous. attempts to move nearer campus and nearer other student housing. This present plan is by far the best one,fitting into City guidelines as it does. Details of the previous attempts to move are really irrelevant, just as details of Ms. Simer's previous hostel locations and permit problems are also irrelevant. Both entities are now obviously conforming to code and permit procedures , and you can be sure of conformity in the future. Whatever lessons have been learned from past experiences and from the present situation are the only ones the Council should be considering in this appeal process. Some other points I would mention as to why I would prefer a hostel rather than a fraternity adjacent to my property: . the hostel rules for no alcohol , drugs or tobacco at any time; the enforced quiet times at night for guests; the lack of activity during the daytime; the national affiliation with a regulating organization that sets good standards for their member hostels. Hostel tourist traffic would occur heavily during the summer months when students are away, and when there is not a major parking problem in the neighborhood. The summer months are when fraternity standards are more lax, as to noise, conduct, and upkeep of the property. This would not be true of a year-round business. The fraternity has done its homework well in locating an appropriate site on Foothill, but according to Planning Commission testimony, they shouldn't be in anybody's backyard, particularly in the Alta Vista neighborhood, and seemingly not in Cal Poly's backyard. So just where ili the heck are fraternities supposed to be? Go ahead and study the issue, but this group should not be penalized in the meantime. p2 RE: PROPOSED FRATERNITY/HOSTEL PROPERTY EXCHANGE — Appeals, 3/17/98 Should this exchange plan fall through, the fraternity will keep trying to move, you can be sure. I am very familiar with the interior of their building, having inspected it along with my contractor last spring for possible purchase and conversion to apartments. It would have been exorbitantly costly to do this, and of course, could only have happened if an approved location was found for the fraternity to move to. The point is, the building is not suited for usage other than for group housing, such as another fraternity, a halfway or Transitions house of some kind, for unrelated, unregulated student housi.ng, , or for this unique use as a hostel . For my money, the hostel is by far the most desirable future option for this property. And not just any hostel , but this one with rules and regulations to avoid a "party" atmosphere. With all of the city and police provisions in place for proper oversight, (plus vigilant neighbors as myself) I sincerely believe the hostel will add positive value to our no longer throwaway, unique and eclectic neighborhood. This -has been my home for 22 years , and I am looking forward to it continuing as my long term retirement home. It has come to my attention that there is opposition to this exchange due to unfounded fears of some of the residents near Santa Rosa Street. Having lived in this neighborhood for several years, I would like to assure all members of the City Council that the majority of residents welcome the idea of having the SLO Coast Hostel join our neighborhood. I am lucky in that I have been exposed to hostels and the giving, sharing, and educational environment that they promote. I have always found that the visitors to hostels represent the ideal type of tourist; well- mannered, caring, and eager to learn. I feel the fears that the Gartner's have must be due to their inexperience and lack of education in the matter. I would like to urge the members of the City Council to accommodate the exchange in any manner possible. I would hate to think that the hostellers would think that all residents of San Luis Obispo are as closed minded as the Gartners. This is an important opportunity for the residents of San Luis Obispo to express their openness towards the profit generating tourism industry that has just begun to flourish in our beautiful community. A high school classmate from the East who frequents hostels stayed there while in town, and reported it to be the cleanest, best-managed hostel she's encountered! In moving to a downtown location, Elaine believes she has found a way to serve the community even better, and she deserves a chance to try this new incarnation of her hostel. The decision for you is one of proper land use and neighborly compatibility. The land use for the Santa Rosa site is right. As for neighborly relations, the hostel will be a huge improvement over the fraternity. I have been hearing horror stories about the fraternity's neighbor compatibility problems for more than a dozen years from a close friend whose house abuts the property. The petty campaign of character assassination contained in the appeal is irrelevant, and speaks more about the character of the appellant than the issues involved. We have lived at 1633 Santa Rosa, San Luis Obispo for ten years, and there is one house between our home and 1617 Santa Rosa. Through our kitchen window,we can see the kitchen and recreation room of 1617 Santa Rosa and the offstreet parking spaces. Our neighborhood is densely populated with families, individuals and students living in houses and apartments (many homes in the area include residences behind homes), a number of businesses several fraternities and the Amtrack train station. Locating the Hostel in our neighborhood would not only be positive for our neighborhood but would be consistent with the character of the neighborhood. Many of the people who stay at the SLO Coast Hostel are the same tourists we see shopping in the downtown region, eating in local restaurants and sightseeing throughout the county. Tourism is an industry that has a positive impact on our local economy and we should welcome tourists, whether they stay in hotels,motels,bed and breakfast inns or hostels. Since people who stay in a hostel are more likely to use alternative transportation--walking, bike riding,trains--locating the Hostel close to the Amtrak station and near the downtown core seems logical. In every downtown SLO neighborhood parking is a premium, and we realize that parking may occasionally be difficult with the Hostel. (Our home has one offstreet parking site, and our