SUBJECT: APPROVAL OF AGREEMENT WITH COUNTY OF SAN LUIS
OBISPO FOR JOINT OPERATION OF BISHOP PEAK TRAIL
CAO RECOMMENDATION
Approve, and authorize the Mayor to sign an agreement with the County of San Luis Obispo for
the joint operation and maintenance of the trail to the summit of Bishop Peak.
DISCUSSION
In March of this year, the City Council authorized a grant application for $7,500 from the Steve
Symms National Recreational Trails Fund, which is administered by the State Department of
Parks and Recreation. This application had the support of the County Parks Department, and
was intended to work in tandem with a 1996 grant received by the County Parks Department,
which had been supported by the City. We have already received favorable feedback from the
State on our application; however, they have requested something stronger than our mutual
letters of support. To accommodate this request (which we believe will place our grant
application in a very favorable position), and to memorialize the intent of both agencies to
cooperate in both construction of the trail and in its maintenance and operation, staff has
developed the attached agreement. This agreement spells out the mechanism by which both
parties will cooperate in the operation and maintenance of the trail. The Department of Parks and
Recreation has asked for this agreement by April 17, 1998, in order to have it for their submittal
to the Federal government,which is the source of the grant funding.
CONCURRENCES
The City of San Luis Obispo Parks and Recreation Department and San Luis Obispo County
Parks and Open Space Division both support this agreement as being consistent with past
cooperative efforts and the intent for continued future cooperation.
FISCAL IMPACT
This agreement would memorialize the cooperation that has gone into the Bishop Peak Trail
project to date, and the clear intent of both City and County park staffs to work together on
operation and maintenance of the trail once construction is completed. It would neither increase
nor decrease the anticipated minor costs of trail operation and maintenance. Resources are
currently available in the Park Ranger program budget and the Natural Resources program
budget to cover anticipated costs.

AGREEMENT FOR JOINT OPERATION OF BISHOP PEAK TRAIL
This AGREEMENT FOR JOINT OPERATION OF BISHOP PEAK TRAIL is entered into
this day of , 1998, by and between the City of San Luis Obispo
("City") and County of San Luis Obispo ("County") with respect to the following
RECITALS
WHEREAS, City is owner of approximately 250 acres of the summit and upper
slopes of Bishop Peak; and
WHEREAS, County is manager of approximately 110 acres of State-owned
property on the upper slopes of Bishop Peak; and
WHEREAS, both City and County, and citizens of City and County, have been
interested in the development of a pedestrian trail to the summit of Bishop Peak for
many years; and
WHEREAS, County has received funds from the State of California in support of
said trail, which would traverse both City and County properties; and
WHEREAS, City is applying for additional funds for said trail in order to develop
a route to the summit which minimizes the trail's negative environmental effects; and
WHEREAS, both parties are aware and supportive of the others' efforts in this
project; and
WHEREAS, it has been the intent of both City and County Parks and Recreation
Department staffs to jointly maintain and operate said trail once constructed; and
WHEREAS, the State of California, Department of Parks and Recreation, has
requested that this intent be memorialized by a written Agreement.
NOW, THEREFORE, the parties hereby agree:
1. The City and County Parks and Recreation staff will cooperate on the
construction of the trail from its beginning point on City property, crossing on to County
property and back on to City property.
2. The parties will cooperate in the daily operation and maintenance of said trail
once construction is completed, including enforcement of both parties' rules and
regulations regarding public use of the trail and the properties in general; and
3. The Director of Parks and Recreation for City and the Parks Manager for County
shall meet at least annually prior to initiation of budget discussions for their respective
agencies to determine needs for trail maintenance, patrol activities and other
operational matters to determine the most effective means of addressing those needs
for the coming fiscal year, and
4. Upon agreement of the Director and Parks Manager, both parties will place in the
appropriate location in their departmental budgets sufficient funds to meet those needs
for the coming fiscal year.
