SUBJECT: SANTA ROSA STREET BRIDGE DESIGN CONTRACT
AMENDMENT
CAO RECOMAMNDATION
1) Approve the amendment to the agreement for the Santa Rosa Street Bridge and authorize the
City Engineer to execute it.
2) Appropriate$ 2,660 from the unappropriatedbalance of the General Fund and$10,640 in grant
revenue and move it to 400.9082.520.552 for Santa Rosa Street Bridge design services.
3) Direct Finance to encumber an additional $1,840 in 400.9082.520.550 and$14,800 in
400.9082.520.552 to Quincy Engineering.
DISCUSSION:
The Santa Rosa Street bridge over San Luis Obispo Creek was identified by the State of California
Department of Transportation as deficient For the past year, a consultant worked to complete the
design of the bridge and obtain the necessary permits for construction. The design is complete
except for those things relating to conditions of the permits. The permits and right of way
necessary for construction are still pending. Eighty percent of the design and construction costs
will be funded through the Federal Highway Bridge Replacement and Rehabilitationprogram.
The designers for the Santa Rosa street bridge requested additional funds to cover changes in the
scope of work. Staff looked at the request for changes in scope to determine if they were valid.
Staff determined there are three items considered"out of scope."
The first item is a design feature called sill walls. These are used to limit the scouring of the
creek bottom. The second is compliance with Army Corps of Engineers(ACE)requirements in
order to complete our permit. The third item relates to additional effort needed to acquire a
construction easement.
Staff does not see a workable alterative to the additional work scope for the designers.
Completion of the remaining work by City staff will only delay other projects in the Capital
Improvement Program.
Sill Walls
The existing bridge walls are mostly exposed due to the erosion of the creek bottom. City records
show the creek has scoured down about 2 meters (6 'h feet) at the bridge over the last 25 years.
The new bridge is designed with deeper walls on either side. This depth allows the bridge to
remain standing as the creek bed erodes. If erosion was severe,the bottom of the walls would be
exposed and the roadbed behind the walls would fail. The bridge would not fail because piles,

which go down into the bed rock, support the walls. In addition to the loss of the road bed, staff
is concerned about the adjacent creek wall of the Frank Lloyd Wright building. The building sits
at the comer of Santa Rosa and Pacific streets and is the only Frank Lloyd Wright building in the
County. The footing for the creek wall built with the Frank Lloyd Wright building is exposed.
Erosion of the creek bed will ultimately undermine this wall.
Staff feels the sill walls have substantial benefits. The sill walls will give the new bridge long
term protection by limiting the channel depth. They will also lessen the undennining of
upstream improvements and natural creek banks. The new bridge walls could be designed
deeper for protection in lieu of the sill walls, but that would not provide the benefit of limiting
the channel depth.
The sill walls are low in the creek with notches to allow for fish passage. The ACE indicated
they are in favor of the sill walls because of the long term benefits; however, they also have
concerns regarding construction. The sill walls were not in the original project scope. The
consultant must design the walls. They must put together additional support information for the
ACE to justify the construction of the sill walls and to discuss the impacts on the wetland habitat.
Permits
In the last year,the ACE increased the amount of biological information they require before
considering a permit complete. Part of this is due to the placement of Steelhead trout on the
endangered species list. The presence of endangered species or potential habitat means the City
must have a Consultation with the Department of Fish and Wildlife (F&W)and National Marine
Fisheries(NMF). The City is preparing additional biological information for the permit
application to ACE and for the consultation with F&W and NMF. The permit and consultation
are necessary to complete the construction of the bridge.
The listing of the Steelhead took place after the consultant submitted their proposal. The ACE
has also issued a revised set of permit conditions since the proposal submittal. The consultant
must spend additional time reviewing the new biological information and incorporating it in the
permit application. They will also need to be involved in the consultation with F&W and NMF.
There is a possibility the ACE will require this project to go through an individual permit
process. This is different than the normal permitting process for our construction projects. If the
ACE requires an individual permit,the consultants agreement will have to be revised again.
Significant effort is needed for individual permits. Until we get a complete permit application in,
we will not know what the ACE determination will be. The consultant and staff feel we have a
very good chance of getting the project through under the normal permit process.
Ri t of Way
The City is in the process of acquiring seven temporary construction easements. Most of these
are for stream diversion in the creek during construction. A stream diversion consists of a pipe
placed in the channel to move the creek water through the site. The pipe allows fish to pass
through the construction unobstructed. We have reached an agreement with all but one property

owner. The owner is difficult to reach due to his own schedule and has concerns about the
project. We are working with the owner continually. The time spent is beyond what could be
anticipated for such an acquisition.

*Existing contract amount for the design consultant has already been subtracted. Expenses relating to
biological work do not currently show in the Finance records and are accounted for in a reduced
encumbrance from the balance.
** The bulk of these funds will be needed for actual payment to property owners for easements and are
not available for right of way agent services.
This project is eligible for 80%reimbursement. The City will pay 20%of the additional costs. The
additional appropriation from the General Fund Balance will not significantly impact the City's
policy goal of a 20%fund balance.

AMENDMENT ONE TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis
Obispo on this day of , 1998, by and between the CITY
OF SAN LUIS OBISPO, a municipal corporation, herein after referred to as City, and Quincy
Engineering hereinafter referred to as Consultant.
WITNESSETH:
WHEREAS, on December 31, 1996 the City entered into an Agreement with
Consultant for design services for the Santa Rosa Street Bridge; and
WHEREAS, the City desires to amend the scope of services to include additional
design services as outlined on the attached work scope;
NOW THEREFORE, in consideration of their mutual promises, obligations and
covenants hereinafter contained, the parties hereto agree as follows:
1 . The scope of services and related compensation is hereby amended as set
forth in Exhibit A attached hereto.
2. All other terms and conditions of the Agreement remain in full force and
effect.

Work Scope - Santa Rosa Street Bridge
Amendment One to Agreement
The following outlines the major elements necessary to complete the extra work. It is
understood the Consultant will furnish other minor work associated with the extra work to
make the project ready for construction under the conditions outlined in the original
proposal and under this amendment.
A. Add Sill Walls:
A.1 . Hydraulic Analysis
A.2. Design
A.3. Incorporate sill walls in the contract documents including adjustments to
previously designed elements.
A.4. Provide additional coordination with or information for the City or permitting
agencies with the understanding the City will furnish biological information.
Review and furnish additional biological information to permitting agencies.