household has two cars.) Even if there were ten cars associated with guests of the hostel,the use of the off street parking spaces would reduce the impact that ten cars might have on our street. In closing,we hope you will not only support the Hostel's Use Permit for 1617 Santa Rosa but will also support the Lambda Chi Alpha's Use Permit for 1292 Foothill Blvd., allowing for the swap of property and relocation of both the SLO Coast Hostel and the Lambda Chi Alpha Fraternity. Although most of the information contained in the appeal is not relevant to the case at hand, it does cast me in an unfavorable light, and I would appreciate it if you would read my responses to his allegations in order to gain a more balanced view of the situation. The Gartners' opposition to the hostel is based on unfounded fear and prejudice. Their appeal states that: (1) The hostel will decrease security in the neighborhood. Mr. Gartner has stated that local residents "would be intimidated about venturing out after dark." Response: Our hostel guests are typically well-educated, financially. se:;ure travelers who are on extended trips of one month to a year. For example, last week (March 8) we had an architect from Switzerland, a dairy farmer from Australia, a travel agent from Brazil, two German Air Force pilots, and a 60- year-old music teacher from Santa Barbara. These are not the kinds of people who would stay in a hostel if the environment were as the Gartners describe. By talking about our hostel guests as if they were low lifes in search of a flop house, the Gartners are attempting to spread hate and fear in the neighborhood. In my four years of operating the hostel on Foothill, we have not received a single complaint from neighbors or police about the conduct of our guests, either on or off our premises. (2) Parking problems in the area will be exacerbated. Mr. Gartner has mistakenly said "There is a very good possibility that guests will all arrive in separate vehicles." Response: There is virtually no street parking available on Foothill, yet our 6-space parking lot has been adequate. Many of our guests arrive by public transportation. Those who do travel in cars tend to travel in groups. At the Santa Rosa location, we would have 7 parking spaces, one P_ffe_1.8�moreln:E03 have now on Foothill. 5ORNEY• L.A04LERKIORIG LICE CHF❑ C DDRIL DIRpRS OIA The transportation modes of our guests on a typica, busy summer night would look like this: 3 people arriving by US Bus` 3 people arriving by Greyhound 2 people arriving by train 1 person arriving by bicycle 20 guests = 5 cars 1 person arriving in one car 3 people arriving in one car 2 couples arriving in two cars 3 - a family of 3 arriving in one car (3) Applicant's credibility is questioned. Response: To illustrate his claim, Mr. Gartner has called attention to a situation I was involved in many years ago which was resolved to the full satisfaction of the city. In describing that situation, he has distorted the facts in an attempt to malign my credibility. Although this situation does not relate in any way to the current issue, I feel compelled to present a more rational account of what transpired: In 1987 1 converted my garage at 1677 McCollum Street to bedrooms without getting a building permit. It was an error in judgement and I regret having done it. During the summer of 1992 1 was using the bedrooms in the garage as an experimental home hostel, testing the waters so to speak for opening an official hostel. When the garage conversion and hostel activities came to the attention of the City, I offered to immediately cease hostel operations and to cooperate fully to comply with building regulations. Instead of letting me off with a warning as I had hoped, they filed misdemeanor charges against me. After the legal problems were resolved I obtained retroactive building permits, completed the requirements of the Building Department, and was given final approval of the garage conversion by the City. The converted garage has been completely legal since 1992. The second McCollum Street Code Violation stems from a microwave oven in one of the tenants' bedrooms which had somehow come to the attention of the Zoning Department. I was no longer living in the house but as the owner I was sent a Notice of Code Violation by Rob Bryn. Even though I doubted that the mere presence of a microwave oven in a bedroom was unlawful, I called the tenant and asked him to remove it and I sent a letter to Rob Bryn (or called, I can't remember which) to that effect. I did not hear back from Mr. Bryn so I assumed the matter was resolved to the City's satisfaction. On February 27, J98, I received a Notice of Cow Violation in regard to an enclosure that was constructed within the hostel garage. This enclosure was originally built to secure hostellers' touring bikes and took up about one quarter of the garage. During the winter when we have very few cyclists, staff members have asked to be allowed to sleep there, since it affords more privacy and quiet than the rest of the hostel. This enclosure has .never been used by hostel guests. The placement of the enclosure in the garage allowed only one .car to be parked inside, but there was ample room for at least six more cars to park outside the garage. Although this parking arrangement changed our use permit parking plan, it met and exceeded the intent of the use permit. Two months ago when I entered the contract with Lambda Chi Alpha to trade properties, the fraternity requested that I remove the partitions inside the garage to allow for their increased parking requirements. I had arranged to have this done before receiving the Notice of Code Violation. On March 6 1 wrote a letter to Rob Bryn advising him that the entire garage was now available for parking, and I have not .heard anything more about it. Again, I assume the matter has been resolved. Mr. Gartner has gone through my public file with the City and obtained copies of: these Notice of Code Violations in order to illustrate that in his opinion "Applicant Elaine Simer has demonstrated time and again by her actions that she is willing to circumvent the law and violate conditions of permits when it so benefits her." I hope you will put his statements in their proper perspective and not form an opinion about me based upon his allegations. Thank you for your attention.
